reasons for decision
- This is an ex parte interlocutory motion by the respondent Commissioner seeking confidentiality for certain evidentiary material and exemption from the obligation to file and serve certain documents as required by s 58 of the Administrative Decisions Review Act 1997 (ADR Act).
- The applicant Mr Stefano Constantino Costaras applied to this tribunal on 13 July 2021 for review of a decision taken by the respondent Commissioner on 5 July 2021 following an internal review to affirm an original decision dated 2 June 2020 to refuse his application for a category AB firearms licence.
- The grounds for refusal given by the adjudication officer in the 2 June 2020 decision were that information is maintained by the New South Wales Police Force stating that the applicant was charged with assault occasioning actual bodily harm and destroying or damaging property on 21 May 2008, of which charges he was found guilty. The charges resulted from an incident on 20 May 2008 in which he damaged a vehicle with a baseball bat, causing injuries to the two occupants. That event also resulted in an apprehended violence order (AVO) being granted against him on 22 October 2008, expiring on 22 October 2009. The AVO was revoked on 28 March 2011.
