DECISION
- The Construction, Forestry, Mining and Energy Union (New South Wales Branch) ('CFMEU') has made an application pursuant to section 142 of the Work Health and Safety Act 2011 ('WHS Act') for the authorising authority, being the Industrial Relations Commission, to deal with a dispute about the exercise, or purported exercise, by a WHS entry permit holder of a right of entry under the WHS Act.
- The respondent to this application, Acciona Infrastructure Australia Pty Ltd and Ferrovial Agroman (Australia) Pty Ltd t/as the Pacifico Acciona Ferrovial Joint Venture ('Pacifico'), is undertaking a major road construction project on the Pacific Highway between Warrell Creek and Nambucca Heads in northern New South Wales ('the Site'). This project involves the upgrading of a 20 kilometre stretch of the highway and the construction of some 15 bridges as well as interchanges and access ramps.
