China Railway Materials (Australia) Pty Ltd v Aurora Metals Limited

THE COURT ORDERS THAT:

1. To the extent necessary, the plaintiffs are granted leave to proceed against the defendants pursuant to s 440D of the Corporations Act 2001 (Cth) (Corporations Act).
2. Pursuant to s 588FM of the Corporations Act, the dates listed in the second column of the Annexure to these Orders are fixed as the time for the plaintiffs to register each of the registrations set out in the first column of the Annexure, respectively, for the purposes of s 588FL(2)(b)(iv) of the Corporations Act.
3. Messrs David Osborne, Richard Tucker and Tony Miskiewicz, being voluntary administrators appointed to each of the defendants, are to take steps to cause notice of these Orders to be given, within one business day of making these Orders, to: the creditors (including persons claiming to be creditors) of the defendants in the following manner: (i) where the defendants have an email address for a creditor - by notifying each such creditor, via email of the making of the Orders; and (ii) where the defendants do not have an email address, by publishing the Orders on the website maintained by the second respondents, and the Australian Securities and Investments Commission, by its email address.
4. Any person who can demonstrate a sufficient interest to vary or discharge Order 2 of these Orders (including any creditor of any of the defendants) has liberty to apply to the Court within 28 days of the date of these orders and on two business days' written notice to the parties to these proceedings.
5. There be no order as to costs. Note: Entry of orders is dealt with in Rule 39.32 of the Federal Court Rules 2011.
