3) All correspondence between Stephen Thomson and DHS in regards to my case.[3]
(1) The objects of this Act are to give the Australian community access to information held by the Government of the Commonwealth, by:
(a) requiring agencies to publish the information; and
(b) providing for a right of access to documents.
(2) The Parliament intends, by these objects, to promote Australia's representative democracy by contributing towards the following:
(a) increasing public participation in Government processes, with a view to promoting better - informed decision - making;
(b) increasing scrutiny, discussion, comment and review of the Government's activities.
(3) The Parliament also intends, by these objects, to increase recognition that information held by the Government is to be managed for public purposes, and is a national resource.
(4) The Parliament also intends that functions and powers given by this Act are to be performed and exercised, as far as possible, to facilitate and promote public access to information, promptly and at the lowest reasonable cost.
(4) The agency or Minister is not required by this Act to give the person access to the document at a particular time if, at that time, the document is an exempt document. > > Note: Access may be given to an exempt document apart from under this Act, whether or not in response to a request (see section 3A (objects--information or documents otherwise accessible)). > > (5) The agency or Minister must give the person access to the document if it is conditionally exempt at a particular time unless (in the circumstances) access to the document at that time would, on balance, be contrary to the public interest.
(a) explanation for delay, length of delay and whether the Applicant has rested on their rights > > (b) prejudice to the Respondent or other person affected by the decision and consideration of fairness as between the applicant and other persons in a similar position > > (c) strength of the Applicant's case and the significance of the issue to be determined, and > > (d) the availability of alternative remedies for the Applicant.
Explanation for delay, length of delay and whether the Applicant has rested on their rights
'the Australian Government has subjected me to a cruel cover up for 14 years. Hence this field is too small to outline my reasons for applying for an extension of (sic). I have already emailed the outline to Sydney.registry@art.gov.au. I have also put the outline in the appendix to this form'.
Prejudice to the Respondent or other person affected by the decision
Consideration of fairness as between the applicant and other persons in a similar position
Strength of the Applicant's case and the significance of the issue to be determined
(a) key evidence ignored > > (b) rationales vacuous and nonsensical, > > (c) refusal to meet with me in person.
'it is not readily apparent to me why the Agency felt compelled to maintain its denial of access to the documents at issue in this IC review. The documents seem to disclose very little more than what was necessarily disclosed to the applicant in the final version of the correspondence sent to him. Again, the fact that the documents might be thought - in this case, incorrectly - to attract legal professional privilege does not necessitate denial of access. Consistently with the evident pro-access parliamentary intention underpinning the FOI Act, it was open to the Agency to consider providing access to the relevant documents at all stages of this matter, including by way of a revised decision under s 55G of the Act once the matter had proceeded to IC review.'
