Background
- The respondent carried out residential roofing works, in connection with a carport and awning at the appellant's home. The appellant was dissatisfied with the work and contended as follows: there was water leakage; the dimensions of the constructed works were different from that shown on the sketch plans provided by the respondent; and the work had not been carried out in a proper and workmanlike manner.
- The appellant lodged a complaint with the Home Building Service of the Department of Fair Trading. The senior building inspector determined that the work had been done in a proper and workmanlike manner, despite agreeing with the appellant that the dimensions of the constructed works were marginally different from that shown on the sketch plans provided by the respondent.
