s.394 - Unfair dismissal
Application for relief from unfair dismissal - public health order requiring vaccination against COVID-19 - valid reason for dismissal - dismissal not harsh, unjust or unreasonable - application dismissed.
"Vaccination is strongly encouraged to prevent a range of deadly and debilitating diseases in Australia. Vaccination is not compulsory in Australia and it will not be compulsory to have a COVID-19 vaccine.
However, a COVID-19 vaccine is the best way to protect the Australian community from this virus. As such, we want to achieve the highest rate of vaccination possible. The Government will explore all avenues to achieve this goal, guided by the advice of medical and scientific experts."
"Vaccination will be mandatory for all other (outside of LGAs of concern) early childhood education and care educators and staff by 8 November. Two doses of the COVID-19 vaccination will be required by this date and an updated Public Health Order is expected soon."
"Thank you for keeping us all updated on everything COVID-19 and vaccination related. The communications and information from you are very much appreciated.
I am emailing you to get some clarity with regards to the requirement for all early childhood education staff to have two doses of the COVID-19 vaccination by the 8th of November.
Can you please advise me of what will happen to staff members after this date if they are unable to receive two doses of a COVID-19 vaccine injection? I have seen that you have mentioned a few times that it is required but I am not clear on what the outcome will be if I am unable to obtain a vaccine by this time.
Thanks for your understanding and support. I look forward to hearing a response to this matter."
"As discussed, if a medical condition that may resolve is currently stopping you from getting the COVID vaccination - can you please ask your Doctor to fill out Section B of the below form and provide us with a copy before the 8th of November?
If you believe this will be an issue please discuss with us further.
I also need to send out another more general email regarding the public health order."
As an update, the 'Public Health Order' was passed last week that means all childcare educators & staff at childcare centres are required to get two shots of a COVID vaccine or have a medical contraindication certificate before the 8th of November and present evidence to their employer.
In short, we need to ensure all workers to be vaccinated to reduce the risk of bringing COVID into the centre and passing it to the unvaccinated children.
This is now law and doesn't provide us with any options. If anyone thinks they will have an issue talk to myself or Michelle as soon as possible..."
Ms Peden: "What are your vaccination plans? Do you have a contraindication certificate from your medical practitioner?"
Ms Mitchell: "I have been to a couple of doctors and no one will provide me a contraindication certificate."
Ms Peden: "That is not an option without a contraindication medical certificate or double vaccination. There's a directive from government, it's not my choice."
Ms Mitchell: "I won't undergo a medical experiment."
Ms Peden: "I need to see proof of a vaccination or a contraindication certificate in order for you to keep working. We don't want to lose you, have a think about what you want to do."
Ms Peden: "Have you got a medical contraindication form?"
Ms Mitchell: "I can't get one. I have been to a couple of doctors and no one will fill in the form."
Ms Peden: "You won't be able to come into the centre unless you have been vaccinated or been given a contraindication certificate. What are your plans?"
Ms Mitchell: "I'm worried about getting the vaccination, I don't want to get it."
Ms Peden: "There's been other staff who have been concerned about the vaccine who have now had it. I've had it. Please talk to a GP, and get more information.
Think about what you'd be giving up if you don't get vaccinated. You won't be able to work for us. You would be throwing away your job with us and you won't be able to work in the industry as a teacher.
We don't want to lose you. Take the weekend to think about it. You can go to Belmont for a walk-in vaccination. If you get vaccinated in the next week, you would be fully vaccinated in four weeks, by 28 November."
"I am emailing to enquire about my options come November 8. I value my position at Kinda Kapers and view this as my home. I have no intention of working elsewhere and have invested a lot of time effort and money to get to where I am now in this company. I believe that I am a valuable asset to the children, my colleagues, the community and the company, and wish to continue being so well into the future.
You called on Wednesday to ask me my plan. My only plan is to continue to work for Kinda Kapers to the best of my ability like I have done since I started with you 6 years ago. Until recently the thought of not being able to work with you had never crossed my mind and this whole situation has taken a toll on me both mentally and physically.
I would appreciate if you would support me in making any adjustments necessary so I can continue to be a valuable asset for Kinda Kapers and to help keep my livelihood intact. As you can imagine this has caused me great stress in the main issue for me is I don't know what you plan to do with me after November 8.
I have been advised to send you a notice but at this stage I would just like for you to email me what my options are from November 8. As I said, the only option I want to take is to continue working for Kinda Kapers like I have done for so many years. I hope you can take into consideration the contributions that I have made and will continue to make to Kinda Kapers into the future.
"I truly feel for you and the difficult position you find yourself in. You are a valuable and respected member of our team. We have never considered losing you up to this point.
When I asked you for a plan I was only talking about your plans, if any, for vaccination. You are in the position of needing to adhere to the guidelines set down by the NSW Department of Health. These are clear. You are unable to attend the centre if you remain unvaccinated after the 8th of November 2021.
At this point we will need to stand you down from November 8th 2021 up until the 28th November. If at that point you can demonstrate proof of 1st vaccination or an appointment to achieve first vaccination then we will extend your standdown until you are double vaccinated. Once you are double vaccinated we will be able to offer you shifts again.
If unfortunately you still remain unvaccinated with no plans to vaccinate we will have no options other than to terminate your contract due to an inability to meet the inherent requirements of the role."
"Thanks for the quick reply. Can you please define for me what the term "stand you down" will look like? Could I work from home or am I able to access my leave since the situation has caused me so much stress.
With reference to my plans to be vaccinated or not I am still waiting to make an informed decision regarding this. Unfortunately at this time no one has been able to guarantee that I won't sustain any damage from this medical procedure and as a result I have not been able to give my informed consent at this point in time.
"Again I am very sorry for the stress you are experiencing. Please see below the definition of "stand down" as per the Fair Work Act.
"Under section 524 of the Fair Work Act, an employer can stand down an employee without pay where they can't usefully be employed because of a stoppage of work for any cause for which the employer can't reasonably be held responsible."
There is a Health order in place with which it anyone working in childcare or education must be double vaccinated by November 8th or you are not permitted to be on site. You must abide by this health order and so can not attend site. Therefore we can not currently offer you any alternative duties as your duties are primarily the care and education of children. This is why we have made the difficult decision to stand you down until the 28th November 2021.
Again we are devastated that he has come to this but we are obligated to support the health directive for the safety and well-being of the children in care for.
Again Ash if at any time you choose to become vaccinated we are more than happy to employ you. You have been an exceptional employee."
"Am I entitled to any paid leave though? I have just read the section of legislation that you directed me to and I also read through Section 525 that goes on to say - Note: An employee may take paid or unpaid leave (for example, annual leave) during all or part of a period during which the employee would otherwise be stood down under subsection 524 (1).
I don't often read legislation but to me this seems as though I can take paid leave?
"Yes you are able to access annual leave entitlements during your standdown period.
I will ask Lydia to forward you a leave application today. I am sorry but I am unaware of how many hours of annual leave you currently have. Any remaining annual leave entitlements on November 28th they will be paid if we terminate your contract.
Again please keep us up to date with any changes in your vaccination status."
"In relation to your employment with Kinda Kapers Toronto Pty Ltd we write to inform you that, due to circumstances outside Kinda Kapers Toronto Pty Ltd control as set out below, Kinda Kapers Toronto Pty Ltd finds it necessary to formally stand you down from your employment as of Monday, 8th November 2021 until 28th November 2021.
There is a Health order in place with which anyone working in childcare or education must be double vaccinated by November 8th or you are not permitted to be on site. You must abide by this health order and so cannot attend site. Therefore, we cannot currently offer you any alternative duties as your duties are primarily the care and education of children. At this point we will need to stand you down from November 8th up until the 28th November. If at that point you can demonstrate proof of first vaccination or appointment to achieve first vaccination then we will extend your stand down until you are double vaccinated. Once you are double vaccinated, we will be able to offer you shifts again.
If unfortunately you still remain unvaccinated with no plans to be vaccinated we will have no options other than to terminate your contract due to an inability to meet the inherent requirements of the role.
Please note that being stood down does not break your employment relationship. Your benefits including Annual Leave, Personal Leave, Long Service Leave & Maternity Leave are maintained.
We are devastated that it has come to this but we are obligated to support the health directive for the safety and well-being of the children we care for."
Lidia sent through a leave application form for you on Tuesday 2nd November as requested. We were wondering if you could fill it in and return it if you would like to access annual leave for the week beginning the 1st November.
I am not working tomorrow and would like to process the leave form to enable you to be paid annual leave this week, if possible today."
"Due to the mental and physical toll this whole situation is taken on me and my family, I will be taking sick leave for the foreseeable future. I don't think I could return to work even if I was allowed to after the affect this whole situation has had on me.
I have been getting support from my psychotherapist and will have a letter to confirm my health status to you early next week.
During this time I will attempt to get support to remedy the situation.
In response to your email for leave this past week, I don't require it as I received pandemic relief from Centre Link but I appreciate the offer.
"We have had a series of conversations with you regarding the requirement of COVID vaccinations over a period of months. Due to an unforeseen change in circumstances we are taking the disappointing decision to terminate your employment contract effective immediately.
This decision has been made due to your unwillingness to meet the inherent requirements of your job, that being seeking COVID vaccination as per a NSW Public Health directive.
We would like to take this opportunity to thank you for your contribution to Kinda Kapers and wish you all the very best in the future.
All entitlements outstanding and owing will be paid to you."
From November 8th childcare centres and schools are under an NSW Public Health directive to ensure all people, educators, cooks, and men and visitors are double vaccinated against COVID-19. Kinda Kapers are very excited and proud to say all staff at Toronto Kinda Kapers are double vaccinated! This assists us to keep our children safe by reducing the risk of introducing COVID-19 into the Centre.
Unfortunately, Ash Mitchell, an extremely valued member of our team remains unvaccinated. We are very sad and disappointed that Ash can no longer be a part of the Kinda Kapers team. Should Ash change her mind in the coming months and seek vaccination we are hopeful she can re-join our team.
We are now advertising for a replacement educator. In the meantime, Claudia Harmen will step into the role of Educational Leader..."
"Thanks for the email. Can you please elaborate on this unforeseen change in circumstances. I will also require some evidence of these conversations that you are describing. I only recall receiving recent communications from you which stated that I had up until November 28th to "demonstrate proof of 1st vaccination or an appointment to achieve first vaccination." Ryan Peden reiterated this point by a letter on Wednesday November 3rd. Apart from that I don't recall having any communications explicitly sent to me regarding this matter.
I will also need to see evidence in my original employment contract which states that vaccination is a condition of employment with Kinda Kapers. If this is the case, I will be more than happy to receive a COVID-19 vaccine, as long as you can show me where I have signed and agreed to this in my employment contract.
I will also require evidence that proves that I have not been seeking a COVID-19 vaccination as you have now just implied since our last email correspondence on November 2nd. At this point in time I have taken sick leave due to the amount of stress that your actions have caused and since you did not respond to the email that I sent to you on Friday November 5th regarding sick leave, it was taken that you accepted this form of leave.
I will be following this up as I'm not once ever stated to you in writing that I would not be taking a COVID-19 vaccination and I believe that the termination of my employment contract is unlawful, unless proven otherwise."
"I have consulted our solicitors and confirm you are unable to meet the inherent requirements of the job. To meet the inherent requirements of the job you must be fully vaccinated against COVID19. Due to this you have been allocated no rostered hours of work and therefore you are unable to access sick leave.
We have also been advised to pay your annual leave entitlements when we finalise your contract on 28 November. There [sic] any application for annual leave over the next three weeks will be declined due to insufficient staff to cover your position."
"I have just received a few messages from some concerned parents of the Kinda Kapers' community. I've been told that you have forwarded out to the Kinda Kapers' mailing list a description of my private medical information.
Can you please clarify where you received permission from me to do this and under what authority.
I am absolutely distraught that you have divulged my private medical information out by email to the wider community."
1. We are required by regulations to meet certain staffing requirements. This means we must fill your position.
2. The requirement for COVID vaccination comes from a NSW Department of Health directive.
3. With regard to sick leave please see email dated Monday 8th November at 11:47am. This email responded to your sick leave enquiry.
4. Multiple emails were sent to you outlining the dates by which you were required to have COVID vaccinations.
5. You have expressed to your manager and to management that it is not your intention to seek COVID vaccinations at this time."
"I advise you to read the two emails I have sent you today. I am very upset and disappointed that this is the way that you have decided to treat me during this time."
"As mentioned in my previous email I require evidence of the points that I raised, I don't see any evidence in response. My understanding is that I have a contract with you (Kinda Kapers) not NSW Health. I have been through my emails and have not seen a response to me taking sick leave as you have just mentioned (dated Monday 8th November at 11.47am) also nothing else addressed to me personally regarding the COVID-19 vaccination. Apologies if I have this wrong. Can you please resend through the emails addressed to me personally that you are referring to.
Please provide this evidence when you can and then evidence that I have given you permission to divulge my private medical information to the Kinda Kapers' community."
(a) Ms Mitchell's application for unfair dismissal was made within the period required in s 394(2) of the Act;
(b) Ms Mitchell was a person protected from unfair dismissal;
(c) the Small Business Fair Dismissal Code did not apply to Ms Mitchell's dismissal; and
(d) Ms Mitchell's dismissal was not a genuine redundancy.
Was the dismissal harsh, unjust or unreasonable?
62 Making of public health orders relating to person with Category 4 or 5 condition or contact order condition (cf 1991 Act, s 23)
(1) An authorised medical practitioner may make a public health order in respect of a person if satisfied, on reasonable grounds, that -
(a) the person has a Category 4 or 5 condition and because of the way the person behaves may, as a consequence of that condition, be a risk to public health, or
(i) has been exposed to a contact order condition, and
(ii) is at risk of developing the contact order condition, and
(iii) because of the way the person behaves, may be a risk to public health.
(c) must state the grounds on which it is made, and
(d) must state that, unless sooner revoked, it expires -
(i) if the public health order is made in respect of a person referred to in subsection (1)(b) - at the end of the period specified opposite the relevant condition in Schedule 1A, or
(ii) in any other case - at the end of a specified period (not exceeding 28 days),
after it is served on the person subject to the order.
An order based on a Category 5 condition expires after 3 days unless an application is made for its confirmation (see section 63(2)).
(3) A public health order may require the person subject to the order to do any one or more of the following -
(b) to undergo specified treatment (whether at a specified place or otherwise),
(c) to undergo counselling by one or more specified persons or by one or more persons belonging to a specified class of persons,
(d) to submit to the supervision of one or more specified persons or of one or more persons belonging to a specified class of persons,
(e) to notify the Secretary of other persons with whom the person has been in contact within a specified period,
(f) to notify the Secretary if the person displays any specified signs or symptoms,
(g) to undergo a specified kind of medical examination or test relating to the condition for which the order was made.
(4) A public health order may authorise the person subject to the order -
(a) to be detained at a specified place for the duration of the order, or
(b) in relation to an order that requires the person to undergo specified treatment at a specified place - to be detained at that place while undergoing the treatment.
(6) In deciding whether or not to make a public health order, the authorised medical practitioner must take into account -
(a) the principle that any restriction on the liberty of a person should be imposed only if it is the most effective way to prevent any risk to public health, and
(b) any matters prescribed by the regulations for the purposes of this section.
(7) A public health order may include provisions ancillary to, or consequential on, the matters included in the order.
(8) A public health order does not take effect until it is served personally on the person subject to the order.
(9) The authorised medical practitioner making the public health order must give the person subject to the order -
(a) information about the duration of the order, and
(b) information about the person's rights of review in relation to the order, and
(c) any other information prescribed by the regulations.
(10) Failure to give the information specified in subsection (9) does not invalidate the order.
"Although it was contended that the impugned orders interfere with a person's right to bodily integrity and a host of other freedoms, when all is said and done the proper analysis is that the impugned orders curtail freedom of movement which in turn affects a person's ability to work (and socialise). So far as the right to bodily integrity is concerned, it is not violated as the impugned orders do not authorise the involuntary vaccination of anyone. So far as the impairment of freedom of movement is concerned, the degree of impairment differs depending on whether a person is vaccinated or unvaccinated. Curtailing the free movement of persons including their movement to and at work are the very type of restrictions that the PHA clearly authorises."
(a) she was an education and care worker within the meaning of the Public Health Order; and
(b) she worked in an education and care facility within the meaning of the Public Health Order.
