- The claimant claimed that he had sustained several injuries as a result of the accident which occurred when the car in which he was a backseat passenger was hit from behind by another motor vehicle. In his application for personal injury benefits, the claimant said that as a result of the accident he sustained injuries to his neck, middle and lower back and left and right shoulders, and psychological injury.
- The insurer disputed that any of the claimed injuries were non-threshold injuries caused by the motor accident.
