- The application pursuant to s 75 of the Victorian Civil and Administrative Tribunal Act 1998 is granted. Paragraphs 13 to 19 (inclusive) of the Applicant's Amended Outline of Legal Contentions dated 31 March 2011 are struck out.
- The Applicants ('ABY, ABZ') have commenced proceedings in the Tribunal to review a decision made by the Patient Review Panel ('the Respondent') pursuant to s 91(1)(b) of the Assisted Reproductive Treatment Act 2008 ('the ART Act'). The decision subject to review was that a presumption against treatment applies in respect of one of the Applicants.
- In July 2010 ABY completed a 'Presumption Against Treatment' application in respect of prospective IVF treatment she and her partner, ABZ, sought to undertake through a registered ART provider. That application attached police record checks in respect of ABY and ABZ which showed that a presumption against treatment existed as a result of ABZ's criminal record.
