Zoological Parks Authority Regulations 2002

The Regulations rely on a small set of structural concepts that determine how powers are exercised and how liability attaches.

Permission as a gating concept (regulation 4)

• "Permission" is a prerequisite for many otherwise prohibited acts. It is defined functionally: permission means the Authority’s permission (regulation 4(1)). The Authority may refuse, grant generally or in a case‑by‑case way, attach terms (including limiting places, classes of persons and fee conditions) and may amend or revoke permissions (regulation 4(2)-(3)). Permissions must be in writing and obtained in advance (regulation 4(4)). Non‑compliance with a condition is taken as a lapse of permission in prosecutions (regulation 4(5)). Mechanically, the written, pre‑commencement requirement places the administrative onus on prospective users and commercial actors to secure a formal approval and to maintain compliance with conditions.

Entrance gates, tickets and deemed liabilities (regulations 5 and Schedule 1 Form 1)

• Entry is restricted to entrance gates unless the Authority permits otherwise (regulation 5(1)) and entry without an entry ticket is prohibited (regulation 5(3)-(4)). Where vehicle offences occur the Form 1 "notice to owner" procedure (Schedule 1 Form 1, referencing s 42 of the Act) allows the Authority to require an owner to identify the driver within 28 days or else be deemed liable unless they show theft or unlawful use. That procedure shifts administrative burdens to owners of vehicles and creates an evidential presumption unless rebutted.

Traffic control and vehicle equipment (regulation 10 and 11)

• The Authority may designate parking areas, set parking charges displayed on traffic signs and require payment via ticket vending machines (regulation 10(6)). Vehicles must not exceed 10 km/h (regulation 10(4)), must be driven only on designated roads/areas (10(3)(a)), and must be equipped to produce a warning sound or have lights/hazard lights on (10(5)). Traffic signs established by the Authority have operative force and directions from park management officers about vehicle movement are legally binding (regulation 11). The Authority determines both the spatial regulation of vehicles and the immediate tactical enforcement via signs and officers.

Protection of animals, property and park fabric (Part 4)

• The Regulations criminalise interference with animals (touching, feeding, placing objects in enclosures) with penalty levels set at $2,000 for many such offences (regulation 12). They also address structural integrity: interdictions on entering enclosures, interfering with locks/gates, damaging rockwork, pools, water features or vegetation, and a $2,000 penalty for climbing fences (regulations 13-15). These provisions create a strong legal boundary around exhibits, staff areas, quarantine zones and infrastructure.

Behaviour and commercial activity controls (Part 5)

• Use of amplification systems, unauthorised trading, commercial reproduction (photography/film for public display or promotion), performances, public speaking and events are all subject to prior written permission (regulations 20, 28-30). The scheme therefore channels commercial and expressive activity through the Authority’s permission function, with the Authority able to attach locational and financial terms under regulation 4(2)(b)(i)-(iii).

Enforcement mechanisms and administrative penalties (Part 6; Schedule 2)

• The Regulations prescribe fines for offences, and specifically designate multiple offences for modified penalties (Schedule 2) to be enforced by infringement notices under section 43(2) of the Act (regulation 33). The Regulations supply standard forms for notices to vehicle owners (Form 1), infringement notices (Form 2) and withdrawal notices (Form 3) (Schedule 1, regs 32-35). There is also a civil recovery tool for costs of removing vehicles, animals or other things under section 29(2)(c) of the Act (regulation 38).

Interplay with other statutes

• The text explicitly cross‑references or preserves other statutes: the definition of "motor vehicle" is taken from the Road Traffic (Administration) Act 2008 (regulation 3); regulation 17(3) states that regulation 17(1) does not limit section 8 of the Dog Act 1976; litter is defined as in the Litter Act 1979 (regulation 19(1)); a firearm is defined by reference to the Firearms Act 2024 (regulation 25(1)).

Administrative discretion and signage

• The Authority has discretionary spatial powers: it may close parts of a park or roads/tracks for periods it thinks fit and is required to erect sufficient signs (regulation 8). The inscriptions on traffic or closure signs operate according to their tenor (regulations 8(3), 11(2)), which makes the visible signage itself the operative mechanism of restriction.

Defences and evidential points

• There are limited statutory defences: necessity to prevent or mitigate injury or damage for certain access/entry offences (regulation 9), a lost ticket defence for ticket offences (regulation 5(6)), and procedural defenses available under the Form 1 notice (e.g. proving theft or identifying the driver within 28 days).

These core concepts determine where control is centralised (Authority and its written permissions), where enforcement is local and officer‑led (park management officers and signage), and where liability and administrative burdens are placed on park users and vehicle owners.

The Regulations create legal duties and operational friction points for a range of identifiable actors. The text itself identifies the following affected parties and the manner in which they are regulated.

Visitors and members of the public

• Every visitor who enters a zoological park is directly bound by admission and behaviour rules. Visitors must enter through designated entrance gates (regulation 5(1)), pay or possess valid entry tickets (regulation 5(2)-(4)), obey closure signs and directions (regulation 8(1)-(4), 23(1)(a)), and comply with rules that protect animals and property (Parts 4-5). Young visitors raise particular obligations: an adult accompanying children under 12 must keep the child supervised at all times while in the park (regulation 6(1)), and staff may refuse admission to inadequately supervised groups (regulation 6(2)).

Vehicle owners and drivers

• Regulation 10 places a number of obligations on anyone who brings a vehicle into a park: permission is required (10(2)), vehicles must be driven only on designated roads (10(3)(a)), parking is limited to designated areas and may require payment via a ticket vending machine (10(6)-(7)), special disabled parking is conditional on ACROD sticker and presence of a disabled person (10(3)(d)), speeds must not exceed 10 km/h (10(4)), and vehicles must have working warning devices or lights/hazard lights (10(5)). The Form 1 owner‑identification procedure (Schedule 1) places additional procedural burdens on registered vehicle owners where vehicle‑based offences are alleged.

Commercial operators, vendors and performers

• Anyone seeking to sell goods or services, film for public display or promotion, provide rides, perform musically or speak publicly must obtain written permission from the Authority in advance (regulations 27-30). The Authority’s power to grant permission on terms (including fees and spatial limits) is central (regulation 4(2)(b)(i)-(iii)). Unauthorised trading or commercial reproduction carries fines or modified penalties as listed in Schedule 2.

Photographers, film crews, promoters and media

• Regulation 29 requires permission for still or motion picture making where the reproduction is for public display, broadcast, transmission or promotion/sale of goods or services. That places a compliance obligation on commercial photographers and media users to secure permissions and likely pay fees if the Authority conditions permission on payment.

Persons with disabilities

• The Regulations provide a facility for designated disabled parking, requiring an ACROD sticker and presence of a disabled person as driver or passenger (regulation 10(3)(d)). The Authority’s traffic signs and parking designations will determine actual availability, but the text imposes a condition-based privilege rather than an absolute entitlement.

Park staff, volunteers and management officers

• Park management officers are the operational enforcers: they may be asked to check tickets (regulation 5(4)), issue notices and infringement notices (Schedule 1 Form 2), give directions as to vehicle movement and traffic (regulation 11(3)(b)), receive lost property and return it on proof of ownership (regulation 31), and remove vehicles or things leading to recoverable costs (regulation 38, referencing Act s 29(2)(c)). Regulation 22 protects staff against obstruction or insult with an express offence for wilful obstruction or annoyance.

Owners of property and persons whose goods are found in the park

• A finder of lost or apparently abandoned property must hand the item to a park management officer (regulation 31(1)), with a $1,000 penalty for failure. Park management officers must return property on satisfactory proof of ownership (regulation 31(2)). Owners subjected to notices under s 42 of the Act must comply with identification requirements or face being deemed liable (Schedule 1 Form 1).

Event organisers, charities and community groups

• Organised sporting activities, instrumental or vocal performances, and public speaking require permission (regulation 30). The Authority therefore controls permitted community uses of the space via the permission framework, and may impose terms, fees or spatial constraints.

Owners of animals and persons with pets

• Regulation 17 generally bans taking animals or birds into the park without permission and prohibits abandoning or releasing animals without permission (regulation 17(1)-(2)). Regulation 17(3) explicitly preserves section 8 of the Dog Act 1976, signalling an interaction point for dogs; where permitted by that Act, dog access rules may differ.

Persons who engage in behaviour affecting safety or park fabric

• Actions such as touching animals, interfering with enclosures, damaging vegetation, climbing fences, lighting fires, carrying weapons or producing amplified noise are all criminalised (various provisions across Parts 4-5) and tend to attract higher penalties ($1,000-$2,000 statutory fines, modified penalties as set out in Schedule 2).

Local businesses and prospective concession holders

• The Authority’s ability to grant permissions on terms and to charge fees (regulation 4(2)(b)(iii), regulation 10(6)) affects commercial uses within the park, including concessions, filming permits and organised events. Permission is the central instrument that converts the public space into a controllable commercial resource.

Enforcement actors and the courts

• The Regulations prescribe how enforcement is implemented administratively (infringement notices, Forms 1-3) and preserve court action for recovery of debt (regulation 38). The Authority may pursue removal costs as a debt in a competent court and may prosecute offences that are not dealt with by modified penalty payment.

In sum, the Regulations place primary regulatory responsibility on the Authority to set conditions, signs and fees, enable park management officers to enforce them, and allocate a mix of criminal fines and administrative (modified) penalties to deter non‑compliance by visitors, vehicle owners, commercial operators and event organisers.

This section sets out the principal duties the Regulations impose and the rights or procedural protections they provide, citing the relevant provisions.

Key duties imposed on park users and commercial actors

• Obtain written permission before doing acts expressly prohibited without permission: The Regulations repeatedly make activities unlawful "without permission" and define permission as the Authority’s written, pre‑commencement authorisation (regulation 4(1), 4(4)). Examples include bringing vehicles in (regulation 10(2)), commercial reproduction (regulation 29), trading or providing services for fee (regulation 28), using public address systems (regulation 20(1)), taking animals in (regulation 17(1)), and lighting fires except in provided fireplaces (regulation 26(a)).

• Pay and display where parking charges apply: Where an area is designated for parking with a charge fixed by the Authority and specified on a traffic sign, payment into a ticket vending machine and display of a parking ticket showing amount, date and expiry time is required (regulation 10(6)(a)-(b); 10(7)). Failure is an offence.

• Enter only through entrance gates and carry an entry ticket while in the park: Entry through entrance gates is mandatory without permission and entry without an entry ticket is prohibited (regulation 5(1), (3)-(4)). A person must produce a ticket to a park management officer on demand.

• Supervise children under 12: Adults responsible for children under 12 must ensure the child remains under adequate supervision at all times (regulation 6(1)). Staff may refuse admission to groups of children if insufficient adult supervision is present (regulation 6(2)).

• Avoid touching, feeding or disturbing animals and do not enter enclosures or staff or quarantine areas: Regulated under regulation 12 (touching, feeding) and regulation 13 (entry into enclosures, interference with locks, gates, staff/quarantine areas).

• Comply with traffic signs and park management officers’ directions: Compliance with inscriptions on traffic signs and directions or signals from park management officers about vehicle use or movement is a statutory duty (regulation 11(3)). More general directions and signs erected under the Regulations must also be complied with (regulation 23(1)(a)-(b)), subject to exceptions regarding traffic signs or vehicle movement directions as expressly set out in subregs (2) and (3).

• Hand found lost or abandoned property to a park management officer: The finder must hand discovered items to an officer (regulation 31(1)).

• Not remove notices attached to or left in vehicles unless they are the owner, driver or person in charge: Regulation 36 forbids removal of such notices by third parties.

Key procedural rights and defences

• Permission must be in writing and will be judged on whether conditions have been observed: Permission must be in writing and obtained prior to the activity (regulation 4(4)). If a permission was conditional and the person fails to observe the condition, the permission is taken to have lapsed for the period of non‑observance in any prosecution (regulation 4(5)). This is framed as a procedural rule that affects the defendant’s evidential position.

• Defence for necessary acts to prevent or mitigate injury or damage: Regulation 9 provides a defence to certain access offences (regulations 5(1), 5(3), 5(5), 7 and 8(4)) if the defendant proves the act was necessary to prevent or mitigate injury to a person or damage to property.

• Lost ticket defence: For entering without an entry ticket (regulation 5(3)), regulation 5(6) provides a defence if the ticket has been lost.

• Owner‑identification notice procedure and theft/unlawful use defence: Schedule 1 Form 1 (linked to section 42 of the Act) requires an owner to identify the driver within 28 days or demonstrate the vehicle had been stolen or unlawfully used in order to avoid being deemed to have committed the offence. The Form sets out the 28‑day procedural timeline and the consequences for failure to respond.

• Return of lost property on proof of ownership: Park management officers must return property to the owner on satisfactory proof of ownership (regulation 31(2)).

• Withdrawal and refund mechanisms for modified penalties: The Regulations include Form 3 for withdrawing infringement notices and provide for withdrawal with refund where the modified penalty was paid (regulation 35 and Schedule 1 Form 3).

Administrative constructs that determine rights and duties

• The Authority’s power to set fees and conditions: Regulation 4(2)(b)(iii) allows setting payment of fees or charges as a condition of permission. Regulation 10(6) gives the Authority the power to fix parking charges and specify the amount on traffic signs. These provisions convert permissions into conditional economic licences.

• Signage as operative instrument: The Regulations repeatedly state that inscriptions on signs and traffic signs operate "according to their tenor" (regulations 8(3) and 11(2)). This makes the visible sign the legal instrument of restriction or condition in many cases, with obligations on the Authority to erect and maintain sufficient signs where closures occur (regulation 8(2)).

• Modified penalties and infringement notices: The Regulations select a set of offences to be subject to modified penalties under s 43(2) of the Act (regulation 33(1)) and specify the monetary amounts in Schedule 2. The Authority may authorise persons to receive payment of modified penalties (Schedule 1 Form 2 note (6) references s 43(10) of the Act). This creates a parallel administrative enforcement track alongside court prosecutions.

These duties and rights shape behaviour by making many activities conditional on prior written authority and by providing streamlined enforcement via modified penalties for lower‑level breaches, while preserving higher fines and prosecutorial options for serious conduct such as disturbing animals, climbing fences or entering staff/quarantine areas.

The Regulations combine criminal fines, modified penalties and administrative notices to produce an enforcement stack. The text sets out monetary penalties, the offences that attract modified penalties, the forms and notice procedures, and recovery routes for costs.

Criminal fines (statutory penalties)

• Most offences are listed with a specified "Penalty" in the text. Common statutory maximum fines in the Regulations are $600, $1,000 or $2,000 depending on the gravity of the offence. Examples:
  • Entering a zoological park except through an entrance gate: $2,000 (regulation 5(1)).
  • Touching, molesting, shouting at or disturbing an animal; placing objects in an enclosure without permission; feeding animals without permission: $2,000 (regulation 12).
  • Driving a vehicle without a warning device or without lights/hazard lights on: $1,000 (regulation 10(5)).
  • Many conduct breaches such as damage to vegetation, littering, failing to produce a ticket, and parking offences carry $600 fines (regulations 14, 19, 5(3), 10(3)(b)).

Modified penalties and infringement notices

• The Regulations prescribe certain offences for modified penalties for the purposes of section 43(2) of the Zoological Parks Authority Act 2001 (regulation 33(1)). Schedule 2 lists each designated offence and the corresponding modified penalty amount (Schedule 2, columns 2-4).
• Modified penalties are generally lower than statutory maximum fines. Typical modified penalties in Schedule 2 are $60, $100 or $200. For example, entering without an entry ticket is $60 (item 2), touching or disturbing an animal has a modified penalty of $200 (item 19A), and parking contraventions are mostly $60 (items 10-12, 17-18).
• Infringement notices must follow the form set out in Schedule 1 Form 2 and are given under section 43(2) of the Act (regulation 34). The Form sets out the alleged offence, modified penalty sum, and the 28‑day period to pay to avoid court proceedings.

Owner notification and identification procedure (Form 1)

• Where a vehicle is alleged to be involved in an offence, the Authority can serve a notice on the registered owner under section 42 of the Act, with the Form 1 template in Schedule 1 (regulation 32, Schedule 1 Form 1). The Form informs the owner they must identify the driver or prove theft/unlawful use within 28 days, or else be deemed to have committed the offence unless the modified penalty is paid within 28 days (Form 1).
• This procedure places the administrative onus on owners, enabling enforcement where direct identification of the driver at the scene was not possible.

Withdrawal and refund of infringement notices

• The Regulations prescribe a Form 3 template for withdrawing an infringement notice and specify that a paid modified penalty should be refunded if a withdrawal results in refund (regulation 35, Schedule 1 Form 3).

Enforcement actors and powers

• Park management officers are the front‑line enforcement actors: they may demand to see entry tickets (regulation 5(4)), direct vehicle movement and parking (regulation 11(3)(b)), serve notices, accept payments from alleged offenders where authorised persons are appointed (Form 2 note (6)), and take custody of lost property (regulation 31).
• The Authority can impose civil recovery procedures: costs for removal of vehicles/animals/things under section 29(2)(c) of the Act may be recovered as a debt in a competent court (regulation 38).

Special offences protecting enforcement integrity

• It is an offence to impersonate a park management officer (regulation 37), to remove notices attached to vehicles except by the owner/driver/person in charge (regulation 36), and to obstruct or insult staff (regulation 22). These provisions protect procedural enforcement and create separate punitive measures for interference.

Procedural limits and statutory defences

• Certain defences exist. Regulation 9 provides a defence for acts necessary to prevent or mitigate injury or property damage for specified access offences. Regulation 5(6) allows a defence where an entry ticket is lost. The owner notice Form 1 permits rebuttal by proving vehicle theft or unlawful use. Regulation 4(5) states that a permission lapses during any period when conditions are not observed, which affects defences in prosecution.

Operational implications of the penalties design

• The Regulations calibrate deterrence and administrative throughput by pairing higher statutory fines for significant risks to animals, staff or infrastructure with much lower modified penalties for common access and parking breaches. The Authority can thus address low‑level non‑compliance through quick administrative collection, while reserving prosecutorial resources for more serious breaches. The prescribed forms and 28‑day timelines standardise the process and allow the Authority to treat vehicle offences as owner‑responsibility matters where necessary.

In short, enforcement is a blended system: visible onsite compliance (via park management officers and signage), administrative sanctions (infringement notices and modified penalties), criminal prosecution for serious breaches, and civil debt recovery for removal costs. All of these powers are governed by the templates and processes the Regulations prescribe.

The Regulations explicitly cross‑reference several other statutory regimes and leave open points of statutory interaction that practitioners should note.

Express cross‑references in the Regulations

• Road Traffic (Administration) Act 2008 (definition of “motor vehicle”): Regulation 3 adopts the meaning in that Act for "motor vehicle". Where the Regulations regulate vehicle behaviour (regulation 10), the primary statutory definition used is that from the Road Traffic (Administration) Act 2008, potentially affecting how particular conveyances are classified and regulated within parks.

• Dog Act 1976: Regulation 17(3) states that subregulation (1) (general prohibition on taking animals/birds into parks without permission) does not limit section 8 of the Dog Act 1976. That provision preserves any access regime or exemptions that section 8 of the Dog Act affords, i.e. the Regulations do not extinguish statutory dog‑related permissions or obligations arising from the Dog Act. Practitioners should consult section 8 of the Dog Act to identify where dog access is permitted or regulated otherwise.

• Litter Act 1979: Regulation 19(1) adopts the Litter Act’s meaning of "litter". Offences concerning depositing litter therefore operate in the context of the Litter Act’s definitions and possibly its enforcement tools. Coordination between litter enforcement regimes may be relevant where local government or other authorised officers have concurrent powers.

• Firearms Act 2024: Regulation 25(1) adopts the Firearms Act 2024 definition of "firearm". Regulation 25(2) prohibits carrying or discharging firearms, spearguns, catapults or other weapons in a zoological park without permission (with police exempted in the course of duty). The use of that definition aligns park weapons regulation with state firearms law.

Interaction with the Zoological Parks Authority Act 2001

• The Regulations implement and depend on the Act in several procedural ways:
  • Regulation 33 prescribes certain offences for the purposes of section 43(2) of the Act (the modified penalty framework).
  • Regulation 34 requires that infringement notices under section 43(2) be in the form of Schedule 1 Form 2.
  • Regulation 32 prescribes the Form 1 notice for the purposes of section 42(3) of the Act.
  • Regulation 38 refers to section 29(2)(c) of the Act to permit recovery of removal costs as a debt to the Authority. Practitioners must therefore read the Regulations alongside the provisions of the Act to understand the full suite of powers, designated decision makers and judicial remedies.

Potential overlaps with local government and other regulatory regimes

• While the Regulations specifically incorporate definitions from other Acts, they do not extinguish other bodies’ powers. For example, litter offences within the park use the Litter Act definition, which may enable local government enforcement elsewhere. The Regulations do not expressly preclude concurrent enforcement by other authorised officers under other legislation, so there may be overlap in enforcement or potential double‑handling of similar misconduct (though the text does not prescribe any particular coordination mechanism).

Licensing, commercial and intellectual property regimes

• Regulation 29 criminalises certain commercial reproduction (still or motion pictures or reproductions for public display, broadcast, transmission or use in the promotion or sale of goods or services) without permission. This provision intersects practically with intellectual property considerations and commercial licensing: permission from the Authority is a separate requirement irrespective of any copyright or other licence. The Authority can therefore impose separate terms and fees distinct from rights cleared under other laws.

Traffic law and enforcement

• Traffic signs erected by the Authority have operative force in the park (regulation 11), but vehicle offences are not necessarily the same as offences under the broader road traffic statutes. The Regulations adopt the motor vehicle definition from the Road Traffic (Administration) Act 2008 but create park‑specific obligations (e.g. 10 km/h speed limit, equipment requirements in regulation 10(4)-(5)). Enforcement can be administrative (modified penalty) or criminal depending on the provision and whether the offence is specified in Schedule 2.

Procedural interaction for owner notices and courts

• The owner notice procedure (Schedule 1 Form 1) is linked to section 42 of the Act and creates deeming consequences if the owner fails to identify the driver or prove theft/unlawful use. That scheme interacts with civil and criminal processes: a modified penalty payment avoids court action, whereas unpaid matters may be prosecuted. Recovery of removal costs is a civil debt in a competent court (regulation 38), so where the Authority removes vehicles, administrative, criminal and civil remedies may be engaged simultaneously.

In short, the Regulations are designed to sit alongside broader statutory frameworks: they borrow definitions, preserve other Acts’ operation where expressly stated, and create a set of park‑specific obligations that may overlap with road traffic, litter, firearms and dogs legislation. A full compliance or enforcement assessment should therefore read the Regulations together with the named external Acts and the Zoological Parks Authority Act 2001.

The Regulations are a living instrument that has been amended on multiple occasions. The compilation notes contained in the text provide a clear chain of the major published instruments and commencement dates.

Primary instrument and initial commencement

• Zoological Parks Authority Regulations 2002, published 8 May 2002 and commencing 22 May 2002 (regulation 2 establishes commencement on the date the Act comes into operation and the compilation table records the Gazette details).

Subsequent amendments recorded in the compilation table

• Zoological Parks Authority Amendment Regulations 2014 (published 8 Jan 2015 p. 141-2): the compilation table shows r. 1 and r. 2 commenced 8 Jan 2015 and the rest of the Regulations (other than r. 1 and r. 2) commenced 27 Apr 2015 (Gazette 17 Apr 2015 p. 1371). The footnotes in the Regulations indicate regulation 3 was amended with effect 8 Jan 2015 (see the "Regulation 3 amended: Gazette 8 Jan 2015 p. 142" note).

• Zoological Parks Authority Amendment Regulations 2020 (SL 2020/6) published 11 Feb 2020: r. 1 and r. 2 commenced 11 Feb 2020 and the remainder commenced 12 Feb 2020. The text has numerous parenthetical references noting multiple regulations amended by SL 2020/6 (for example, many provisions are annotated "Regulation ... amended: SL 2020/6 r. 11(1)" or r. 11(2)). The 2020 instrument changed several penalty amounts in the text and updated which items carry modified penalties in Schedule 2.

• Environment Regulations Amendment (Firearms) Regulations 2024 Pt. 6 (SL 2024/298) published 21 Dec 2024: compilation notes record commencement 31 Mar 2025 (see r. 2(b) and SL 2024/289 cl. 2). Regulation 25(1) was amended to adopt the definition of "firearm" from the Firearms Act 2024; the Regulations indicate this amendment as "Regulation 25 amended: SL 2020/6 r. 11(1); SL 2024/298 r. 13."

Textual deletions and re‑numberings

• The text shows certain portions were deleted in past amendments: for example, regulation 13 lists paragraphs (d) and (e) as deleted and regulation 15 has paragraph (b) deleted, which is expressly noted in the body text with bracketed "deleted" annotations. Schedule 2 also shows items 25 and 26 deleted (with square bracket notes). These deletions change the set of specific prohibitions or the penalty schedule and reflect iterative refinement of the regulatory coverage.

Footnote and defined term adjustments

• The defined term list includes new or updated defined terms tied to amendments: "motor vehicle" picks up the Road Traffic (Administration) Act definition via the 2015 amendment (regulation 3 note), and "firearm" is introduced in regulation 25(1) following the 2024 changes. The defined term list at the end compiles where defined terms appear.

Amendment patterns and administrative emphasis

• The 2020 suite of amendments (SL 2020/6) appears to have been a significant package, touching many regulations (the text has many "Regulation ... amended: SL 2020/6 r. 11(1)" notes). The 2024 environment/firearms amendment was narrower and concerned definitional alignment with the Firearms Act 2024.

Practical implications of the amendment history

• Amendments that change definitions (motor vehicle, firearm), delete obsolete paragraphs or adjust penalty levels affect compliance strategies. Legal advisers and compliance officers should always consult the current consolidated version and the compilation table because the Regulations contain multiple in‑text amendment annotations. The publication includes the Creative Commons attribution and the © State of Western Australia 2025 notice; the compilation table signals the Regulations as up to date with amendments listed to 2024/2025.

For lawyers and compliance professionals, the key historical points are: (1) the Regulations were enacted in 2002 and have been actively amended in 2014, 2020 and 2024; (2) the 2020 amendments were extensive and adjusted many substantive clauses and Schedule 2 items; and (3) definitions have been aligned with other statute regimes through later amendments, affecting interpretive baseline for vehicle and firearms rules.

The Regulations’ text and compilation notes do not record specific litigation or named cases. The instrument itself does not list judicial decisions or administrative determinations. Therefore, from the supplied materials:

• There are no cases or appeals cited in the Regulations or in the compilation notes attached to this document. The Regulations do not include an annotated litigation history.

What this absence means for practitioners and researchers

• The absence of cases in the Regulations is a neutral statement about the document itself: it does not indicate whether enforcement actions or prosecutions have occurred; it simply means the instrument does not contain judicial annotations. Because the Regulations create statutory offences enforceable by the Authority and capable of prosecution, relevant litigation could exist in court records (magistrates' courts, higher courts, or administrative tribunals) but is not recorded in the statutory text. Practitioners requiring precedential or interpretive guidance will therefore need to search court databases, magistrates' court lists and administrative law decisions for cases that concern the Act and Regulations (for example, prosecutions for touching animals, disputes over owner notices under s 42 of the Act, or judicial review of Authority decisions to refuse permissions).

Points to consider when searching for litigation outcomes

• Potential areas where litigation or appeals commonly arise, even if not recorded in the regulations, include:
  • Challenges to notices served on vehicle owners under the Form 1 procedure (evidentiary disputes on identity of driver, proof of theft).
  • Prosecutions for interfering with animals or enclosures, including arguments about the scope of "molest" or "disturb".
  • Judicial review applications contesting the Authority’s exercise of discretion to grant, condition, amend or revoke permissions (regulation 4), particularly where commercial or expressive activity is refused or conditioned.
  • Disputes over disposal or retention of lost property or civil recovery of removal costs under regulation 38.

Recommended next steps for researching litigation

• Practitioners should:
  • Search local magistrates' court records for prosecutions under the Zoological Parks Authority Regulations 2002 and the Zoological Parks Authority Act 2001 (including infringement notices that were not paid and resulted in prosecution).
  • Search for judicial review proceedings in the Supreme Court of Western Australia where decisions of the Authority (permissions, revocations, fee impositions) were challenged.
  • Check administrative tribunal or small claims lists where civil debt recovery for removal costs under regulation 38 may have been pursued.

Because the statutory text provides penalties, modified penalty forms and owner‑notice procedures, litigation may hinge on procedural compliance, adequacy of signage (given the "operative according to tenor" wording for signs), and proper exercise of discretion by the Authority. However, any specific outcomes, precedents or judicial interpretation must be sought in case law; none are included in the Regulations’ text supplied.

The Regulations contain several specific drafting and procedural features that commonly create compliance surprises. These are concrete operational "gotchas" anchored in the text.

Permission must be written and obtained before acting (regulation 4(4))

• Many offences are conditional on "permission" and regulation 4 requires that permission be in writing and obtained before the act or activity is commenced. Verbal or after‑the‑fact approvals will not satisfy this requirement. Permission conditions lapse where not observed and that lapse is used against defendants in prosecutions (regulation 4(5)). Practitioners should be careful: seeking permission after the event does not cure an offence unless the Authority expressly provides retroactive written permission.

Authority discretion and conditional permissions (regulation 4(2)-(3))

• The Authority may grant permission generally, for a specific instance, or subject to terms as to location, class of person and payment of fees (regulation 4(2)(a)-(b)). It may amend or revoke permissions (regulation 4(3)). Businesses and event organisers must assume permissions are conditional and monitor for revocations or amendments, and keep written records proving the Authority’s permission and terms.

Signage is the operative instrument and must be maintained (regulations 8(2), 11(2)-(3))

• The Regulations make the inscriptions on signs operate "according to their tenor" (regulation 8(3), 11(2)). If the Authority does not erect or properly maintain signs required for closures or designated parking, there may be factual disputes about whether an offence occurred. Conversely, visitors are required to comply with signs in place, so a lack of clarity on signage is a practical compliance risk. The Authority has a duty to erect and maintain sufficient signs in closure instances (regulation 8(2)).

Owner liability via Form 1 procedure (Schedule 1 Form 1)

• Where a vehicle is alleged to be involved in an offence, the owner receives a Form 1 notice and must identify the driver within 28 days or be deemed to have committed the offence unless they prove the vehicle was stolen or unlawfully used (Schedule 1 Form 1). Owners unaware of third‑party use or victim to vehicle theft must act quickly; failure to respond exposes them to liability and potentially to prosecution or payment of modified penalties.

Wide scope of “permission required” activities

• The list of activities that require permission is extensive: trading and services for reward (regulation 28), commercial reproduction for public display or promotion (regulation 29), organised performances and public speaking (regulation 30), use of amplified sound systems (regulation 20(1)), and even inflating party balloons outside designated areas (regulation 18(2)). Commercial photographers, vendors, charity fundraisers, and community groups may inadvertently commit offences without written permissions.

Low thresholds for modified penalties and owner responsibility

• The modified penalty regime uses relatively low sums (many $60 items in Schedule 2) to encourage administrative resolution. However, the owner identification procedure can turn what would be a $60 modified penalty into a de facto liability for the registered owner if no driver is identified. This is an important operational risk for fleet owners and shared car users.

Equipment requirement for vehicles carries a higher fine (regulation 10(5))

• Driving without appropriate equipment (sound device or lights/hazard lights on) carries a $1,000 penalty rather than the common $600. Practically, visitors using small electric vehicles or mobility scooters should ensure equipment complies with the requirement or seek permission, as this is a higher‑penalty item.

Strict rules for animal and enclosure contact (regulations 12-13)

• The Regulations impose $2,000 penalties for touching, feeding, or placing objects in animal enclosures and for entering railed areas or staff/quarantine buildings (regulations 12 and 13). A common issue in prosecutions is whether a person "disturbed" an animal; the text is broad and criminalises touching, molesting, shouting at or generally disturbing animals (regulation 12(a)). This is a clear area where well‑intentioned visitor conduct (e.g. attempting to attract an animal to take a photo) can give rise to serious fines.

Party balloons and other seemingly innocuous items (regulation 18)

• The Regulations specifically designate items such as party balloons and laser lights as prohibited without permission and restrict inflatable balloons to designated areas (regulation 18(1)(a), 18(2)). Small parties and family events need to be advised that such items are regulated and that letting balloons escape is a distinct offence (18(2)(b)).

Climbing fences and entering staff or quarantine areas attract high penalties (regulation 15(2), 13(f)(i))

• Both actions have $2,000 penalties. For staff and compliance teams this means grey‑area behaviours around exhibits (e.g. crossing low barriers to recover a dropped phone) can trigger serious charges unless justified by the defence in regulation 9.

Impersonation offence by third parties (regulation 37)

• A person must not impersonate a park management officer. Given the owner notice and enforcement system relies on officers’ actions, anyone falsely representing themself to secure permission or to enforce rights risks a $1,000 penalty. Authorised persons who receive modified penalty payments are specified by Act s 43(10) (referenced in Form 2), so only specifically appointed persons should collect payments.

Removal of vehicle notices prohibited (regulation 36)

• Only the owner, driver or person in charge of a vehicle may remove a notice attached under s 42(4) or s 44(2)(b) of the Act. Third parties who remove such notices face a $600 penalty. This provision can trap roadside assistance or towing agents who remove notices without confirming ownership status.

Recovery of removal costs as a debt (regulation 38)

• The Authority may recover its costs for exercising removal powers as a debt in court. This means that, beyond fines, owners may incur civil liabilities for removal costs to be pursued in a court of competent jurisdiction.

Limited statutory defences

• Regulation 9 provides a narrow defence for necessity in certain access offences and regulation 5(6) allows a lost ticket defence. Outside these narrow exceptions, the written permission requirement and owner notice mechanics provide limited procedural relief for inadvertent breaches.

Taken together, these "gotchas" underline the importance of pre‑event planning, written permissions, clear record‑keeping, and quick responses to owner notices. For commercial operators, the interaction of permission conditions, potential fees and the Authority’s revocation power are especially material.

This section provides a practical, source‑grounded compliance checklist and operational guidance for the main regulated activities, aligned with the Regulations’ text.

Obtain and document written permission in advance

• For any activity the Regulations make unlawful "without permission" (e.g. trading, commercial filming, organised events, use of amplification, bringing animals, portable cooking, public performances), secure a written permission from the Authority before commencing. Regulation 4(4) requires permissions to be in writing and obtained before the activity; regulation 4(2)(b)(iii) contemplates fees as a condition, so contractually record any fee conditions and location/class limitations. Keep physical or electronic copies on site when the activity occurs so that officers can verify compliance.

Check and comply with permission conditions at all times

• A permission lapses for periods when a condition is not observed and that lapse is taken against defendants in prosecution (regulation 4(5)). Ensure staff and contractors are trained on the scope of permissions and maintain checklists to ensure all conditions are continually observed (space limits, duration, number of persons, signage).

Access and ticketing compliance

• Ensure visitors enter only via entrance gates and are given entry tickets upon payment (regulation 5(1)-(3)). Park management officers may demand proof of a ticket; have ticket machines functioning and ticketing staff trained to provide and record ticket issuance (regulation 5(2)-(4)). If a visitor loses a ticket, be prepared to apply the lost ticket defence under regulation 5(6).

Child supervision

• For groups with children under 12, enforce supervision ratios and confirm adult supervision before admission (regulation 6). Staff should have the authority to refuse admission to inadequately supervised groups (6(2)) and must record instances of refusal to provide a defence if challenged.

Parking and vehicle operations

• For vehicles:
  • Obtain written permission to bring vehicles into the park if required (regulation 10(2)).
  • Drive only on designated roads/tracks (10(3)(a)), park only in designated areas and pay any posted charges using the ticket vending machine where applicable (10(6)(a)-(b)), display tickets so they are readable from outside the vehicle (10(7)).
  • Ensure vehicles carry an appropriate device for sounding a warning or use headlights/hazard lights as required (10(5)); this rule attracts a $1,000 penalty.
  • Observe the 10 km/h speed limit (10(4)). Display signage to make the speed limit clear.
  • For disabled parking, ensure the ACROD sticker is displayed and a disabled person is present (10(3)(d)).

Signage and communications

• The Authority must erect sufficient signs for closures (regulation 8(2)). Ensure signs are clear, visible and properly worded because inscriptions operate "according to their tenor" (regulation 8(3), 11(2)). Maintain a sign maintenance log and inspect signs regularly to reduce litigation risk and visitor confusion.

Animal protection and enclosures

• Prohibit touching, feeding or placing objects into enclosures (regulation 12). Post clear signage and staff advisories at exhibits. Keep staff trained to intervene and document incidents. Preserve quarantine and staff‑only areas by clear fencing and signage; entry to those areas without written permission attracts $2,000 penalties (regulation 13(f)).

Trading, events and filming

• Require commercial operators and performers to present evidence of prior written permission before engaging in trading or filming. Process applications for permission under regulation 4 and record the scope, fees and conditions. For commercial reproduction (regulation 29), distinguish between personal photography and commercial use (public display, broadcast, promotion). Maintain a permit register and require producers to provide evidence of compliance with Authority conditions.

Lost property and recovery

• Instruct staff that found property must be handed to a park management officer (regulation 31(1)). Maintain a lost property register and procedures for returning property on satisfactory proof of ownership (31(2)). Train officers on retention periods and disposal if unclaimed according to the Authority’s internal policy.

Dealing with owner notices and infringement notices

• If served with a Form 1 notice, owners must respond within 28 days by identifying the driver or proving theft/unlawful use, or pay the modified penalty where appropriate (Schedule 1 Form 1). Establish an internal process for fleet owners to track whereabouts of vehicles at alleged offence times and to respond to notices promptly. For individuals served with Form 2 infringement notices, the Regulations provide 28 days to pay the modified penalty to an authorised person (Schedule 1 Form 2) to avoid court action.

Event organisers and community groups

• For events, obtain written permission, ensure amplification systems are authorised, and comply with designated spaces and times. Provide staff to ensure balloons and other regulated items are used only in designated areas (regulation 18(2)). Ensure emergency and safety plans are approved where the Authority may require them.

Record‑keeping and audit trails

• Keep copies of all permissions and written approvals, and logs showing how conditions were complied with. For parking and ticketing, retain transaction records from ticket vending machines, and maintain CCTV or attendance logs where practical. For permissions involving commercial activities, retain signed agreements that record fee payments and conditions, and evidence of payment made to the Authority where required.

Staff training and enforcement coordination

• Train park management officers and front‑line staff on the statutory powers and the proper method of issuing Form 1 and Form 2 notices, including the protocols for identifying drivers, collecting evidence and maintaining chain of custody for seized items. Ensure authorised persons receiving modified penalty payments are properly appointed under section 43(10) of the Act as referenced in Schedule 1 Form 2.

Responding to emergencies and defences

• Ensure staff understand the narrow statutory defences: regulation 9 permits a defence to certain access offences where actions were necessary to prevent or mitigate injury or damage. Document incidents, witness statements and contemporaneous evidence demonstrating necessity to support reliance on this defence.

Security and anti‑impersonation measures

• Maintain staff identification and verification procedures for park management officers to prevent impersonation risk and to protect against the impersonation offence (regulation 37). Ensure officers display authorised identity when acting to issue notices or directions.

Co‑ordinate with other statutory regimes

• For issues that engage other statutes (Dog Act, Litter Act, Road Traffic Act, Firearms Act), adopt internal protocols that ensure compliance with cross‑referenced laws. For example, check whether dog access is governed by section 8 of the Dog Act and whether firearms issues must be handled by police as an exception is provided for official duty (regulation 25(3)).

Insurance and contractual protections

• For commercial licensing or permissions, insert indemnities and insurance requirements as conditions in permission documents. Because permission may be conditional on fees (regulation 4(2)(b)(iii)), include contractual clauses obliging commercial operators to comply with Authority rules and to accept removal or eviction for breaches.

Audit and review

• Regularly audit compliance with ticketing, parking, signage maintenance and permissions. Keep a register of permissions, terms, revocations and amendments to show contemporaneous compliance. Use audit trails to mitigate risks that otherwise could lead to prosecution or civil claims.

By following these practical steps grounded in the Regulations’ text, businesses, event organisers, vehicle owners and park staff can reduce exposure to fines, modified penalties and civil liabilities. The overriding operational theme is: when in doubt obtain a written permission, ensure strict record‑keeping, and respond promptly to notices.
