Youth Justice Administration Regulations 2016

Several core concepts structure the regulations and govern decision-making in training centres.

Prohibited items. The regulations define a comprehensive and partly open-ended list of items that are "taken to be a prohibited item" unless the manager permits their introduction (r 3(2)). The list includes controlled drugs, syringes, devices for smoking drugs, dangerous substances, liquor, explosives, weapons or devices that could be adapted to cause harm, material that instructs how to make weapons or escape, publications classified RC/X18+/R18+, indecent or offensive material under the Summary Offences Act 1953, cameras and mobile telephones, devices with modems or unauthorised data storage devices, common personal items such as mirrors, grooming products, backpacks and even "any other item for personal use" (r 3(2)(a)-(x)). The breadth mixes statutory cross-references (Controlled Substances Act 1984, Dangerous Substances Act 1979, Classification Act 1995) with operationally defined items and a catch-all that leaves a degree of managerial discretion (r 3(2)(x)).

Isolation versus segregation. The regulations distinguish isolation (placement in a locked room and kept apart from the centre’s normal routine) and segregation (an individualised regime with restricted contact) (r 6(1), r 7(1)). Both are only available on reasonable grounds related to safety, order, security or health, and both are subject to constraints: isolation must not be used as punishment and must not contravene a Charter of Rights for Youths Detained (r 6(6)); segregation contains further express limits on access to exercise, stimulation and visitors and requires an action plan to return the resident to the normal routine (r 7(3)-(4)(d)(iv)). Time limits differ: isolation must not continue for longer than is reasonably necessary and not more than three hours unless manager approval is given, with a potential extension to 24 hours only in exceptional circumstances with Chief Executive approval (r 6(7)(b)-(c)). Segregation must not prevent a resident from having contact with other residents for more than 22 hours in any 24-hour period unless contact would be detrimental (r 7(4)(b)).

Mechanical restraints. The use of devices to restrict free movement is permitted only when the device kind is approved by the Chief Executive, an employee reasonably believes on grounds that the resident is about to self-harm or harm another or it is necessary to preserve security, prevent escape or protect the community, and only as a last resort following a risk assessment (r 8(2)-(3)). Use must be reasonable, proportionate, by trained staff, supervised, time-limited, logged and accompanied by checks at intervals not exceeding 15 minutes (r 8(5)(a)-(e)).

Procedures and delegation. The Chief Executive is repeatedly required or permitted to establish procedures to implement testing, segregation, isolation and the use of restraints and to ensure those procedures accord with appropriate medical or professional standards (r 6(8), r 7(5), r 8(4), r 10(1), r 11(1)). Authorised officers are employees trained for drug testing (r 9(2)). The manager has day-to-day operational discretion: authorising visits, screening visitors, ordering limited searches and barring visitors where special reasons exist (r 12(3), r 12(5), r 14).

Communication and oversight carve-outs. Residents are entitled to mail and at least two visits weekly (r 12(1), r 15(1)). Certain kinds of correspondence and telephone communications (e.g. to the Independent Commissioner Against Corruption, Ombudsman, Members of Parliament, legal practitioners) are protected from opening or monitoring except in limited circumstances (r 15(5)-(8), r 16(5)-(6)). The manager must facilitate access to translators, cultural supports and notification for Aboriginal and Torres Strait Islander youths as part of the Aboriginal and Torres Strait Islander Youth Justice Principle (r 5 and r 7(4)(d)(ii)).

Records and notification. Multiple provisions require records and notification: isolation must be recorded with start/finish times, reasons and ordering employee (r 6(9)); segregation must be recorded with risk assessments and contact details and an action plan prepared (r 7(4)(d)(v)-(vi)); restraint use must be recorded (r 8(5)(f)). Managers must inform parents/guardians and, for younger children, the Training Centre Visitor, when segregation occurs (r 7(4)(d)(i)-(iii)).

Interaction with other Acts. The regulations presuppose and reference other statutory regimes for classification, controlled substances, prohibited persons, registration of practitioners and teachers, and property handling (r 3(2), r 15(9)(c)(v), r 18(5)). They also declare the Northern Territory Youth Justice Act 2005 to be a corresponding law for the purposes of certain transfer provisions (r 4).

Together, these concepts create a layered operational framework: the Chief Executive and managers exercise and document discretionary decisions constrained by procedural time caps, notification duties, training/authorisation requirements and exemptions for specified communications.

Primary subjects. The central regulated population is residents of training centres, i.e. youths detained under the Youth Justice Administration Act. The regulations govern what may be done to those residents: isolation (r 6), segregation (r 7), mechanical restraint (r 8), drug testing (r 9-10) and therapeutic drug administration (r 11). They also define entitlements such as at least two visits weekly (r 12(1)), rights to send and receive letters (r 15(1)), and limits on monitoring or opening certain communications (r 15(5), r 16(5)).

Operational decision-makers. Managers of training centres hold key day‑to‑day authority. Their duties include authorising or refusing visits (r 12(2)-(3)); screening and searching people entering the centre and vehicles (r 14); approving extensions to periods of isolation up to three hours, and reporting to the Chief Executive for longer periods (r 6(7)(b)-(c)); ensuring notifications and records are made in the case of segregation (r 7(4)); providing suitable meeting rooms for professional visitors (r 13); facilitating authorised telephone calls (r 16); and making inventory records for personal property on admission (r 17(3)). The manager can order that a person is barred from visiting where special reasons exist (r 12(5)(b)), and can refuse entry where a person refuses to be screened or searched (r 14(3), r 14(11)).

Chief Executive and Department. The Chief Executive holds the regulatory drafting and supervisory role: establishing procedures relating to isolation, segregation, mechanical restraint, drug testing and therapeutic drug administration (r 6(8), r 7(5), r 8(4), r 10(1), r 11(1)); approving types of mechanical restraints (r 8(2)(a)); determining the treatment of letters and prohibited items (r 15(3), r 15(9)-(10)); and exercising an "absolute discretion" to deal with or dispose of personal property beyond that permitted on admission (r 17(4)). The Department’s employees who are trained and designated act as authorised officers for drug testing and mail per r 9(2) and r 15(13).

Visitors and communication partners. Relatives, friends, significant others, professional visitors and specific oversight figures are affected. The regulations list individuals and bodies whose communications have special protection: the Independent Commissioner Against Corruption, Office for Public Integrity, Police Ombudsman, Ombudsman, Health and Community Services Complaints Commissioner, Training Centre Review Board, Training Centre Visitor, Guardian for Children and Young Persons, Members of Parliament and legal practitioners (r 15(5) and r 16(5)). The manager must verify identity and professional status of professional visitors (r 13(1)(a)) and may screen visitors for prohibited items (r 14).

Police and law enforcement. Managers may detain and hand over persons found with prohibited items to police and must notify police when persons are detained under r 14(8)-(10). Letters suspected of containing unlawful prohibited items may be passed to law enforcement (r 15(8)(b)(ii)).

Aboriginal and Torres Strait Islander communities. The Aboriginal and Torres Strait Islander Youth Justice Principle (r 5) names obligations: recognition of cultural identity, access to cultural ceremonies and interpreters, involvement of family and community in case planning, cultural training for officers and targeted recruitment/retention of Aboriginal and Torres Strait Islander staff (r 5(a)-(j)). Segregation rules require notification of a cultural support person where the resident is an Aboriginal or Torres Strait Islander youth (r 7(4)(d)(ii)).

Third parties and suppliers. People who deliver property, money sent by mail, drivers of vehicles entering centres and persons who might bring prohibited items are affected by search powers, detention and the Chief Executive’s disposal powers for contravening letters or property (r 14, r 15, r 17(4)). The regulations also prescribe classes of persons for the purposes of s 21A of the Act; for example, maintenance contractors who have only incidental contact with children are prescribed classes (r 18(1)(e)), subject to the exclusion for prohibited persons (r 18(1) final clause).

Costs and compliance burdens fall mainly on the Department (training, procedure development, recordkeeping) and on managers (screening, searches, visitor management, notifications), while residents bear behavioural constraints and limits on communications, personal property and movement. The legal and operational power to detain and hand people to police (r 14(8)-(10)) imposes potential enforcement actions on external law enforcement agencies. Cultural supports and interpreter obligations create obligations to engage or source community contacts, with attendant administrative work.

Duties placed on the Chief Executive. The Chief Executive must establish procedures for isolation, segregation and mechanical restraint (r 6(8), r 7(5), r 8(4)). The Chief Executive may establish procedures for drug testing that are consistent with medical or professional standards (r 10(1)) and for the therapeutic use and administration of drugs (r 11(1)). The Chief Executive is given discretion in the treatment of letters and items found in letters (r 15(3), r 15(9)-(10)), and an explicit absolute discretion to deal with or dispose of personal property not permitted in a 1,000-litre receptacle (r 17(4)). The Chief Executive is empowered to approve types of mechanical restraints for use (r 8(2)(a)).

Duties placed on managers. Managers must facilitate and encourage visits (r 12(2)), verify identities of visitors and can screen and search entrants (r 14). They must ensure records are kept when isolation, segregation or restraints are used (r 6(9), r 7(4)(d)(v), r 8(5)(f)). Managers must inform the Chief Executive or be informed of isolation in specified circumstances (isolation longer than 30 minutes) and they must approve extensions beyond particular limits in the time regime for isolation (r 6(7)(a)-(c)). For segregation, managers must inform parents/guardians and, where applicable, cultural supports and the Training Centre Visitor for under-12s (r 7(4)(d)(i)-(iii)); ensure an individualised action plan is prepared (r 7(4)(d)(iv)); ensure access to education, health and rehabilitative services “as far as reasonably practicable” (r 7(4)(d)(vi)); and ensure notification to police where a person is detained under search powers (r 14(10)). Managers must facilitate authorised telephone calls in accordance with rules (r 16(2)).

Duties and limitations on employees/authorised officers. Employees authorised as officers for drug testing must be trained (r 9(2)). Mechanical restraints may be used only by employees trained in their use (r 8(5)(b)). Authorised officers performing searches and screenings must avoid undue humiliation and ensure searches are appropriate in gender and minimally invasive where required (r 14(5)(c)-(f), r 14(6)(d)). An authorised officer per r 15(13) is required to be an officer not substantially engaged in day-to-day contact with residents where they perform mail perusal under r 15. Authorised officers must also keep the contents of letters confidential except as required by law or duty (r 15(12)).

Rights and protections for residents. Residents are entitled to at least two visits per week (r 12(1)). They are entitled to send and receive letters and to have letters handed over and forwarded “as soon as reasonably practicable” (r 15(1)(b)-(c)), subject to the prohibition of letters containing particular material (r 15(2)). Certain communications and letters to specified oversight and advocacy bodies are protected from opening (r 15(5)-(6)), and telephone calls with those same categories may not be monitored (r 16(5)). Isolation, segregation and mechanical restraints are explicitly not to be used as punishment and must not contravene the resident’s rights under the Charter of Rights for Youths Detained in Training Centres (r 6(6)(a)-(b), r 7(3)(a)-(b), r 8(3)(b)(ii)). During isolation or restraint, residents must be closely supervised, provided with mental or physical stimulation if possible, observed at intervals not longer than 15 minutes and have observation records kept (r 6(7)(d)-(g), r 8(5)(d)-(e)).

Recordkeeping and notification requirements. The regulations prescribe specific record elements: for isolation, the resident’s name and age, start and end times, reason, the employee who ordered it and action taken beforehand (r 6(9)(a)-(f)); for segregation, similar elements plus frequency and outcome of risk assessments and contact with other residents (r 7(4)(d)(v)(A)-(H)); for restraints, details including type of restraint and employee names who ordered and used it (r 8(5)(f)(i)-(vi)). Where letters or items contravene the mail regulation, the Chief Executive is required to advise the resident of actions taken (r 15(11)). Managers must notify police immediately if a person is detained under search powers (r 14(10)).

Limits and professional standards. Drug testing and therapeutic drug procedures must be "consistent with appropriate medical standards or other relevant professional standards" (r 10(1), r 11(1)). Mechanical restraints must be used as a last resort after risk assessment and only by trained employees (r 8(3)-(5)). Searches are constrained by rules aimed at minimising humiliation and requiring appropriate gender of searchers (r 14(5)(e), r 14(6)(e)-(f)). For telephone monitoring, the parties must be informed at the start (r 16(4)).

Prescriptive powers and discretion. The instrument combines prescriptive duties (time limits, minimum visit entitlements, record contents) with broad administrative discretion. The Chief Executive’s authority to make procedures and to deal absolutely with property (r 11(1), r 17(4)) and the manager’s discretion to permit exceptions to visiting arrangements on "special reasons" (r 12(3)-(5)) or to bar visitors (r 12(5)(b)) concentrate decision authority within the Department and its local managers while maintaining procedural constraints designed to document and constrain exercise of that authority.

The regulations do not create a schedule of fixed monetary fines or criminal penalties within their text for breaches of the particular regulations. Instead, enforcement is effected primarily through administrative powers, recordkeeping and referral to law enforcement where criminality is suspected, and by restricting access or entry to the centre.

Police involvement and detention. If a prohibited item is found as a result of screening or search, or if a person fails to comply with lawful screening or search requirements, the manager may hand the person or driver over to police and keep them in detention until police custody can be assumed (r 14(8)). Where a search under r 14(2)(b) leads an authorised officer to suspect on reasonable grounds that a prohibited item may be concealed on or in the person, the manager may hand the person to police (r 14(9)), and the manager must immediately cause a police officer to be notified (r 14(10)). These provisions create an enforcement path that transfers matters to criminal investigation and possible prosecution under other laws.

Mail handling and evidentiary uses. Where a letter contravenes the mail regulation (r 15(2)), the Chief Executive may take a range of administrative actions including retaining the letter, providing copies (with prohibited material deleted), destroying prohibited items, returning items to senders, retaining items as evidence of an offence, or providing items to law enforcement if necessary (r 15(9)(a)-(b)). For a letter sent by a resident that contravenes the regulation, the Chief Executive may hold sums of money, credit them, hold them on behalf of the resident until release, return sums to the sender, or pay amounts to the Treasurer as unclaimed money where entitlement is lacking or sender unidentified (r 15(9)(c)). These provisions set out administrative remedies and evidence preservation mechanisms rather than specifying internal disciplinary sanctions.

Drug testing non-compliance. A resident who does not provide a urine sample within the period specified in Chief Executive procedures will be taken to have failed to comply with the direction (r 10(5)). The regulations do not prescribe the consequences for a failure-to-comply event; the statutory parent Act or facility rules likely set out disciplinary responses, but these regulations only specify that a failure is taken to have occurred.

Administrative record and oversight enforcement. Repeated obligations to record the use of isolation, segregation, and restraints with specific details (r 6(9), r 7(4)(d)(v), r 8(5)(f)) generate an administrative audit trail which can be used in oversight, complaint handling, or as evidence in separate legal proceedings. The regulations also expressly protect communications with oversight agencies (r 15(5)-(6), r 16(5)) which creates channels for external complaints and investigation. The manager must give information arising from monitored communications to the Commissioner of Police if monitoring reveals information about an offence (r 16(7)), which creates another enforcement referral path.

Protections and limits on enforcement powers. Search powers are qualified: managers may require screening subject to consent and may refuse entry or remove persons who do not consent but may only use force that is reasonably necessary (r 14(2)-(3)). Limited contact searches and more intrusive searches are constrained by rules aimed at minimising direct contact with flesh, avoiding humiliation and ensuring appropriate gender of searcher and presence of at least two other persons for intrusive searches (r 14(5)-(6)). These procedural constraints function as internal checks on enforcement conduct.

Delegated discretion and lack of internal penalty schedule. The regulations leave a significant amount of enforcement discretion with managers and the Chief Executive instead of prescribing graded penalties within the instrument. Administrative sanctions (e.g. barring visitors, refusing entry, withholding letters or money, and handing people to police) and record-keeping requirements are the primary mechanisms by which compliance is enforced. Where criminal conduct is suspected, police referral can lead to prosecution under other statutes. The regulations do not themselves specify disciplinary processes for staff breaches, nor do they provide a statutory appeal mechanism against manager decisions within the regulation text; the parent Act and other applicable laws would need to be consulted for those processes.

Cross-references and corresponding laws. The regulations explicitly reference and incorporate other statutory schemes for definitional and procedural purposes. Section 4 declares the Youth Justice Act 2005 (Northern Territory) to be a corresponding law for Part 4 Division 7 of the Act, thereby facilitating inter-jurisdictional transfer arrangements (r 4). The definition of prohibited items uses the Controlled Substances Act 1984 to identify prescription drugs, controlled drugs and controlled plants (r 3(2)(a)), and refers to the Dangerous Substances Act 1979 for flammable/corrosive/toxic substances (r 3(2)(d)(i)). Publications and media references use the Classification (Publications, Films and Computer Games) Act 1995 classifications (r 3(2)(j)). Indecent and offensive material are defined by reference to s 33 of the Summary Offences Act 1953 (r 3(2)(k)-(l)). The Chief Executive’s disposal of unclaimed money in mail procedure references the Unclaimed Moneys Act 1891 (r 15(9)(c)(v)). The regulations also tie into child safety checks by prescribing classes under s 21A of the parent Act and excluding persons who are prohibited persons under the Child Safety (Prohibited Persons) Act 2016 (r 18(1), final clause).

Charter and rights interface. The regulations repeatedly reference the Charter of Rights for Youths Detained in Training Centres, and contain express prohibitions against using isolation, segregation or mechanical restraint in ways that contravene that Charter (r 6(6)(b), r 7(3)(b), r 8(3)(b)(ii)). The regulations therefore sit alongside domestic human rights protections as operational limits rather than as standalone rights-enforcement instruments.

Health and professional standards. Drug testing and therapeutic-use procedures must be consistent with appropriate medical standards or other relevant professional standards (r 10(1), r 11(1)). The requirement that mechanical restraints be used only by trained employees and that drug testing be performed by authorised officers trained in testing embeds professional standards into operational legality (r 8(5)(b), r 9(2)).

Privacy and communications law. The regulations create carve-outs for communications to specified oversight bodies which intersect with confidentiality obligations and legal privilege. For example, letters to legal practitioners at their business address are protected from opening under r 15(5)(i). Telephone monitoring is permitted with notice but exempt for calls with particular oversight and legal actors (r 16(3)-(6)). These provisions interact in practice with legal professional privilege and may be relevant to broader privacy laws and supervisory regimes, although the regulations do not themselves recreate civil privacy rights.

Classification and censorship regimes. By importing the Classification Act’s categories, the regulations align centre censorship and permitted media with the broader Commonwealth/state classification regime (r 3(2)(j)). This means prohibited material decisions will often be guided by existing classifications rather than centre-specific content policies.

Employment and registration regimes. The r 18 prescription of classes for s 21A(2) of the Act specifies that certain persons, including registered health practitioners and registered teachers (under their respective national registration frameworks and the Teachers Registration and Standards Act 2004), are prescribed classes (r 18(1)(c)-(d), r 18(5)). The regulations also exclude persons who are prohibited persons under the Child Safety (Prohibited Persons) Act 2016 from the prescribed classes (r 18(1) final clause), creating an interaction between the training centre employment/engagement rules and the child safety prohibited persons regime.

Evidence and criminal process. Where letters or items are suspected to be unlawful items, the Chief Executive may provide the evidence to an appropriate law enforcement authority (r 15(8)(b)(ii)). This establishes a direct evidence-preservation pathway for criminal investigation outside the regulation itself.

Administrative law and oversight. The repeated obligation to keep records and notify parents, cultural supports and oversight agencies creates a compliance trail which is relevant to administrative review, oversight investigations (Ombudsman, Police Ombudsman), and potential judicial review of decisions made by the Chief Executive or managers. The regulations do not, however, set out an internal merits-review mechanism; other Acts or internal departmental policies would supply review pathways.

Overall, the regulations operate as operationalising instruments that embed and reference multiple other regulatory regimes. They set operational constraints intended to be consistent with medical, classification and child safety frameworks and channel suspected criminal conduct to police and other enforcement agencies.

The legislative history supplied in the instrument records the principal regulations and a sequence of variations from 2016 to 2022. The principal regulations were made in 2016 (Regulation No 220, Gazette 8.9.2016 p3688) with commencement entries recorded (r 2 referenced at commencement 1.12.2016: r 2). Subsequent variations were published in later Gazettes: 2018 (No 186), 2019 (No 221), 2020 (Nos 38 and 74), and 2022 (Nos 9 and 78) with specified commencement dates (see the legislative history table).

Specific provision changes recorded in the history focus heavily on r 18 (the prescriptions for s 21A of the Act). The table notes:

• r 2 was omitted under the Legislation Revision and Publication Act 2002 on 22.10.2018.
• r 18 was inserted by 186/2018 r 4 (22.10.2018).
• r 18(1) was later varied by 221/2019 r 4(1),(2) with commencement 17.10.2019.
• r 18(1a) was inserted by 38/2020 r 4 (2.4.2020).
• Certain sub‑provisions (r 18(1b)) were inserted (by 74/2020 r 4) and then marked as expired or omitted under the Legislation Revision and Publication Act 2002 and later deleted by 78/2022 r 3, indicating transient insertions with specified expiry/omission events (21.5.2020 insertion and 3.2.2022 omission, later deleted by 1.9.2022).
• r 18(2) and r 18(3) contained provisions that expired (r 18(4) expired 22.10.2019; r 18(3) expired under the same revision process).
• r 18(4) was substituted by 221/2019 r 4(3) on 17.10.2019 and later omitted under the Legislation Revision and Publication Act 2002 on 21.5.2020.
• r 18(4a) was inserted by 221/2019 r 4(3) on 17.10.2019 and later omitted under the Legislation Revision and Publication Act 2002 on 3.2.2022.

The legislative history shows the instrument has been the subject of iterative tuning, with particular attention to the prescriptions under r 18 relating to s 21A(2) of the Act. The table also lists the historical consolidated versions that were in force on specified dates: 22.10.2018, 17.10.2019, 2.4.2020, 21.5.2020 and 3.2.2022. The legislative history contains editorial notes warning that cross-references to other legislation may not be automatically updated and may be obsolete.

Practical reading of the history yields these concrete points: (1) the regulations were enacted in 2016 and have been periodically amended; (2) a cluster of amendments through 2018-2020 and into 2022 focused on prescribed classes under r 18, including transient provisions with specified expiry or omission events under the Legislation Revision and Publication Act 2002; and (3) certain text has been intentionally inserted and later omitted or expired, indicating short-term or transitional measures were used in r 18. The history does not set out the policy rationales for each amendment; it records only the formal variation entries and commencement dates.

Users of the regulations should consult the chronological list of consolidated versions listed at the end of the history to identify the text in force at any particular date, especially if assessing decisions made under particular versions of the regulations. The legislative history does not list case law or judicial determinations interpreting the regulations.

The text of the regulations does not record any litigation history, judicial decisions, or reported cases arising from or interpreting these regulations. The instrument itself does not name any cases. The absence of a litigation section in the regulations does not confirm that no judicial proceedings have ever involved these provisions; it only means that the regulations’ own legislative history and text do not include case citations or summaries.

Operationally, several features of the regulations create potential points that could generate litigation or administrative review, although the regulations do not record such outcomes. These include:

• Use of isolation, segregation and mechanical restraint. The regulations set time limits, notification, supervision and recording requirements (r 6-8). Disputes could arise over whether the use was reasonable, proportionate, or the least restrictive option, or whether procedural requirements and records were complied with. The regulations reference the Charter of Rights for Youths Detained in Training Centres (r 6(6)(b), r 7(3)(b), r 8(3)(b)(ii)); potential legal challenges could therefore engage rights-based arguments, administrative law review or complaint processes to oversight bodies listed in r 15(5) and r 16(5).

• Search and detention powers at entry. Managers may detain persons and hand them to police if a prohibited item is found, and must notify police immediately on detention (r 14(8)-(10)). The rules on use of force and minimal humiliation are intended to constrain searches (r 14(3), r 14(5)(e)), but their practical application could be a subject of complaint or judicial review if rights are alleged to have been breached.

• Mail and communication handling. The regulations permit opening and perusal of mail by authorised officers except for certain protected correspondents (r 15(3)-(6)), with the power to translate letters in other languages (r 15(4)). Disputes might occur over whether a letter was properly opened, whether a prohibited item was lawfully removed or destroyed, or whether communications to protected bodies were improperly intercepted.

• Chief Executive’s absolute discretion over personal property. r 17(4) grants the Chief Executive an absolute discretion to deal with or dispose of personal property not within the permitted 1,000-litre receptacle allowance. The expansive wording could be a focal point for challenge if disposals are alleged to be arbitrary or procedurally unfair; again, the regulations do not itself set out internal review or appeal processes.

• Prescribed classes under s 21A. r 18 prescribes persons and classes for the Act’s operation; multiple amendments to r 18 are recorded in the legislative history, which may have altered who is prescribed or excluded. Challenges could concern whether a particular person falls within or outside the prescribed classes, but the regulations themselves do not report any judicial determinations about these issues.

For researchers and practitioners, the absence of litigation history in the instrument means one must look to external case law databases, tribunal decisions, ombudsman reports or departmental complaint files to identify adjudications or administrative findings touching these regulations. The regulations themselves point users to oversight bodies (Ombudsman, Police Ombudsman, Independent Commissioner Against Corruption) which could generate non-judicial findings and reports relevant to compliance and interpretation (r 15(5), r 16(5)).

Several operationally important features of the regulations may be overlooked by a casual reader but have material implications for centre practice and for residents' rights.

Breadth of the "prohibited item" definition. The prohibited items list in r 3(2) mixes narrow statutory references (e.g. controlled drugs) with broad categories and catch-all clauses (for example, “a device capable of being used for the administration of a controlled drug” r 3(2)(c); “any other item for personal use” r 3(2)(x)). It explicitly includes everyday items: backpacks, mirrors, grooming/toiletry items, pressurised spray canisters and unauthorised data storage devices (r 3(2)(u),(t),(w),(e),(q)). That breadth places a high demand on managers to interpret and communicate permitted items clearly and to exercise discretion consistently; otherwise, ordinary personal effects risk being classified as prohibited under managerial decisions.

Unauthorised data storage device nuance. The definition of an unauthorised data storage device clarifies it does not include data storage devices referred to in preceding paragraphs or containing only a G-class film or computer game (r 3(2)(q) definition). The presence of data-capable devices across the prohibited list (mobile phones, devices with modems, data storage) requires careful policy design around electronic content and data transfer risks.

Absolute discretion over personal property. r 17(4) grants the Chief Executive “an absolute discretion to deal with or dispose of personal property other than that referred to in subregulation (2) as the Chief Executive thinks fit.” The word “absolute” conveys a very wide standard in the text. The regulations do not prescribe a review mechanism or proportionality test for that discretion, nor do they specify notice requirements to residents or guardians before disposal, except the manager must make a record at admission (r 17(3)). Practically, this may result in significant administrative variation and reputational risk unless internal departmental protocols fill the governance gap.

Timing and notification thresholds for isolation. Isolation can be initiated for a range of safety or security reasons and may be in the resident’s own bedroom (r 6(2)-(3)). The manager must be informed as soon as reasonably practicable if isolation exceeds 30 minutes (r 6(7)(a)), but the staff member who ordered the isolation need not notify the manager before that unless the period exceeds 30 minutes. Isolation caps allow manager approval to extend beyond 3 hours and Chief Executive approval for exceptional extensions beyond 24 hours (r 6(7)(b)-(c)). These staged thresholds create multiple managerial decision points and potential for ambiguity about when escalation to senior decision-makers is required, particularly in fast-moving safety incidents.

Segregation contact cap. Segregation restrictions specify residents must not be prevented from having contact with other residents for more than 22 hours in any 24-hour period (r 7(4)(b)), unless such contact would be detrimental. The 22-hour cap is less obvious than a 24-hour cap and is operationally significant for shift planning, staffing, education delivery and case planning. Segregation also triggers mandatory notifications to parents/guardians and to cultural supports for Aboriginal or Torres Strait Islander youths (r 7(4)(d)(i)-(ii)), which may require rapid outreach processes.

Training and authorisation requirements for mechanical restraint and drug testing. Mechanical restraints must be of a kind approved by the Chief Executive and applied only by trained employees (r 8(2)(a), r 8(5)(b)). Drug testing requires authorised officers trained in testing (r 9(2)). The regulations tie legality to training and authorisation rather than to a simple managerial order. Failure to comply with training requirements could render an otherwise lawful use of force procedurally defective.

Search powers and consent. Managers may require people entering centres to submit to screening “subject to the person’s consent” (r 14(2)(a)), but r 14(3) permits refusal of entry or removal if the person does not consent, using only reasonably necessary force. The regulations also state that refusal to consent is not, by itself, evidence of possession of a prohibited item (r 14(4)), which limits the inference managers may draw from refusals. Operationally, centres must balance privacy and access against security, and must comply with the minimal force standard.

Mail and protected correspondents. Letters to oversight bodies and legal practitioners are generally protected from opening (r 15(5)), but r 15(7)-(8) allow opening when an authorised officer reasonably believes the letter contains a prohibited item. The exception permits opening “in the presence of the resident” and, if necessary, providing the letter to law enforcement. That carve-out is narrow but important: communications to oversight bodies are not absolutely sacrosanct where the officer has reasonable grounds for suspecting a prohibited item.

Telephone monitoring notice and exemptions. Telephone calls can be monitored, but parties must be told at commencement (r 16(3)-(4)). Calls with protected persons (e.g. legal practitioners, Ombudsman, Training Centre Visitor) may not be monitored, but only if authorised in advance by the manager (r 16(5)-(6)). That is a procedural requirement that managers must operationalise by pre-authorising such calls; absent authorisation, confidentiality protections do not automatically apply.

Record content specificity. The regulations prescribe specific data fields that must be recorded for each use of isolation, segregation and restraint (r 6(9), r 7(4)(d)(v), r 8(5)(f)). These minimum contents create a template for documentation that managers must adopt; non-compliance can undermine the administrative record and raise issues in oversight or legal challenge even if the substantive action was permitted.

Interactional complexity across statutes. The regulations cross-reference many other Acts (Controlled Substances Act 1984, Dangerous Substances Act 1979, Classification Act 1995, Summary Offences Act 1953, Unclaimed Moneys Act 1891, Child Safety (Prohibited Persons) Act 2016 and registration laws) and declare a corresponding law in the Northern Territory for transfer purposes (r 4). Practically, compliance requires at least familiarity with these other regimes; the instrument itself warns cross-references might be obsolete in time (Legislative history notes).

Transient amendment mechanics. The legislative history shows that some sub-provisions were inserted temporarily and later expired or were deleted. Where policies or local practices rely on particular wording in r 18 (for example), practitioners should check the consolidated version in force at the relevant date because text may have been transient. The legislative history records multiple insertions, substitutions and expiries for r 18 (see legislative history), which increases the risk of relying on an outdated version.

Create and maintain Chief Executive procedures. The Chief Executive is required to establish procedures for isolation, segregation, mechanical restraints, drug testing and therapeutic drug administration (r 6(8), r 7(5), r 8(4), r 10(1), r 11(1)). Compliance begins with promulgating written procedures consistent with the regulatory text and with “appropriate medical standards or other relevant professional standards” for testing and therapeutic use (r 10(1), r 11(1)). Procedures should be documented, legally reviewed and version-controlled to reflect legislative amendments recorded in the legislative history.

Training and authorisation. Ensure authorised officers and employees receive training required by the regulations: drug-testing officers must be trained (r 9(2)); employees using mechanical restraints must be trained in their use (r 8(5)(b)). Training records should be retained for audit. The Chief Executive must approve types of mechanical restraints (r 8(2)(a)); centres must keep a register of approved restraint types and the employees authorised to use each type.

Operational templates and recordkeeping. Prepare standardised forms to capture the details mandated by the regulations for isolation, segregation and restraint use: name and age, start and end times, reasons, employees ordering and using the measure, actions taken before the measure, risk assessment frequency and outcomes, contact with other residents and individualised action plans for segregation (r 6(9), r 7(4)(d)(v)(A)-(H), r 8(5)(f)). Embed a requirement that observations/checks on isolated or restrained residents occur at intervals not exceeding 15 minutes, and that checks are logged (r 6(7)(g), r 8(5)(e)). Make these records readily retrievable for oversight or internal review.

Visitor policies and identity checks. Draft visiting rules consistent with the regulations that ensure each resident has at least two visits per week (r 12(1)) and that the manager encourages and facilitates visits by relatives and significant persons (r 12(2)). Include clear criteria and processes for authorising contact vs non-contact visits (r 12(2) example), screening and barring visitors for "special reasons" (r 12(5)), identity verification and pre-visit screening procedures (r 12(4)-(5)(a)). Keep records of any visitor bans and the reasons for them.

Search and screening procedures. Operationalise r 14 with written procedures that explain when and how to request consent for screening, the acceptable forms of screening (electronic screening, limited contact search, searching belongings), requirements for limited searches (minimal direct contact with flesh, gender‑appropriate searchers, no forced entry of orifices), requirements for full searches (two persons present, pat-downs allowed, no introduction into bodily orifices) and the use of only reasonably necessary force when refusing entry or effecting removal (r 14(2)-(7)). Embed a process for notifying police immediately if someone is detained after screening or search (r 14(10)) and for safe custody until police arrive (r 14(8)). Note that refusal to consent is not itself evidence of possession (r 14(4)) and ensure staff training covers that point.

Mail handling and exceptions. Adopt written mail-handling procedures aligned with r 15: ensure timely delivery and forwarding of letters (r 15(1)), develop search criteria for letters that may contravene r 15(2) (threats, incitements, prohibited items, sums of money without permission, coded statements, etc.), and specify staff authorised to open mail (r 15(3), r 15(13)). Create protocols for letters to protected correspondents (r 15(5)) and for opening such letters when authorised officers reasonably believe a prohibited item is present (r 15(7)-(8)). Implement processes for translation where mail is in another language (r 15(4)). Set out the chain of custody for any found prohibited item and options for destruction, retention as evidence, return to sender, or handing to police (r 15(9)(b)). Ensure residents are advised of actions taken in relation to their letters (r 15(11)) and protect confidential material except as required by law (r 15(12)).

Telephone monitoring and authorisation. Build telephone rules consistent with r 16: rules for authorised telephone calls, facilitation by managers (r 16(1)-(2)), monitoring practices with notice at call commencement (r 16(3)-(4)), and pre-authorisation processes for exempt calls to protected bodies and legal counsel (r 16(5)-(6)). Train staff to inform call participants when monitoring is taking place and to pass on information about offences revealed during monitoring to the Commissioner of Police (r 16(7)).

Personal property and inventories. On admission, permit residents to retain personal property that fits in a receptacle of 1,000 litres if allowed under the rules (r 17(2)). Make admission inventories containing name, age and details of property and, where property is not allowed, details of how it is dealt with (r 17(3)(a)-(c)). Because the Chief Executive has absolute discretion to dispose of other personal property (r 17(4)), document any transfer or disposal actions thoroughly, including reasons and attempts to return items to the resident or sender.

Segregation action plans and notifications. For segregation episodes, prepare an individualised action plan to support the resident’s return to the normal routine, including planned interaction with other residents (r 7(4)(d)(iv)). Implement notification procedures: inform parents/guardians as soon as reasonably practicable (r 7(4)(d)(i)); for Aboriginal or Torres Strait Islander youths, notify an appropriate cultural support person (r 7(4)(d)(ii)); for residents under 12, inform the Training Centre Visitor (r 7(4)(d)(iii)). Keep the plan and any risk assessments available and recorded (r 7(4)(d)(v)-(vi)).

Drug testing processes and dignity. Establish drug test procedures consistent with medical standards and with the directions allowed in r 10(2) (alcotest directions, urine collection processes, hygiene and dignity protections). Make clear that failure to provide a urine sample within the specified period in procedures will be taken to be non-compliance (r 10(5)), and document the specified timeframe in local procedures so residents are advised.

Cultural training and recruitment obligations. Implement the Aboriginal and Torres Strait Islander Youth Justice Principle in staff induction and ongoing training (r 5). The principle requires cultural recognition, consultation, support for cultural responsibilities, interpreter access, consideration of cultural identity in accommodation and case planning and active recruitment and retention of Aboriginal and Torres Strait Islander staff (r 5(a)-(j)). Embed these obligations into case planning templates and recruitment strategies.

Prescribed persons and prohibited person checks. For persons in classes prescribed under r 18 for s 21A of the Act, ensure appropriate screening against the Child Safety (Prohibited Persons) Act 2016 because the prescribed classes exclude persons who are prohibited persons under that Act (r 18(1) final clause). Maintain records of vetting and, where necessary, ensure supervised contact status is appropriately documented (r 18(1)(b)).

Governance and review. Because the regulations grant substantial discretion to the Chief Executive and managers (for example, on disposal of property r 17(4) and on barring visitors r 12(5)(b)), develop internal governance protocols and delegated-authority matrices to ensure consistent application, internal review and escalation routes in cases of exceptional decisions (e.g. extensions of isolation beyond the normal limits r 6(7)(c)). Keep the legislative history and consolidated versions accessible to check whether transient provisions (notably r 18 variations) apply at a particular time.

Documentation for oversight. Prepare an oversight pack for each significant incident (isolation beyond 30 minutes, segregation, restraint use, mail interference, police detentions) that includes the mandated records, staff training evidence, manager/Chief Executive approvals and notification logs so that external oversight bodies (Training Centre Review Board, Ombudsman, Police Ombudsman) or police can review decisions and actions with a complete audit trail (r 7(4)(d)(v), r 6(9), r 8(5)(f), r 15(11)).

By translating these regulatory requirements into concrete policies, training, records and governance protocols, managers and the Department can operationalise the regulations’ demands while meeting the procedural limits and notification obligations the regulations impose.
