Division 9 Transitional matters for Sentencing Legislation Amendment Act 2023 Youth Justice Act 2005 138 (2) For subsection (1), the act done or omitted to be done is taken to have been done or omitted to have been done after the commencement if: (a) for an act – all of the conduct constituting the act occurred after the commencement; or (b) for an act that has omitted to be done – the act has omitted to be done after the commencement, irrespective of whether the omission began before or after the commencement.
