For the Act, section 9(2A), an offence under the Law Enforcement (Powers and Responsibilities) Act 2002, section 199 is prescribed as an offence for which an investigating official must consider the matters referred to in the Act, section 9(2)(a) and (b) before issuing a penalty notice.
