498 Chief Executive Officer
S. 498(1) amended by No. 27/2025 s. 28(1).
(1) There is to be a Chief Executive Officer of the Authority appointed by the Board with the approval of the Minister.
S. 498(2) substituted by No. 50/2019 s. 11.
(2) A Director is ineligible to be appointed as the Chief Executive Officer.
(3) Subject to this Part, the Chief Executive Officer holds office for the term, not exceeding 5 years, specified in the instrument of appointment.
(4) The Chief Executive Officer is eligible for re‑appointment.

(4A) The Chief Executive Officer may resign from office by delivering a signed letter of resignation to the Chairperson of the Board.
(5) The terms and conditions of appointment of the Chief Executive Officer are as specified in the instrument of appointment.
(6) The Chief Executive Officer is to manage and control the affairs of the Authority in accordance with the policies of the Board.
(7) Any act, matter or thing done in the name of, or on behalf of, the Authority, by the Chief Executive Officer is to be taken to have been done by the Authority.

(8) The Board may appoint a person to act in the office of the Chief Executive Officer for a period not exceeding 12 months—
(a) during a vacancy in the office of the Chief Executive Officer; or
(b) during any period when the Chief Executive Officer is unable, whether because of illness, suspension, absence or otherwise, to perform the duties of the office of Chief Executive Officer.

(9) A person appointed under subsection (8)—
(a) has all the rights and powers, and must perform all the duties, of the Chief Executive Officer; and
(b) is entitled to be paid any remuneration and travelling or other allowances fixed by the Board from time to time, having regard to the rate of remuneration and allowances for the time being payable to the Chief Executive Officer.

(10) The Board may at any time terminate an appointment under subsection (8).
