361Application of Division

361 Application of Division (1) This Division applies to and in relation to all common law proceedings brought or made (as the case may be) on or after 1 July 2014 in respect of which the Authority is liable to indemnify a defendant in whole or in part under this Act, in relation to an injury, disease or death caused to or suffered by a worker that has arisen out of, or in the course of any employment or is due to the nature of employment in which the worker was employed at any time. (2) A defendant or a common law insurer may enter into an agreement with the Authority that the provisions of this Division do not apply to a common law proceeding to which this Division applies and the provisions of this Division do not thereafter apply to the extent that they are inconsistent with that agreement.
