299 Revocation of directions of ACCS S. 299(1) substituted by No. 73/2016 s. 21(12), amended by No. 15/2021 s. 32. (1) A direction given by ACCS under this Subdivision may be revoked by ACCS. S. 299(2) amended by Nos 73/2016 s. 21(2), 5/2021 s. 19(1), 15/2021 s. 32. (2) A court may, on the application of a person who is liable to make payments of compensation or provisional payments in accordance with a direction of ACCS under this Subdivision, revoke the direction. S. 299(3) amended by No. 5/2021 s. 19(1). (3) If a direction is revoked, the obligation to make payments of compensation or provisional payments under the direction ceases. (4) If a court determines that a person is not liable to make the payments of compensation or provisional payments that have been paid in accordance with a direction of ACCS— (a) the worker or other person who received those payments is not required to refund those payments unless the court otherwise orders under paragraph (b); S. 299(4)(b) amended by No. 5/2021 s. 19(2)(b). (b) if the court is satisfied that the claim for compensation or request for provisional payments was wholly or partly fraudulent or made without proper justification, it may order the worker or other person concerned to refund the whole or a specified part of those payments; (c) the court may, instead of making an order for a refund, order any other person whom it determines was liable for the whole or any part of those payments to reimburse the person who made those payments. (5) The Magistrates' Court may, on the application of a person to whom a direction has been given under section 294(1)(b)(i), revoke the direction.
