Workplace Gender Equality (Gender Equality Targets) Instrument 2025

The instrument relies on a small set of operational concepts that determine eligibility, measurement and the employer’s obligations. Each is defined or operationalised in the instrument.

Baseline. Baseline has an instrumental role. For numeric targets the baseline is the corresponding numeric value reported in the baseline report for the target cycle, and for action targets the baseline is the circumstances or actions reported in the baseline report (s 4, baseline definition). Many eligibility gates hinge on whether particular policies, entitlements or reporting practices existed in the baseline report.

Target cycle and target selection. The instrument repeatedly refers to a target cycle and to targets selected for that cycle. Section 6(1) specifies that the section’s selection rules apply for a designated relevant employer selecting targets in accordance with subsection 13(3AA) of the Act in relation to a target cycle that begins after commencement. The instrument therefore operates within the Act’s framework of reporting cycles and designated employers; the Act supplies the definitions of designated relevant employer, target cycle, baseline report and public report (s 4 notes those are defined in the Act).

Numeric targets and action targets. The instrument labels each target as either a numeric target or an action target. A numeric target requires the employer to nominate a measurable change expressed as a percentage relative to the baseline (for example, ss 7-13, 17, 21). An action target requires the employer to implement particular policies, practices or reporting arrangements by the end of the target cycle (for example, ss 14, 15, 16, 18-20, 22-25). The instrument specifies precisely what must be reported in the public report when selecting targets (s 6(3)) and what constitutes meeting the target for both numeric and action varieties (see the relevant target sections, e.g. s 14(2) for the annual pay gap analysis, s 15(2) for equal remuneration policies).

Designated relevant employer and roles. The instrument applies to designated relevant employers as that term is used in the Act; the instrument does not itself set the threshold that makes an employer designated (s 4 Note). The instrument expands the statutory meaning of manager for its purposes (s 4): manager includes CEO or equivalent, Agency Head or equivalent, key management personnel and other managers. Non‑manager is defined by exclusion. These definitions matter for targets that differentiate managers from non‑managers (for example, ss 7-10, 13, 21).

Public report and specificity. Section 6(3) requires that if an employer must nominate or specify anything in relation to a target, that nomination or specification must be included in the public report in which the employer selects the target. That converts subjectivity into a public, auditable statement of policy choice and numeric ambition. The instrument repeatedly requires employers to specify categories and percentage increases or to specify which policy changes they will implement; these selections must be publicly reported.

Eligibility tests. Several targets are only selectable if particular circumstances existed in the baseline. Examples include the pay gap analysis target (only selectable if the employer did not undertake a comprehensive pay gap analysis in the two reporting periods immediately prior to the target cycle, s 14(3)), the equal remuneration and pay equity policies target (only selectable where at least two listed policy items were absent in the baseline, s 15(3)), and numerous action targets that require the employer to have not provided the listed items in the baseline (see ss 16(3), 18(4), 19(3), 20(4), 22(3), 23(3), 24(3), 25(3)).

Measurement timing. Some targets specify when measurement is to occur. Several numeric targets are framed as changes “at the end of the target cycle” compared to the baseline (for example ss 7(1)(b), 8(1)(b), 10(1)(b), 11(1)(b), 12(1)(b), 13(1)(c), 21(1)). Others ask for change in the third year of the target cycle (notably promotions to manager, s 9(1)(b), and uptake of primary parental leave, s 17(1)(b)). Where the instrument uses “third year” it imposes a discrete temporal measurement point that may interact with the Act’s definition of the target cycle.

Reporting and governance. Several targets require reporting to, or consultation with, governance bodies. For example, a target to undertake gender pay gap analysis requires reporting the results to the governing body at least annually (s 14(1)(b)). Targets 24 and 25 concern policies and internal reporting mechanisms for sexual harassment, with 25 explicitly requiring expansion of reporting to CEO, key management personnel and governing body to include specified issues (s 25(2)).

These core concepts determine how employers must frame targets, what can be selected, what must be reported publicly and how success is measured. The instrument embeds baseline‑dependent eligibility gates and makes public reporting the mechanism by which selection and specificity are fixed.

The instrument applies to designated relevant employers selecting gender equality targets for target cycles commencing after the instrument’s commencement (see s 6(1)). The instrument does not itself define which employers are “designated relevant employers”; that term is defined in the Workplace Gender Equality Act 2012 and is noted in the instrument’s definitions (s 4 Note). Practitioners must therefore read the Act to determine whether an employer is within scope.

Within an employer, the definitions in the instrument expand who counts as a manager for measurement and reporting purposes. Manager expressly includes Chief Executive Officer or equivalent, Agency Head or equivalent, key management personnel and other managers (s 4). Non‑manager is any employee who is not a manager under that definition. These definitional choices affect headcount splits, promotion metrics and the composition of governing bodies for targets that require measurement by role or level (for example, ss 7-11, 13, 21).

Who decides. The controlled decisions are taken by the employer in its public report when choosing targets and specifying nominated categories and percentage changes (s 6(3)). The Act sets the statutory duty to lodge baseline and public reports; the instrument requires employers to record their targeted selections within that public report (s 6(3)). Governing bodies and key management personnel are explicit audiences for some targets: the pay gap analysis target requires reporting of analysis results to the governing body at least annually (s 14(1)(b)), and the reporting target in s 25 requires expanding reporting to CEO, key management personnel and governing body.

Who pays. The instrument’s action targets translate into costs for the employer who selects them. Examples include introducing employer‑funded parental leave (s 16), paying superannuation while an employee is on parental leave (s 18(2)(f)), increasing paid family and domestic violence leave beyond the National Employment Standards (s 22(1)(c)), and providing onsite or subsidised childcare (s 19(1)(b)-(c)). The instrument does not quantify costs; it specifies design features that, if chosen, will require expenditure or reallocation of benefits by the employer.

Who benefits. The instrument’s targets are designed to change workplace practices and representation. If employers select and meet the targets, the instrument anticipates changes to representation in workforce cohorts, improvements in leave offerings, changes in managerial working arrangements and new policies on pay equity and sexual harassment (Part 3 generally). The instrument does not itself guarantee implementation; it creates public commitments and measurable goals that may shift employer practice if employers select and act on targets.

Other bodies. The instrument makes cross‑statutory references that create indirect effects for other institutions. For example, the concept of adverse action and family and domestic violence are drawn from the Fair Work Act 2009 (s 4 definitions), and Agency Head is defined by reference to the Public Service Act 1999 (s 4). The instrument therefore intersects with employment and public service frameworks to the extent employers’ policies involve those concepts.

Practical reach. In function, the instrument places obligations on employers that have to select targets publicly, to make specific, measurable commitments and to implement policy changes where they select action targets. The principal actors affected are the employer’s HR, payroll, legal and executive teams, and the governing body, since the instrument ties many obligations to governance reporting and to the baseline reported by the employer.

This instrument places a number of specific duties on designated relevant employers selecting targets and contains rights or eligibility conditions that gate access to particular targets. The duties generally fall into three categories: selection duties, specification and public reporting duties, and substantive implementation or measurement duties.

Selection duties. Section 6(2) imposes the primary selection duty: a designated relevant employer must select three different targets, at least one of which must be a numeric target. Section 6(1) binds these rules to employers selecting targets for target cycles beginning after commencement. Section 6(4) imposes a duty not to select targets for which the employer does not meet the instrument’s specified eligibility circumstances.

Specification and public reporting duties. If an employer is required to nominate or specify anything in relation to a target, it must include that nomination or specification in the public report in which the employer selects the target (s 6(3)). Across Part 3 almost every target requires a selection specification or nomination: numeric targets typically require the employer to specify the category and nominate the percentage increase or reduction required (for example ss 7(1), 8(1), 10(1), 11(1), 12(1)). Action targets require the employer to specify which elements from a listed set the employer will implement (for example ss 15(1), 18(1), 19(1), 24(1), 25(1)). These obligatory public specifications convert internal policy choices into public commitments.

Implementation and measurement duties. Meeting each selected target is defined within the target. For numeric targets the employer meets the target if the specified percentage change is achieved relative to the baseline at the required timepoint (for example ss 7(1)(b), 8(1)(b), 10(1)(b), 11(1)(b), 12(1)(b), 13(1)(c), 21(1)). For targets that specify measurement in the third year of the target cycle, achievement is judged against that discrete measurement point (see ss 9(1)(b), 17(1)(b)). For action targets the employer meets the target where, by the end of the target cycle, the employer’s policies or practices provide for the specified things (see, e.g., ss 14(2), 15(2), 16(2), 18(3), 19(2), 20(3), 22(2), 23(2), 24(2), 25(2)).

Governance and reporting duties. Several targets attach governance duties: s 14 requires that a comprehensive gender pay gap analysis be undertaken at least annually and its results reported to the governing body (s 14(1)(a)-(b) and s 14(2)). Target 25 requires expansion of internal reporting practices to include specified sexual harassment metrics to the CEO, key management personnel and governing body during the target cycle (s 25(2)). These duties create internal reporting obligations and place the governing body in the chain of accountability.

Eligibility rights and constraints. Many targets are only selectable where the baseline demonstrates absence of the specified arrangements. For instance, s 14(3) makes the pay gap analysis target selectable only if the employer did not undertake such an analysis in the two reporting periods immediately prior to the target cycle. Section 15(3) requires that two of the listed remuneration policies were not provided in the baseline for eligibility. Sections 16(3), 18(4), 19(3), 20(4), 22(3), 23(3), 24(3) and 25(3) contain analogous eligibility gates. These rules create rights for employers to avoid selecting targets that they are not eligible for, and conversely a duty to select only those targets for which baseline conditions permit selection (s 6(4)).

Documentation and evidentiary duties. Because nominations and specifications must be published (s 6(3)), employers have a duty to provide clear, documented specifications in their public report. For action targets, the obligation to provide specified policies or facilities by the end of the cycle implicitly creates a requirement to document implementation and make it verifiable in subsequent reporting cycles. The instrument repeatedly frames “meets the target” in terms of having the specified policies or the measured outcomes in place at the relevant timepoint (for example ss 14(2), 15(2), 18(3), 20(3)).

Limits on duties within the instrument. The instrument does not set penalties or enforcement procedures. It is made under s 17B of the Act (s 3). Any compliance or enforcement consequences for failure to select appropriate targets, to meet targets or to report accurately are matters for the Act and any other law, not the instrument itself. Practitioners should therefore consult the Act to determine statutory enforcement pathways.

In sum, the principal duties are to select three targets including at least one numeric target (s 6(2)), to specify and publish nominations in the public report when required (s 6(3)), and then to achieve the specified measurable or action outcomes by the end of the target cycle or at the discrete measurement points the instrument identifies (see the relevant target sections). Eligibility constraints in many targets limit which employers may select them, and governance duties require reporting to the governing body for certain targets (notably s 14).

The instrument itself does not set out penalties, sanctions or enforcement procedures. It is made under section 17B of the Workplace Gender Equality Act 2012 (s 3), and the instrument’s provisions operate within the enforcement architecture of that Act. The instrument provides the machinery for selecting, specifying and publicly reporting targets, and defines what constitutes meeting those targets; it does not separately prescribe fines, criminal offences or administrative sanctions.

Because the instrument repeatedly references the Act for key concepts and authority (for example s 6(1) refers to subsection 13(3AA) of the Act and s 5 operationalises paragraph 17B(1)(a) of the Act), enforcement and any remedies for non‑compliance are matters for the Act. Practitioners must therefore consult the Workplace Gender Equality Act 2012 for the statutory enforcement regime, the powers of the regulator, administrative sanctions or civil remedies that may follow from incorrect reporting, failure to select targets as required, or failure to meet selected targets. The instrument’s obligation to include nominations and specifications in the public report (s 6(3)) suggests that inaccuracies or false statements in public reporting would be governed by the Act’s provisions on reporting accuracy and any general provisions in other statutes about false or misleading representations, but the instrument itself does not describe such mechanisms.

The instrument does create auditability and evidentiary expectations. By requiring specification of categories and percentage changes, and by making selection and specification matters of the public report, the instrument increases the transparency of employer commitments. That transparency creates a record that could be used by the regulator under the Act to assess whether a target was properly selected, whether eligibility gates were respected (see s 6(4) and the several eligibility rules in Part 3), and whether the employer met the target by the relevant measurement date.

Where targets impose obligations that intersect with other statutory obligations , for example through references to adverse action and family and domestic violence as defined in the Fair Work Act 2009 (s 4) or through references to the National Employment Standards (s 22(1)(c)) , enforcement of overlapping statutory duties will be a matter for the relevant statute. For example, if an employer adopts an action target that introduces paid family and domestic violence leave in addition to the NES (s 22(1)(c)), enforcement of NES entitlements remains with the Fair Work regime while the instrument’s target compliance remains governed under the Act.

In practice, employers should assume that the consequences of inaccurate baseline reporting, erroneous selection, failure to implement promised action targets, or failure to achieve numeric targets will be addressed through the Act’s monitoring and enforcement powers. The instrument provides the commitments and measurement framework; the Act contains the enforcement levers.

The instrument expressly cross‑references several external statutes and statutory regimes and thereby shapes how employers must align their target choices with obligations under those regimes.

Workplace Gender Equality Act 2012. The instrument is made under s 17B of the Act (s 3) and repeatedly ties its operation to provisions of the Act. Section 5 explicitly links each target in Part 3 to the gender equality indicator referenced in the Division heading for the purposes of paragraph 17B(1)(a) of the Act. Section 6(1) sets the instrument’s selection rules as the rules for employers selecting targets in accordance with subsection 13(3AA) of the Act. The instrument therefore functions as a delegated instrument implementing target‑setting within the primary Act’s reporting and compliance framework. Practitioners must read the Act for definitions and for enforcement, baseline report requirements, reporting periods and the statutory meaning of designated relevant employer and target cycle.

Fair Work Act 2009. The instrument imports definitions from the Fair Work Act. The instrument’s definitions note that adverse action and family and domestic violence have the same meaning as in the Fair Work Act 2009 (s 4). That connection matters where action targets require protections against adverse action (for example s 22(1)(a) provides for protection from adverse action or discrimination where an employee disclosed family and domestic violence). Any interaction between targets and employees’ protection from adverse action will engage the Fair Work Act’s substantive protections and remedies where those protections are implicated by employer conduct.

National Employment Standards. The instrument references the National Employment Standards in a constrained way. Section 22(1)(c) permits an employer to select a target to provide paid family and domestic violence leave “in addition to” the paid family and domestic violence leave provided for by the National Employment Standards. That indicates the instrument contemplates employers may offer entitlements beyond the NES, and that employers selecting such a target should be conscious that NES entitlements continue to apply independent of any instrument target.

Public Service Act 1999. The instrument defines Agency Head by reference to the Public Service Act 1999 (s 4). That is relevant for employers within the public sector or with Agency Head roles included among managers for measurement purposes.

Superannuation and payroll law. Several action targets reference paying superannuation while employees are on parental leave or unpaid parental leave (s 18(2)(f)-(g)). Those obligations, if selected as targets and implemented, intersect with employers’ statutory obligations under superannuation law and payroll administration. The instrument itself does not change superannuation law, but an employer implementing a target that commits to paying superannuation must ensure those payments comply with superannuation legislation and taxation rules.

Confidentiality and non‑disclosure. Section 24(1)(e) and section 25(1)(h) address processes relating to use of non‑disclosure or confidentiality agreements in relation to sexual harassment and reporting of any use of such agreements to governing bodies. These provisions interact with general contract law on confidentiality and with any statutory constraints on the enforceability of non‑disclosure agreements in workplace harm contexts, although the instrument itself does not address any limits on such agreements. Employers choosing targets that touch on confidentiality must consider how those practices operate alongside any other statutory or common law constraints.

Privacy and data‑handling. The instrument requires employers to collect, measure and report demographic and pay data (for example, gender composition, pay quartiles, gender pay gap analyses). Those data collection and reporting obligations will interact with privacy laws and recordkeeping duties. The instrument does not specify privacy compliance requirements, but employers must ensure that collection, storage and publication of public reports comply with applicable privacy and data protection law.

Industrial instruments and enterprise agreements. Targets that affect entitlements , for example introducing employer‑funded parental leave, paying superannuation during leave, paid family and domestic violence leave beyond the NES , may require changes to employment contracts, enterprise agreements or workplace policies. The instrument does not change the legal status of enterprise agreements or awards; employers must ensure any target implementation complies with existing industrial instruments and consultation obligations.

Regulatory and governance frameworks. Several targets require reporting to the governing body or CEO and embedding governance accountabilities (ss 14, 24, 25). These obligations will interact with corporate governance regimes and the employer’s internal compliance frameworks. For public sector employers, Agency Head definitions may align target reporting with public sector accountability.

In short, the instrument is designed to sit within and to leverage multiple existing statutory frameworks. It makes explicit cross‑references to the Fair Work Act, the Public Service Act and the National Employment Standards, and functions as a delegated instrument under the Workplace Gender Equality Act 2012. Employers must therefore align any target selection and subsequent implementation with applicable rights, obligations and reporting duties under those connected legal regimes.

This instrument is the original instrument as made on 28 March 2025 by the Minister for Women, Katy Gallagher (instrument heading and signature block). Section 1 gives the instrument its name, the Workplace Gender Equality (Gender Equality Targets) Instrument 2025 (s 1). Section 2 contains a commencement table which records that the whole instrument commences immediately after the commencement of the Workplace Gender Equality Amendment (Setting Gender Equality Targets) Act 2025, with a commencement date shown as 4 April 2025 (s 2(1)). The commencement table includes the note: “This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument” (s 2 Note).

The instrument is made under section 17B of the Workplace Gender Equality Act 2012 (s 3). There are no amendment provisions within the instrument text; it neither provides for staged implementation of particular sections beyond what is stated in the commencement table nor lists any prior instruments or historical versions. The contents listing and the body of the instrument present the instrument as the initial specification of targets resulting from the Workplace Gender Equality Amendment (Setting Gender Equality Targets) Act 2025.

Because the instrument is newly made, there is no internal amendment history recorded in the text. Any future amendments would be made by the Minister under the Act and published as subsequent instrument versions. The commencement table’s note indicates that the table will not be updated to reflect future amendments: any amendment history must therefore be tracked by reference to the consolidated instrument register or to the government’s legislative instrument database rather than to the instrument’s printed commencement table.

For practitioners advising employers, the key dates from this instrument are: instrument made 28 March 2025 and commencement tied to the Amendment Act’s commencement, recorded as 4 April 2025 (s 2). After commencement, the instrument’s selection rules and target lists apply to target cycles beginning after that date (s 6(1)).

The instrument itself contains no references to judicial decisions, case law, or litigation. It is a delegated legislative instrument that prescribes the content and selection rules for gender equality targets under the Workplace Gender Equality Act 2012. The instrument does not name any cases, nor does it summarise litigation history or judicial interpretation of the Act or related policies.

Because the instrument is new, there is no litigation history involving the instrument’s text in the instrument itself. Any litigation that may arise in future would concern interpretation of the Act and of this instrument in the context of employer reporting, alleged misstatements in public reports, disputes about baseline assessments, alleged failures to meet selected targets, or intersectional claims under other statutes (for example, claims under the Fair Work Act or under anti‑discrimination laws). Those potential disputes would be litigated under the statutory frameworks referenced by the instrument, notably the Workplace Gender Equality Act 2012 and employment law regimes.

Practitioners should therefore be aware that while the instrument creates publicly reportable commitments and measurable obligations, the instrument does not itself establish procedural dispute resolution or specify tribunals or courts for adjudication. Any legal proceedings about obligations, accuracy of reports or compliance are matters for the relevant courts, tribunals or statutory enforcement mechanisms under the Act or connected statutes. The instrument’s text offers no interpretative guidance from prior decisions.

In the absence of litigation tied to this instrument in its text, prudent advisers should monitor developments under the Act, and any early regulatory decisions or litigation that interprets the interaction between baseline reporting, target selection and the Act’s enforcement mechanisms, because those will shape how courts and regulators interpret the instrument’s requirements once disputes arise.

This instrument contains several specific traps and points of legal and practical friction that advisers and employers should be alert to. These are concrete mechanics and timing issues that can create compliance risk if misunderstood.

Mandatory selection composition. A designated relevant employer must select three different targets and at least one of those targets must be a numeric target (s 6(2)). Failure to select the required number or composition of targets would be non‑compliance with the instrument’s selection rules. Because the selections must be recorded in the public report (s 6(3)), employers cannot “reserve” unspecified targets for later.

Public report specificity. Any nomination or specification required by a target must be included in the public report in which the employer selects the target (s 6(3)). That turns launching commitments into immediate public statements. If an employer selects a target that requires specification of categories and percentages (typical for numeric targets), those specifications must be published at selection. Selecting without adequate public detail is inconsistent with s 6(3).

Eligibility gates tied to baseline. A large number of targets are only selectable if specific things did not exist in the baseline report. Examples include s 14(3) (pay gap analysis only if none in the prior two reporting periods), s 15(3) (equal remuneration policy components only if at least two were absent), s 16(3), s 18(4), s 19(3), s 20(4), s 22(3), s 23(3), s 24(3), and s 25(3). These rules mean employers must analyse their baseline report carefully before selecting targets, because selecting a target for which eligibility does not exist risks breaching s 6(4): “an employer may only select the target if those circumstances exist.”

Timing and measurement points. Numeric targets often measure at “the end of the target cycle” (for many targets) but some require measurement in the “third year of the target cycle” (notably promotions to manager in s 9(1)(b) and uptake of primary parental leave in s 17(1)(b)). If the Act’s concept of target cycle is not three years or its calendar does not align with employers’ reporting periods, this difference may create ambiguity. Employers must check the Act’s definition of “target cycle” to ensure they measure at the correct timepoint.

Definition of manager. The instrument expands the category of manager to include CEO or equivalent, Agency Head or equivalent, key management personnel and other managers (s 4). That broadened definition affects headcount splits and can materially change representation and pay gap calculations. Employers should not assume conventional structural definitions of manager align with the instrument’s definition.

Third‑year measurement implications. For promotions and parental‑leave uptake the instrument requires measurement specifically in the third year of the target cycle (ss 9(1)(b), 17(1)(b)). That creates a discrete measurement date and may mean progress earlier in the cycle is not the determinative evidence of success. Employers must prepare to measure and report at those discrete points.

Action target proof. For action targets the instrument states an employer “meets the target” if, at the end of the target cycle, the employer’s policies provide for the specified things (for example ss 15(2), 18(3), 19(2), 20(3), 22(2), 24(2)). This places premium on documented policy text and demonstrable implementation. Verbal commitments or interim pilots without formal policy change may not be sufficient evidence that the target is met.

Intersections with NES and Fair Work protections. Targets that commit to paid family and domestic violence leave “in addition to” the NES (s 22(1)(c)) or that involve protections from adverse action defined by the Fair Work Act (s 4) require employers to manage overlapping legal obligations. Implementing additional paid leave must be reconciled with enterprise agreements, awards and existing contractual obligations.

Quantification and comparators. Numeric targets require employers to nominate a percentage change relative to the baseline (for example ss 7-13, 17, 21). Accurate baseline data is therefore essential. The instrument defines baseline for numeric targets as the corresponding value reported in the baseline report (s 4). If the baseline data are incomplete or incorrectly categorised, the employer risks committing to an infeasible target or misstating progress.

Multiple minima and combined conditions. Some targets require combinations of specifications. For example, s 18 allows an employer to specify at least three of a list of parental leave improvements, or at least two plus an increase in length of entitlement (s 18(1)(a)-(b) and s 18(2)). Section 20 requires the employer to specify at least six flexible offerings (s 20(1)) and at least four policy items that were not in the baseline (s 20(2)). These multi‑condition rules create complexity in both selection and demonstration of compliance.

Reporting on sexual harassment and confidentiality. Targets 24 and 25 require policies about non‑disclosure agreements and reporting practices for sexual harassment (s 24(1)(e), s 25(1)(h)). Expanding reporting to governing bodies about prevalence, trends and any use of confidentiality agreements (s 25(1)) may have consequences for how organisations manage complainant confidentiality, settlement agreements and legal risk. Employers should design reporting practices that both protect victims and meet the expanded reporting obligations.

Default failures and remedial ambiguity. The instrument sets the commitments and measurement points but does not describe remedial mechanisms for partial compliance or for missing a numeric target by a small margin. Because enforcement lies in the primary Act, employers should plan for internal governance and remedial plans to evidence good‑faith progress where targets are not met entirely.

In practice these “gotchas” mean employers should treat selection as a formal governance decision: verify baseline data, ensure eligibility conditions are met before selection, specify targets precisely in the public report, prepare documentation and governance reporting arrangements, and align implementation with other legal obligations.

Compliance with this instrument requires a structured, documented process that connects baseline data, public reporting, governance assignments and operational implementation. The following stepwise checklist is grounded in the instrument’s provisions and cites the relevant sections employers must observe.

1. Confirm designation and applicable cycles. Determine whether the employer is a designated relevant employer under the Workplace Gender Equality Act 2012 and identify the relevant target cycle start date that begins after the instrument’s commencement. The instrument’s selection rules apply to target cycles beginning after commencement (s 6(1)). Consult the Act for definitions of designated relevant employer and target cycle.

2. Assemble and verify the baseline report. The instrument’s eligibility rules and baseline comparisons depend on the employer’s baseline report (s 4, baseline definition). Before selecting targets, extract and verify the baseline values for numeric measures (representation percentages, pay metrics, promotions, pay quartiles) and the baseline statements of policy or circumstance for action targets (for example whether particular parental leave items, facilities, training or reporting practices existed in the baseline). Errors in baseline data will propagate into the public report and can create compliance risk.

3. Identify candidate targets and check eligibility. Review Part 3 and identify three different targets to nominate. Remember the mandatory composition: select three different targets and at least one numeric target (s 6(2)). For each candidate target, check eligibility gates that depend on baseline absence of particular practices or prior reporting (see s 14(3), s 15(3), s 16(3), s 18(4), s 19(3), s 20(4), s 22(3), s 23(3), s 24(3), s 25(3)). Do not select a target that requires circumstances that do not exist, because s 6(4) forbids selecting targets without the required eligibility circumstances.

4. Prepare precise public report specifications. For any target that requires nominations or specifications, prepare the exact wording and numeric values that will go into the public report. Section 6(3) requires inclusion of the nomination/specification in the public report at time of selection. Numeric targets typically require specifying the category (e.g. a pay quartile, managers or non‑managers, a category of non‑managers that does not include all non‑managers) and nominating the increase or reduction as a percentage (see ss 7-13, 17, 21). Action targets require specifying which items from the listed options the employer will provide or implement (for example ss 15(1), 18(1), 19(1), 24(1), 25(1)).

5. Assign governance responsibility and reporting lines. For targets with governance reporting duties, assign responsible officers. The pay gap analysis target requires reporting results to the governing body at least annually (s 14(1)(b)). Target 25 requires expanding reporting to CEO, key management personnel and governing body to include specified issues (s 25(2)). Document who will receive and review these reports and how they feed into board or executive oversight.

6. Build implementation plans and timelines. For action targets, develop an implementation plan that ensures the specified policies, facilities or reporting arrangements will be in place by the end of the target cycle (see s 15(2) and s 18(3), among others). For numeric targets, build measurable interventions that are reasonably likely to achieve the nominated percentage change by the measurement date (end of target cycle or third year, depending on the target; see ss 7-13, 17, 21, 9, 17). Where measurement occurs in the third year (e.g. promotions and primary parental leave uptake, ss 9(1)(b), 17(1)(b)), ensure data collection and interim monitoring is aligned to capture the required snapshot.

7. Ensure HR, payroll and benefits systems can deliver required changes. Targets that involve employer‑funded parental leave, paid family and domestic violence leave, or employer payment of superannuation during leave will require payroll and HR system changes to administer entitlements and super contributions (see ss 16, 18(2)(f)-(g), 22(1)(c)). Coordinate with payroll, tax and superannuation administrators to test scenarios and ensure legal compliance with superannuation and tax law.

8. Put in place data collection, audit trails and privacy safeguards. Numeric targets and pay gap analyses require collection and retention of demographic and remuneration data. Ensure recordkeeping, privacy and data protection processes are established. Baseline values will be subject to public reporting; maintain an auditable trail demonstrating how baseline numbers were derived in case of queries under the Act.

9. Implement training, policy drafting and communications. Action targets frequently require training (for example managers and non‑managers training on sexual harassment, s 24(1)(b)) and policy drafting (for example remuneration review processes without gender biases, s 15(1)(a)). Ensure that training curricula, policy texts and communications to staff are drafted, approved and scheduled before the end of the target cycle.

10. Document measurement and set monitoring cadence. For numeric and action targets that require at least annual activity, set monitoring cadences (for example pay gap analysis requires at least annual analysis, s 14(1)(a)). Track progress quarterly or semi‑annually and keep governance informed. For targets measured at specific points, schedule end‑of‑cycle or third‑year measurement and ensure data integrity at those snapshots.

11. Prepare the public report at point of selection and maintain evidence. When lodging the public report that selects targets, include the precise nominations and specifications required by the instrument (s 6(3)). Keep documentary evidence that demonstrates implementation: policy documents, payroll records, meeting minutes of governing body reviews, training attendance lists, procurement records for facilities, and data extracts for numerical measures. For action targets, the instrument defines “meets the target” by the presence of specified policies or facilities at the end of the target cycle (see, e.g., ss 15(2), 18(3), 19(2), 20(3)), so documentation that demonstrates policy presence and operation is essential.

12. Engage employee groups and governance for consultation targets. Target 23 requires that employers consult at least annually either a diversity committee or an employee representative group and also consult all staff annually using at least two specified methods (s 23(1)). Ensure consultative structures exist or are established and that consultation outcomes are recorded.

13. Coordinate with legal counsel on confidentiality, reporting and settlement practices. Targets addressing sexual harassment and confidentiality (ss 24-25) require careful legal alignment. Where targets require reporting of the use of non‑disclosure agreements or expanded reporting on harassment outcomes, counsel should review settlement clauses and confidentiality practices to ensure they do not frustrate reporting obligations or contravene the employer’s commitments.

14. Review interactions with enterprise agreements and awards. If implementing leave or pay changes that affect employment terms, test whether enterprise agreements, awards or contracts require consultation or variation procedures, and ensure any bargaining or notice obligations are observed.

15. Reassess and recalibrate at reporting intervals. Use the interim monitoring results and the annual pay gap analysis (if selected) to recalibrate strategies and to evidence ongoing progress to the governing body. For numeric targets, maintain a trajectory that makes achieving the nominated percentage realistic, and where it is not, document remedial steps and governance oversight.

16. Seek external assurance if necessary. Given the public and auditable nature of target specifications in the public report, employers may consider external assurance or third‑party verification of baseline data or implementation status, particularly for complex pay or representation metrics.

17. Keep regulatory liaison and review the Act. Because enforcement, definitions and some processes are in the Act rather than in the instrument, coordinate with regulatory advisers to ensure that selection, reporting and implementation meet both the instrument and the Act’s broader requirements.

This compliance pathway converts the instrument’s provisions into an executable plan: verify designation and baseline, select eligible targets (three in total including at least one numeric), ensure precise public reporting, assign governance and operational responsibility, implement required changes, maintain auditable records, and measure at the instrument’s specified timepoints. Each step is traceable to the instrument’s sections and to the Act where the instrument refers to statutory definitions and powers.
