What it does
This instrument, the Workplace Gender Equality (Gender Equality Standards) Instrument 2023 (the instrument), specifies the gender equality standards required under subsection 19(1) of the Workplace Gender Equality Act 2012 (the Act). It does three concrete things.
First, it sets out that, for the purposes of subsection 19(1) of the Act, designated relevant employers must have in place policies or strategies in respect of each gender equality indicator listed in the instrument, and those policies or strategies must aim to achieve the listed objective for each indicator (see s 6(1) and s 6(3)(a)-(b)). The instrument therefore converts the statutory reference to a gender equality standard into a set of six discrete obligations: to have policies or strategies addressing workforce gender composition; governing body composition; equal remuneration; availability and utility of family‑supportive and flexible working arrangements; consultation with employees on gender equality issues; and prevention of and appropriate response to sexual harassment, harassment on the ground of sex or discrimination (s 6(3) and the table in s 6(3)).
Second, it fixes the dates from which the standards apply to reporting periods for designated relevant employers. For Commonwealth companies and Commonwealth entities, the standards apply to reporting periods commencing on or after 1 January 2024. For any other designated relevant employer, the standards apply to reporting periods commencing on or after 1 April 2023 (s 6(2)(a)-(b)). This creates staggered commencement depending on employer type.
Third, it handles continuity and transition from the previous instrument and later amendments. The instrument repeals the Workplace Gender Equality (Minimum Standards) Instrument 2014, but preserves the 2014 instrument as in force immediately before repeal for reporting periods that commenced before that repeal (s 7). It also specifies that amendments made by the Workplace Gender Equality (Gender Equality Standards) Amendment Instrument 2025 apply to reporting periods that commence after that amendment instrument commences (s 8). The instrument is made under section 19 of the Act (s 3), and defines Act to mean the Workplace Gender Equality Act 2012 (s 5).
