sec.316 Use of information given to police commissioner
Information given to the police commissioner under this division must not be accessed or disclosed for any purpose except for a purpose under this chapter or any other purpose relevant to law enforcement. Information given to the police commissioner under this division must not be used for any purpose except if— for information other than information about a withdrawal—the use is for a purpose under this chapter or for any other purpose relating to child protection; or for information about a withdrawal—the use is for a purpose under this chapter. However, subsections (1) and (2) do not apply to information the police commissioner obtained before the chief executive gave the information to the police commissioner under this section. In this section— withdrawal means withdrawal of any of the following— a working with children check application; an application to cancel a negative notice. s 316 ins 2010 No. 5 s 58 amd 2014 No. 28 s 55 ; 2019 No. 18 s 86 (1) sch 1 ; 2024 No. 50 s 84 (sec.316-ssec.1) Information given to the police commissioner under this division must not be accessed or disclosed for any purpose except for a purpose under this chapter or any other purpose relevant to law enforcement. (sec.316-ssec.2) Information given to the police commissioner under this division must not be used for any purpose except if— for information other than information about a withdrawal—the use is for a purpose under this chapter or for any other purpose relating to child protection; or for information about a withdrawal—the use is for a purpose under this chapter. (sec.316-ssec.3) However, subsections (1) and (2) do not apply to information the police commissioner obtained before the chief executive gave the information to the police commissioner under this section. (sec.316-ssec.4) In this section— withdrawal means withdrawal of any of the following— a working with children check application; an application to cancel a negative notice.
- (a) for information other than information about a withdrawal—the use is for a purpose under this chapter or for any other purpose relating to child protection; or
- (b) for information about a withdrawal—the use is for a purpose under this chapter.
