sec.311 Chief executive may ask police commissioner for information

The chief executive may ask the police commissioner for information, or for access to the police commissioner’s records, to enable the chief executive to learn what, if any, police information exists in relation to the person. For subsection (1) , the chief executive’s request may include the following information— the person’s name and any other name that the chief executive believes the person may use or may have used; the person’s gender and date and place of birth; the person’s address; if the person holds a working with children clearance—any number or date related to the person’s clearance or working with children card; if the person holds a working with children exemption—any number or date related to the person’s exemption or working with children card; if the request relates to a person employed in regulated employment—whether or not the person carries out the work as a volunteer; the basis on which the chief executive may request information about the person, including, for example, by referencing the relevant provision of section 310 . If there is police information about the person, the chief executive may ask the police commissioner for— a brief description of the circumstances of a conviction, charge or investigative information mentioned in the police information; or a section 93A transcript relating to an offence mentioned in the police information; or a transcript of a recorded statement relating to an offence mentioned in the police information.
