Workforce Inspectorate Victoria Act 2020

This Act organises the law around a small set of core concepts. Each concept plays a discrete mechanical role in allocating decision‑making, disclosure obligations and enforcement.

Workforce Inspectorate Victoria (institutional concept)

• S 19 establishes the inspectorate as a corporate entity with the usual corporate capacities and powers necessary to perform its statutory functions (s 19(2)(a)-(e)). The body is the primary actor for administration, enforcement, education and information sharing under the Act (s 20).

Commissioner (single executive concept)

• The Commissioner is the statutory officeholder who holds the functions and powers of the inspectorate (s 30(1)(a)). Appointment, term, removal, vacancy and acting appointment rules are set out in ss 25-29. The Governor in Council appoints or removes on the Minister’s recommendation (ss 25(2), 28). The Commissioner is the public service head of the inspectorate (s 30(2)(b)).

Worker (substantive subject)

• The Act defines "worker" in s 3(1) as a person who is or was employed on a paid or voluntary basis or engaged as an independent contractor to work at or in relation to a workplace. The workplace definition expressly includes residential premises where work is carried out but excludes a person’s domestic home except where work is carried out elsewhere in the home (s 3(1)).

Public construction (scope for referrals and complaints)

• "Public construction" is defined at s 3(1) to mean public construction under the Project Development and Construction Management Act 1994 and any other class of construction prescribed by regulation (s 3(1)(a)-(b)). The inspectorate has express functions to receive, refer and report on complaints and matters about public construction (s 20(1)(ia)-(id)).

Functions versus powers

• Functions are specified in s 20. They include education, compliance promotion and enforcement, guideline publication, inter‑agency information sharing, receipt and referral of public construction complaints and provision of advice to the Minister. Section 21 provides a general ancillary power to do all things necessary or convenient to perform these functions. The Commissioner is vested with the functions and powers of the inspectorate (s 30(1)(a)) and may delegate (s 31).

Ministerial oversight and limits

• The Minister may give general written directions to the inspectorate except in relation to the function in s 20(1)(ib) (the referral/disclosure of public construction complaints) and employment/engagement of staff under s 23 (s 24(1)(a)-(b)). The Minister can require reports (s 24(2)-(3)).

Confidentiality and disclosure

• S 77 sets out both prohibitions on unauthorised disclosure and express grounds for disclosure, including where necessary to perform the Act, to enable enforcement of law, under court order, with consent or where required by law. The Commissioner also has a public interest discretion to disclose (s 77(3)).

Offences and protections

• New anti‑reprisal offence: s 69A makes it an offence to cause or threaten detriment because a person has made or intends to make a complaint to the inspectorate or provided, intends to provide or is participating in processes arising from complaints to the inspectorate. Detriment is defined broadly in s 69A(6)(a) but expressly excludes a number of employment‑related actions (s 69A(6)(b)).
• False information offences: s 70 prohibits giving false or misleading information to the inspectorate or producing false documents without indicating the falsehood and supplying correct information if practicable.

Information sharing with government agencies

• Section 71 imposes a statutory duty on government agencies and bodies to respond to requests from the inspectorate for notifications or information about investigations or actions taken in relation to matters referred by the inspectorate, within a reasonable time.

Regulations and prescription

• S 79 empowers the Governor in Council to make regulations, including prescribing workplace entitlements matters for the inspectorate’s information and education functions (s 79(1)(a)) and prescribing classes of construction for public construction (s 79(1)(ab)). Regulations may confer discretionary authority or impose duties (s 79(3)(c)).

Transitional construction and saving

• Ss 80-83 provide that references to the Wage Theft Act 2020 and to the Wage Inspectorate Victoria in other instruments are to be read as references to the renamed Act and Workforce Inspectorate Victoria, preserve the entity and Commissioner continuity, and permit transitional regulations with limited retrospective operation and a two‑year expiry for the transitional regulation power (s 83(4)).

Taken together, these concepts create a statutory inspectorate that exercises investigatory, referral, educational and enforcement roles, with a single accountable Commissioner, powers to coordinate with government agencies and explicit confidentiality and criminal offence provisions intended to protect complainants and the integrity of information supplied to the inspectorate.

The Act sets out a network of statutory relationships; those who will practically be affected fall into several classes. Below each class is described in terms of who pays, who decides, and what behaviour the Act is structured to change, with statutory citations for each point.

Workers and potential complainants

• Who: persons defined as "workers" (s 3(1)), including paid or voluntary employees and independent contractors working at or in relation to a workplace.
• Decisions: workers decide whether to make complaints to the inspectorate or provide information on public construction issues. The Act expands the inspectorate’s functions to receive complaints and to provide information and advice to workers about prescribed workplace entitlements matters (s 20(1)(ha), (ia)).
• Behaviour change: s 69A creates a statutory protection against reprisal for those who make or intend to make complaints or provide information; that protection is backed by criminal penalties (s 69A(1)-(5)). The Act therefore intends to reduce the perceived cost of reporting to the inspectorate by criminalising detriment and threats.

Employers, principals, labour hire providers and contractors (including in public construction)

• Who: private sector entities and individuals who employ or engage workers or who are parties to public construction projects falling within the definition at s 3(1).
• Decisions: affected parties must decide how to respond to complaints, referrals and information requests. While the Act places formal information obligations on government agencies in s 71, employers and private parties are subject to the criminal prohibitions in s 69A if they cause or threaten detriment and to s 70 if they provide false or misleading information to the inspectorate.
• Behaviour change: the reprisal offence (s 69A) and false information offences (s 70) increase legal risk for aggressive responses to complainants and for providing false material to the inspectorate. Employers must also account for the inspectorate’s ability to receive and refer complaints about public construction (s 20(1)(ia)-(ib)).

Government agencies and bodies

• Who: Victorian government agencies, bodies and agencies of the Commonwealth, other States or Territories with which the Workforce Inspectorate is directed or chooses to share information (s 20(1)(i), (ib), (ic)).
• Decisions: agencies must decide how to respond to the inspectorate’s requests for notifications or information about investigations and actions on referred matters under s 71(1)-(2). The Act imposes a duty to provide requested notifications or information "within a reasonable time", as specified by the inspectorate (s 71(2)).
• Behaviour change: the statutory obligation in s 71 formalises inter‑agency co‑operation and can change investigation and enforcement timing and prioritisation for recipient agencies, which must allocate resources to respond.

Minister, Governor in Council and the Commissioner

• Who: the Minister retains policy direction and reporting oversight; the Governor in Council appoints, remunerates and may remove the Commissioner on the Minister’s recommendation (ss 25-28).
• Decisions: the Minister may give general written directions to the inspectorate, except in relation to staff employment/engagement and the public construction referral/disclosure function (s 24(1)). The Commissioner decides operational matters, may delegate powers (s 31) and can disclose information in the public interest (s 77(3)).
• Behaviour change: the statutory carve‑outs in s 24(1) limit Ministerial control in two specific areas, preserving operational independence over public construction referrals and staffing decisions in a narrow sense. The Commissioner, backed by statutory immunity for acts done in good faith (s 75(1)-(2)), has executive discretion in practice to shape the inspectorate’s interventions.

Courts, VCAT and legal practitioners

• Who: courts and VCAT receive information disclosed under exception grounds in s 77(2)(b)-(c) and may be the forum for enforcement proceedings. Legal practitioners will engage with disclosure and confidentiality rules and the offence provisions.
• Decisions: legal actors decide admissibility, confidentiality and whether particular disclosures are authorised by s 77 exceptions or fall within the Commissioner’s public interest discretion (s 77(3)).

The Crown

• Who: the Act binds the Crown in right of the State and in other capacities where legislation permits (s 4(1)-(2)). The Crown is therefore both a subject and a potential addressee of the inspectorate’s functions.
• Decisions: agencies representing the Crown must comply with information requests under s 71 and can be recipients of referrals under s 20(1)(ib).

Regulated private parties in construction

• Who: parties involved in public construction projects as defined or prescribed (s 3(1); s 79(1)(ab)).
• Decisions: contractors, subcontractors and principals in public construction must decide whether to engage with inspectorate complaints and whether to co‑operate with referred investigations. The inspectorate may disclose or refer information about public construction to other agencies (s 20(1)(ib), (ic)).

Third parties, consultants, contractors engaged by the inspectorate

• Who: persons engaged under s 23(2)-(4) as consultants or contractors to assist performance of functions.
• Decisions: these persons must comply with confidentiality duties under s 77 and are subject to the Act’s disclosure prohibitions and exemptions.

Who pays

• Practical compliance costs will fall primarily on employers, contractors and principals who must adjust conduct and processes to avoid contravening s 69A and s 70, and on government agencies that must respond to s 71 requests. The inspectorate’s operating costs are borne by the State through normal public budgeting and staffing arrangements; the Commissioner’s remuneration is fixed by Governor in Council (s 26(2)).

Who decides

• Strategic decisions about the inspectorate’s priorities and conduct rest with the Commissioner exercising powers vested by the Act (s 30(1)(a)). Appointments and removals are carried out by Governor in Council on the Minister’s recommendation with the Minister able to issue general directions subject to specified limits (s 24).

What behaviour the Act is structured to change

• The criminalisation of reprisal and threats against complainants aims to reduce retaliation and increase reporting to the inspectorate (s 69A). Information‑sharing powers and a formal duty on agencies to reply to requests aim to increase inter‑agency cooperation and case progression (ss 20(1)(ib)-(ic), 71). Education, guideline publication and outreach functions aim to alter private behaviour through information rather than through direct economic penalties alone (s 20(1)(a), (f), (j)).

These impacts follow directly from the statutory text. The Act’s territorial reach, the definitions it retains and those it repeals, and the delegated rule‑making powers shape the practical perimeter of who is affected and how.

This section identifies statutory duties the Act imposes and rights it creates or preserves. Each duty or right is cited to the provision that creates it and described in concrete terms so practitioners can identify compliance obligations and enforcement levers.

Duties imposed on the Workforce Inspectorate Victoria

• To inform, educate and assist: The inspectorate must carry out information, education and assistance functions about rights and obligations under the Act (s 20(1)(a); s 20(1)(ha) for prescribed workplace entitlements).
• To promote, monitor and enforce compliance: The inspectorate is required to promote, monitor and enforce compliance with the Act and regulations (s 20(1)(b)).
• To develop and publish guidelines: The inspectorate must develop and publish guidelines in relation to the Act (s 20(1)(f)).
• To share and receive information about public construction: The inspectorate may receive complaints about public construction and refer them to other government agencies; it may request and receive notifications from agencies about actions taken in respect of referred matters (s 20(1)(ia)-(id); s 71).

Duties on government agencies and bodies

• To respond to inspectorate requests for information: Section 71(2) requires a government agency or body that receives a request under s 71(1) to provide the required notification or information within a reasonable time specified by the inspectorate. That is a statutory duty on recipient agencies.

Duties on persons interacting with the inspectorate

• Not to give false or misleading information: Section 70(1) prohibits giving information to the inspectorate or Commissioner that the person believes to be false or misleading in a material particular. Section 70(2) has a similar prohibition concerning producing false documents without indicating how they are false and, if practicable, providing correct information.
• Not to cause or threaten detriment: Section 69A(1) prohibits causing or threatening detriment to a person because they have made, provided, intend to make or participate in matters related to complaints or public construction information. Detriment is defined in s 69A(6)(a) and the section clarifies what is excluded in s 69A(6)(b).

Duties of confidentiality and permitted disclosures

• Non‑disclosure duty: Section 77(1) prohibits a person who obtains information under the Act from disclosing it unless an exception applies, with a penalty of 75 penalty units for unauthorised disclosure.
• Specified disclosure exceptions: Section 77(2) lists circumstances when disclosure is permitted, including where disclosure is necessary to perform functions under the Act, to courts or VCAT, under court order, for the investigation or enforcement of laws, with written consent, or where required by law. Section 77(2)(ab) specifically authorises disclosure consistent with the inspectorate’s functions to refer information about public construction (s 20(1)(ib) or (id)). The Commissioner also has a public interest power to disclose (s 77(3)).

Rights conferred on individuals and bodies

• Protection against reprisals: Individuals who make complaints or provide information to the inspectorate gain protection under s 69A, which criminalises detriment or threatened detriment against such persons. The right is statutory and enforceable by criminal sanction.
• Right to have the inspectorate receive and act on complaints: The inspectorate’s functions include receiving complaints and matters, including about public construction (s 20(1)(ia)), and the power to refer them to other agencies (s 20(1)(ib)).
• Right to confidentiality with limited exceptions: Persons whose information is obtained by the inspectorate have a statutory expectation of non‑disclosure except in the enumerated circumstances (s 77). The Commissioner’s discretion under s 77(3) to disclose in the public interest will be a touchstone for balancing confidentiality and transparency.

Operational duties connected to appointment and governance

• Reporting to the Minister: The Minister may direct the inspectorate to provide reports on specified matters and the inspectorate must comply within a reasonable time (s 24(2)-(3)). The Commissioner also reports and advises the Minister on guidelines and other referred matters under s 20(1)(h), (id).

Delegation and valid acts

• Delegation duties: The Commissioner may delegate functions to staff (s 31) but cannot delegate the power of delegation itself. Acts of the Commissioner done in the name of the inspectorate are taken to be acts of the inspectorate (s 30(3)). Section 74 vindicates acts and decisions despite defects in appointment, preserving administrative continuity.

Immunity for good faith acts

• Section 75(1) provides immunity for the Commissioner, Acting Commissioner or another person performing the Commissioner’s function from personal liability for acts or omissions necessarily or reasonably done in good faith. Any liability that would have attached to the individual instead attaches to the inspectorate (s 75(2)). This allocates the financial risk of legal exposure to the corporate body.

Regulation‑making duties and prescription

• The Governor in Council can make regulations prescribing workplace entitlements matters and classes of construction for the purposes of the Act (s 79(1)(a), (ab)), and more generally to give effect to the Act (s 79(1)(b)). Regulations may impose duties or confer discretionary authority (s 79(3)(c)).

Penalties and enforcement rights

• The Act establishes criminal sanctions as enforcement tools for selected conduct: s 69A imposes a Level 5 fine (1200 penalty units maximum) or Level 5 imprisonment (10 years maximum) or both; s 70 prescribes different penalties for bodies corporate and other persons for false information offences. The Act thereby gives prosecuting authorities the right to pursue criminal sanctions for contraventions of these specific offences.

Practical consequences of these duties and rights

• Employers and other private actors must calibrate their response to complaints and information requests knowing there is a reprisal offence (s 69A) and a false information offence (s 70).
• Government agencies must establish processes to respond within a reasonable time to inspectorate requests under s 71.
• The Commissioner and staff must observe confidentiality rules while balancing permitted disclosures and the Commissioner’s public interest discretion (s 77).

All duties and rights summarised above derive from the text of the Act. Practitioners should map specific factual situations to the precise statutory language, for example the exclusions in s 69A(6)(b) that exclude certain employment‑related disciplinary actions from constituting "detriment", and the requirement in s 70(2) to indicate how a document is false if produced.

This Act uses a targeted set of criminal penalties and administrative enforcement levers. The legislation delegates primary operational enforcement to the Workforce Inspectorate Victoria and reserves criminal sanctions for specific conduct types. This section sets out the statutory penalties and indicates how those penalties are invoked, with particular attention to procedural contexts signalled by the Act.

Criminal offences and maximum penalties

• Offence to cause or threaten detriment (s 69A)

  • Prohibition: It is an offence to cause detriment, or threaten to cause detriment, to a person because the person has made, provided or intends to make or provide a complaint or information to the inspectorate or has participated (or intends to participate) in processes under this Act or other Acts arising from complaints to the inspectorate (s 69A(1)).
  • Penalty: "Penalty: Level 5 fine (1200 penalty units maximum) or level 5 imprisonment (10 years maximum) or both" (s 69A(1)). The section defines "detriment" broadly (s 69A(6)(a)) while expressly excluding certain employment‑related actions such as dismissal or disciplinary proceedings (s 69A(6)(b)).
  • Elements: The section clarifies that detriment may be direct or indirect (s 69A(2)); a threat includes intention or recklessness that the other person will believe the threat (s 69A(3)); threats can be words or conduct, explicit or implicit and need not be believed by the other person (s 69A(4)); and the knowledge or belief that motivates the actor need not be the sole reason for causing detriment nor reasonable (s 69A(5)).

• Offence to give false or misleading information (s 70)

  • Prohibitions: It is an offence to give information to the inspectorate or Commissioner that the person believes to be false or misleading in a material particular (s 70(1)), and to produce a document known to be false or misleading without indicating the respect in which it is false and, if practicable, providing correct information (s 70(2)).
  • Penalties: For bodies corporate, the penalty is a Level 5 fine (1200 penalty units maximum). For "any other case", the Act specifies "level 7 imprisonment (2 years maximum)" (s 70(1) and (2)): the text as printed assigns different maximums by class of offender. Practitioners should consult sentencing and penalty unit tables for precise monetary or term conversions and confirm applicability in practice.
  • Mental element: The person must believe the information is false or misleading in a material particular for s 70(1). For document‑related misconduct s 70(2) requires knowledge that a document is false or misleading and a failure to indicate and, if practicable, correct it.

Administrative enforcement levers and inter‑agency mechanisms

• Investigation and case progression: The inspectorate’s functions include promoting, monitoring and enforcing compliance (s 20(1)(b)) and receiving and referring complaints about public construction (s 20(1)(ia)-(ib)). The inspectorate may thereby open administrative investigations, refer matters to other agencies and use its educational and guideline powers to achieve compliance.
• Inter‑agency information requests: Section 71 gives the inspectorate an affirmative route to obtain notifications and information from government agencies and bodies about investigations or actions they have taken on matters the inspectorate referred. Government agencies must comply within a reasonable time specified by the inspectorate (s 71(1)-(2)). That statutory duty can accelerate inter‑agency enforcement activity and facilitate prosecutions or administrative enforcement by other agencies.
• Prosecution: The Act contains criminal offences; prosecution would proceed under ordinary criminal procedure and prosecutorial discretion. The Act does not itself create an exclusive enforcement pathway or specify which prosecuting authority handles offences; the ordinary prosecutorial bodies and processes in Victoria would apply.
• Immunity and vicarious liability: S 75 provides immunity for the Commissioner, Acting Commissioner or persons performing the Commissioner’s functions from personal liability for acts or omissions done in good faith; liability attaches to the corporate body instead (s 75(1)-(2)). This shifts economic risk from individuals performing statutory functions to the inspectorate entity, which may affect how enforcement decisions are operationalised.

Confidentiality and enforcement interfaces

• The confidentiality duty in s 77(1) (penalty 75 penalty units) limits the unauthorised use of information obtained under the Act in enforcement contexts. Exceptions in s 77(2) permit disclosure in specific enforcement circumstances, for example to enable investigation or enforcement of laws (s 77(2)(d)) or to a court or VCAT (s 77(2)(b)-(c)). The Commissioner’s public interest discretion to disclose (s 77(3)) creates an operational tool to release information where disclosure is thought necessary to support enforcement or public accountability.

Procedural protections and validation

• Validity of acts and decisions: S 74 protects acts and decisions of the inspectorate or Commissioner from challenge based solely on defects in appointment or on the ground that the acting appointment occasion had not arisen or had ceased. This reduces the risk that procedural defects in appointment will invalidate enforcement action.
• Evidence and disclosure: Where information produced to the inspectorate is materially false, s 70 allows for criminal sanctions and such production would also affect evidentiary credibility in any prosecution or civil proceedings.

Practical enforcement implications

• The Act targets reprisals and false information rather than creating a broad criminal offence regime against employers for wage theft in the text provided. The reprisal offence (s 69A) is framed to deter retaliation against complainants and participants in inspectorate processes.
• The inspectorate’s capacity to refer public construction matters to other agencies and to compel timely responses (s 20(1)(ib), s 71) increases the potential for coordinated administrative enforcement and for follow‑on prosecutions by other enforcement bodies. Penal consequences for non‑compliance (criminal offences and penalty units for confidentiality breaches) mean regulatory risk is material.

All penalties and enforcement architecture summarised here are taken from the statutory text as printed. Practitioners should consult authoritative penalty unit schedules and prosecutorial practice guidance for operational details and any subsequent amendments not captured in the 17 December 2025 consolidated version.

The Act expressly cross‑references, modifies or sits alongside several existing statutes and legal frameworks. This section identifies the most salient statutory interactions signalled in the text and spells out the practical consequences of those interactions for allocation of functions, definitional scope, and regulatory reach.

Public Administration Act 2004

• Staff and public service head: Section 23(1) authorises employment under Part 3 of the Public Administration Act 2004 of employees necessary for the inspectorate’s administration. Section 30(2)(b) makes the Commissioner the public service body Head of the Workforce Inspectorate for the purposes of s 16 of the Public Administration Act 2004. That links the inspectorate to public service governance, HR, and employment frameworks under the PAA.

Project Development and Construction Management Act 1994

• Definition of public construction: Section 3(1) defines "public construction" to include public construction within the meaning of the Project Development and Construction Management Act 1994 and any other classes prescribed by regulation. The inspectorate’s functions to receive and refer complaints relating to public construction (s 20(1)(ia)-(ib)) therefore reach activities governed under the project development legislation and, by regulation, may be expanded to specified classes of construction activity.

Wage Theft Amendment Act 2025 and transitional provisions

• Renaming and continuity: Parts of the Act and the accompanying Pt 6 (ss 80-83) implement a title change effected by the Wage Theft Amendment Act 2025. Section 80 requires that references in other instruments to the Wage Theft Act 2020 and to the Wage Inspectorate Victoria be read as references to this Act and the Workforce Inspectorate Victoria. Sections 81-82 save the identity of the inspectorate and the incumbent Commissioner. Section 83 authorises transitional regulations related to the Wage Theft Amendment Act, including limited retrospective effect, subject to constraints in s 83(3) and time limits in s 83(4).

Charter of Human Rights and Responsibilities Act 2006

• Limit on transitional regulation‑making: Section 83(3) provides that regulations made under the transitional power may have effect despite anything to the contrary in any Act other than the Wage Theft Amendment Act 2025 or the Charter of Human Rights and Responsibilities Act 2006. That means transitional regulations may not be used to override the Charter; Charter protections remain available against transitional regulations that attempt to operate inconsistently with the Charter.

Courts, VCAT and evidentiary interfaces

• Disclosure and proceedings: Section 77(2)(b)-(c) contemplates disclosure to courts or VCAT in the course of legal proceedings or under order. The Act therefore provides a statutory basis for information about complaints and investigations to be used in adjudicative forums subject to ordinary evidence and confidentiality rules.

Criminal law and prosecutorial frameworks

• Penalties in the Act invoke state criminal enforcement processes. The Act does not itself specify a particular prosecuting authority but offences will be prosecuted under Victoria’s criminal justice framework. The text and penalties therefore interact with criminal procedure, sentencing laws and prosecutorial discretion.

Administrative law and ministerial direction

• Limits on ministerial direction: Section 24 allows the Minister to give general written directions to the inspectorate about its performance, but expressly excludes directions in relation to the function in s 20(1)(ib) (referral/disclosure of public construction) and employment/engagement decisions under s 23. This design interacts with administrative law principles of executive control and operational independence, creating statutory carve‑outs for specified functions.

Inter‑agency co‑operation and other Acts

• Information sharing with Commonwealth, other States and Territories: Section 20(1)(i) contemplates sharing information with other government agencies and bodies, including Commonwealth and other States or Territories. That creates an operational bridge for cross‑jurisdictional investigations and enforcement that will engage the law controlling inter‑governmental information exchange and privacy obligations.
• Referrals to other bodies: The inspectorate may refer matters to other bodies (s 20(1)(k)), interact with agency‑specific enforcement regimes, and rely on recipient agencies to progress certain matters. Section 71 formalises a duty on such agencies to respond to inspectorate requests for notifications and information.

Interpretation of Legislation Act 1984

• The endnotes indicate that style changes and interpretive rules from the Interpretation of Legislation Act 1984 apply. Practitioners should note that headings, punctuation and examples included in the Act form part of the Act under the ILA as described in the endnotes.

Regulatory rule‑making and prescription

• Section 79 permits regulations to prescribe workplace entitlements matters and to identify classes of construction as public construction, and to differ by time, place or circumstance, and to confer discretionary authority. That gives regulatory instruments the capacity to shape operational scope and to impose duties on specified classes of person or body, subject to ordinary constraints on delegated legislation.

Other statutory contexts not explicitly amended in the Act

• Employment law and industrial remedies: The Act’s reprisal offence explicitly excludes certain employment actions such as dismissal and disciplinary proceedings from being treated as a "detriment" for the purpose of s 69A(6)(b). That preserves the separate regulatory architecture of employment law and industrial dispute resolution for many workplace‑connected adverse actions.
• Privacy and secrecy laws: The confidentiality regime in s 77 interacts with privacy legislation and other statutory secrecy obligations. Section 77(2)(d) permits disclosure to the extent reasonably required to enable investigation or enforcement of a law of the State, other States or the Commonwealth, which can create tension where privacy or secrecy laws limit disclosure; statutory exceptions in those regimes will need to be considered in each matter.

In short, the Act is designed to sit alongside existing enforcement and administrative law structures, to create an inspectorate with referral and inter‑agency coordination powers, and to protect complainants from reprisals and the integrity of the inspectorate’s information. The text embeds specific cross‑references that practitioners must track, notably to the Public Administration Act 2004, Project Development and Construction Management Act 1994 and the Wage Theft Amendment Act 2025, and it preserves constitutional limits such as those arising from the Charter.

The consolidated version presented incorporates amendments up to 17 December 2025. The Act’s endnotes and Table of Amendments list the principal amending instruments and the mechanical effect of those instruments as recorded in the text. This section summarises the amendments recorded in the source and the principal mechanical effects they produce in the statute.

Principal amending Acts and dates (as recorded)

• Justice Legislation Amendment (Integrity, Defamation and Other Matters) Act 2024, No. 31/2024

  • Assent: 10 September 2024
  • Commencement of the relevant schedule items: 10 February 2025 (special Gazette references in Table of Amendments)
  • Effect: Among other amendments recorded, Schedule 1 item references appear in the s 3 definition history; entries in the provisions show insertion and later repeal of definitions referenced to this amending Act (see Table of Amendments).

• Wage Theft Amendment Act 2025, No. 35/2025

  • Assent: 2 September 2025
  • Commencement: Various provisions commenced on 12 December 2025 and 17 December 2025 as specified in the Table of Amendments. The Act effected the title change from the Wage Theft Act 2020 to the Workforce Inspectorate Victoria Act 2020, inserted new definitions (worker, Workforce Inspectorate Victoria), repealed many prior definitions and parts (including previously existing Pt 2 and Pt 4 content), and inserted new sections such as ss 20(1)(ha), 20(1)(ib)-(id), 24(1) amendments, s 30 amendments and the new Pt 6 saving and transitional provisions (ss 80-83). The Table of Amendments records precise section numbers where these changes appear.

• Labour Hire Legislation Amendment (Licensing) Act 2025, No. 57/2025

  • Assent: 16 December 2025
  • Commencement: s 30 of that Act commenced on 17 December 2025 and is recorded as inserting s 69A into the Workforce Inspectorate Victoria Act 2020. The new anti‑reprisal offence is therefore a late 2025 insertion.

Amendment mechanics in the consolidated text

• Repeals of earlier provisions and definitions: The consolidated text shows a significant number of repeals described in s 3(1) annotation lines, where definitions such as "employee", "employer", "inspector", "employee entitlement" and various parts of earlier structure were repealed by No. 35/2025 s 5(1)(...). That suggests a substantial reworking of the Act’s definitional architecture and may signal shifting of substantive offence or enforcement provisions into other instruments or into the amended structure.
• Insertions of new concepts: The 2025 amendments inserted the definition of "worker" and "public construction" (s 3(1)), and new functions directed to public construction complaints (s 20(1)(ia)-(id)) and to provision of information and advice to workers on prescribed workplace entitlements matters (s 20(1)(ha)).
• Functional reconfiguration: The 2025 amendments reworked functions of the inspectorate in s 20, inserting and repealing subparagraphs and adding powers for referrals and inter‑agency coordination (s 20(1)(i), (ib), (ic), (id)).
• Transitional provisions and saving clauses: Ss 80-83 were inserted by No. 35/2025 s 40 to provide continuity in name and identity, to preserve existing decisions and appointments, and to permit transitional regulations with certain constraints and a two‑year sunset on the transitional regulation‑making power (s 83(4)).

Recorded commencement and operation details

• The original Wage Theft Act 2020 was assented to on 23 June 2020 and came into operation on 1 July 2021 for sections required to commence by s 2(2) (see endnotes). The Table of Amendments identifies the various commencement dates of the amending Acts listed above, with special Gazette references showing specific commencement dates for parts of the Wage Theft Amendment Act and the Labour Hire Legislation Amendment Act.

Practical effects of the amendments visible in the text

• The title change and saving provisions ensure continuity of references in other instruments and agreements to the old title and body (ss 80-82).
• The insertion of s 69A creates a new criminal offence protecting complainants and participants in inspectorate processes from detriment, thereby expanding the Act’s enforcement toolbox.
• The insertion of inter‑agency cooperation powers and duties, and the power to prescribe classes of public construction by regulation (s 79(1)(ab)), expands the inspectorate’s operational remit into public construction sectors and into co‑operation with other enforcement agencies.

Limitations of the amendment record in the source

• The consolidated text records the amendments and their legal effects but does not include explanatory memoranda or second reading speech details beyond the small endnote references. The Endnotes record that explanatory details contain "No entries at date of publication" in the consolidated version. Practitioners must therefore trace the underlying amending Acts and associated parliamentary materials for policy context and the legislative history of particular provisions if required for interpretation.

This amendment history summary is distilled from the Table of Amendments and endnote entries in the consolidated Act text provided, including the specific amending Act names, assent dates and commencement notes that the text records.

The text of the Act and its endnotes do not record any judicial decisions under the Workforce Inspectorate Victoria Act 2020 or its predecessor title in the material provided. The endnotes include the Minister’s second reading speech dates for the original Bill (Legislative Assembly 19 March 2020; Legislative Council 4 June 2020), but the consolidated act text contains no reported cases or citations to judicial interpretation within the body or endnotes.

What the absence of litigation in the source means in practice

• Unsettled interpretation risk: Because there are no reported decisions set out in the consolidated text, key interpretive questions arising from the post‑2025 configuration of functions, the scope of the public interest disclosure power in s 77(3), the scope and meaning of "detriment" in s 69A, and the interaction between s 71’s duty on government agencies and other statutory confidentiality or privacy obligations remain untested in court on the material provided. Practitioners should therefore anticipate litigation risk where statutory language is novel or broad, particularly around the tension between confidentiality, public interest disclosure and inter‑agency information exchange.
• Administrative law challenges: The Act provides for Ministerial directions (s 24) and prescribes appointment and removal processes for the Commissioner. Administrative law challenges could arise in contexts where the Minister’s direction powers are exercised in ways that parties allege are ultra vires or where appointment and removal processes are contested. Section 74 attempts to insulate acts from invalidity based on appointment defects, which is a statutory measure likely intended to reduce the scope for technical invalidity challenges.
• Criminal enforcement and evidentiary disputes: The new criminal offences (s 69A and s 70) will generate factual and legal disputes in prosecution, notably about the mental element of belief or knowledge, the causal link between protected acts and detriment, the meaning of "threat", and the exclusion in s 69A(6)(b) of certain employment actions. Those will be matters for prosecutorial decision and for court adjudication in individual cases.

Practical advice given the lack of judicial guidance in the Act

• Expect first impression litigation: Novel statutory elements such as the reprisal offence and the Commissioner’s public interest disclosure power are likely to be litigated at first instance. Practitioners should plan for interlocutory disputes over disclosure and confidentiality in investigations.
• Monitor prosecutorial practice and administrative guidance: Enforcement patterns and prosecutorial charging decisions will shape how the criminal provisions are operationalised. Administrative guidance, published guidelines and the inspectorate’s own policy documents under s 20(1)(f) will be important proxy sources of operational detail until courts provide authoritative interpretation.
• Litigative process implications: Section 74’s validation of acts despite appointment defects and s 75’s immunity for good faith acts are statutory protections that will feature in procedural arguments about remedies, damages and invalidity. Parties should factor those provisions into risk assessments and into decisions about judicial review or civil claims against officers.

In sum, the consolidated Act text contains no recorded litigation history. The legal community should treat many of the Act’s provisions as likely to attract early and important litigation on scope, interpretation and interaction with other legal frameworks.

This section sets out traps for the unwary, drafting asymmetries, operational friction points and legal tensions that arise from the Act as printed. Each "gotcha" identifies the operative provision, explains the practical effect and points to the statutory text that governs the risk.

1. Broad but selectively limited definition of "detriment" in the reprisal offence (s 69A)

• Why it matters: S 69A defines "detriment" widely to include injury, intimidation, harassment, ostracism and property damage (s 69A(6)(a)). That breadth could capture many forms of adverse conduct.
• The gotcha: The section also expressly excludes many employment‑related actions from constituting "detriment", including disciplinary proceedings, dismissal or prejudice in employment (s 69A(6)(b)). That carve‑out sits next to the otherwise broad definition and may produce disputes in cases where conduct overlaps employment discipline and retaliatory conduct (for example, where a purported disciplinary action is alleged to be pretextual retaliation). Practitioners should carefully map factual conduct to the exclusion list in s 69A(6)(b).

2. High criminal penalties with unusual classification language (ss 69A and 70)

• Why it matters: S 69A prescribes a Level 5 fine or Level 5 imprisonment "10 years maximum" or both. S 70, by contrast, sets corporate and individual penalties differently and uses the phrase "level 7 imprisonment (2 years maximum)" for non‑corporate offenders. The printed consolidation mixes penalty unit and level language that requires cross‑checking with the courts and penalty unit schedules.
• The gotcha: Penalty‑classification language in the consolidated text should be reconciled with Victoria’s Penalty Units Act and sentencing regimes. Practitioners should not rely on the textual shorthand in the consolidation without checking the current penalty unit schedule and sentencing framework.

3. Repeals and removed definitions create interpretive gaps

• Why it matters: The consolidated text records the repeal of many earlier definitions (employee, employer, inspector, employee entitlement, employee entitlement offence, employee entitlement record, etc.) by No. 35/2025 s 5(1)(…). At the same time, new terms such as "worker" have been inserted. The net practical effect is a reconfigured definitional landscape.
• The gotcha: Outside the text provided there may be other amending instruments or reform packages that relocate previously existing offences or obligations. Practitioners dealing with legacy matters or with citations to earlier versions of the Act must trace those amendments carefully and not assume previous terms remain operative.

4. Commissioner appointment and Ministerial direction interactions

• Why it matters: The Governor in Council appoints and removes the Commissioner on the Minister’s recommendation (ss 25, 28). The Minister can give general written directions but is explicitly barred from issuing directions in relation to the inspectorate’s public construction referral/disclosure function and staff employment/engagement (s 24(1)).
• The gotcha: The statutory carve‑outs narrow certain directions but not all. There may be borderline areas where a Minister’s direction indirectly affects a function that is excluded. Parties should scrutinise the content and practical effect of directions, and consider judicial review avenues where directions appear to usurp operational independence.

5. Confidentiality obligations versus public interest discretion (s 77)

• Why it matters: S 77 prohibits disclosure with a penalty and then sets out multiple exceptions, including a public interest disclosure power for the Commissioner (s 77(3)). The Commissioner’s public interest power is broad and will be fact‑sensitive.
• The gotcha: Organisations and counsel must navigate competing obligations when information is required by other law, needed for enforcement or subject to a court order. The Commissioner’s public interest decision is discretionary, and disclosure without appropriate statutory authority risks the 75 penalty unit sanction in s 77(1).

6. Government agency duty to respond to inspectorate requests (s 71)

• Why it matters: S 71 imposes a duty on government agencies to provide requested information within a reasonable time as specified. That creates a mandatory inter‑agency cooperation mechanism.
• The gotcha: The term "reasonable time, as specified by the Workforce Inspectorate Victoria" gives the inspectorate the ability to set timing expectations. Recipient agencies that are constrained by confidentiality, process, resources or other statutes must still reconcile those constraints with s 71’s duty, potentially creating tension and inter‑agency disputes. Practitioners in agencies should establish internal protocols to comply promptly with s 71 requests while ensuring legal constraints are managed.

7. Transitional regulations can have retrospective effect but are time limited (s 83)

• Why it matters: Section 83 allows transitional regulations to have retrospective effect to the day of Royal Assent of the Wage Theft Amendment Act 2025 and to override other Acts or instruments. It also limits such regulations from operating contrary to the Wage Theft Amendment Act 2025 or the Charter (s 83(3)) and provides that s 83 is repealed two years after commencement (s 83(4)).
• The gotcha: Transitional regulations with retrospective effect can alter legal rights and obligations for past conduct. Entities affected by the transition should identify whether regulations were made under s 83 and whether they are within the two‑year window.

8. Validation of acts despite appointment defects (s 74)

• Why it matters: S 74 preserves the validity of acts and decisions of the inspectorate or Commissioner despite defects in appointment or the acting appointment occasion.
• The gotcha: This provision limits procedural challenges to the validity of inspectorate acts based solely on appointment technicalities. Litigants should therefore focus on substance rather than relying on narrow technical grounds to invalidate actions.

9. Vicarious liability and immunity allocation (s 75)

• Why it matters: S 75 provides immunity for persons performing Commissioner functions in good faith and transfers liability to the corporate inspectorate.
• The gotcha: Parties wishing to pursue actions against individual officers for negligent or bad faith acts will face an immunity threshold; the practical effect is that civil claims will commonly target the inspectorate as the liable entity, with corresponding implications for remedies, insurance and funding.

10. Reliance on guidelines and regulatory instruments

• Why it matters: The inspectorate is empowered to develop and publish guidelines (s 20(1)(f)) and the Governor in Council may make regulations prescribing workplace entitlements matters and classes of construction (s 79(1)(a), (ab)).
• The gotcha: Guidelines and regulations may create discrete compliance obligations that are not spelled out in the Act’s core text. Regulated parties should monitor published guidelines and subordinate instruments to identify new duties or categories of regulated conduct.

Each of these points follows from the statutory text and the consolidated amendments as recorded. Practitioners should not assume these are exhaustive; the combination of recent amendments and the limited litigation record means operational unpredictability is a continuing risk.

This section provides practical, source‑grounded compliance steps for the main stakeholders identified earlier. The recommendations map directly to statutory duties and probable operational practices implied by the Act’s text.

For employers, principals and contractors

• Update policies on handling complaints and interactions with the Workforce Inspectorate:
  • Establish a written procedure for receiving, escalating and responding to complaints that may be or are made to the inspectorate, including steps to avoid causing or threatening detriment to complainants in any form identified in s 69A(6)(a).
  • Train managers and HR on the s 69A prohibition and the exclusions in s 69A(6)(b) so that legitimate disciplinary actions are documented and defensible.
• Ensure accuracy checks before producing materials to the inspectorate:
  • Implement a verification protocol for any information or documents provided to the inspectorate to minimise risk under s 70 (false/misleading statements or documents). If a document is known to be false in a material particular, comply with s 70(2) by indicating the respect in which it is false and, if practicable, providing correct information.
• Maintain confidentiality controls:
  • Designate a custodian for information obtained from the inspectorate and apply strict disclosure controls aligned with s 77. Only disclose where an express exception applies, such as necessary for performing functions under the Act, under court order, with written consent, or where required by law.
• Monitor public construction referrals:
  • If involved in public construction, be prepared for the inspectorate to receive and refer complaints to agencies (s 20(1)(ia)-(ib)). Ensure contract and compliance records for projects likely to be designated public construction (s 3(1); s 79(1)(ab)) are well kept and quickly accessible.

For government agencies and bodies receiving inspectorate referrals or requests

• Develop internal protocols to respond to s 71 requests:
  • Assign a liaison officer to receive and fulfil requests under s 71, including a process for assessing and providing "the required notification or information within a reasonable time, as specified by the Workforce Inspectorate Victoria" (s 71(2)). Document the reasonableness of time frames and any constraints or legal impediments to full disclosure.
• Coordinate privacy and disclosure risk:
  • Review privacy and secrecy obligations that could affect information sharing. Where disclosure is limited, document legal bases for refusing or redacting information and engage with the inspectorate early to resolve conflicts.
• Maintain evidentiary records for potential prosecutions:
  • Preserve records and investigative materials that may be needed for enforcement action following a referral so that the recipient agency can act expeditiously.

For the Commissioner and inspectorate staff

• Establish procedural fairness and confidentiality systems:
  • Implement procedures that ensure compliance with s 22’s guiding principles to act fairly, impartially and independently, and to be transparent, accountable and consistent. These should include clear internal guidance on s 77 confidentiality exceptions and the public interest disclosure power in s 77(3).
• Clarify delegation and operational decision‑making:
  • Use s 31 to delegate operational functions to staff while ensuring delegations are recorded in instruments and that the power to delegate is not itself delegated. Maintain robust records of delegation instruments.
• Publish guidelines and educational materials:
  • Exercise s 20(1)(f) to publish guidelines that clarify how the inspectorate approaches complaints, referrals, confidentiality, and public‑interest disclosures, thereby reducing uncertainty for stakeholders.

For legal advisers and compliance professionals

• Check regulatory instruments and guidelines:
  • Monitor regulations made under s 79, especially those prescribing workplace entitlements matters (s 79(1)(a)) and classes of public construction (s 79(1)(ab)). Guidelines issued under s 20(1)(f) will be operationally important.
• Map the relationship between employment law remedies and the reprisal offence:
  • Advise clients that s 69A excludes certain employment‑related actions, so offending conduct that is framed as a disciplinary action may nonetheless attract liability if it crosses into the "detriment" territory outside the exclusion list. Draft documentation for disciplinary processes to provide contemporaneous evidence of lawful grounds.
• Prepare for inter‑agency cooperation and information sharing:
  • When representing a government agency asked for information under s 71, counsel should identify statutory barriers to disclosure, preserve privilege where appropriate and negotiate scope and timelines with the inspectorate.

Cross‑cutting practical measures

• Logging and documentation:
  • Maintain a central log for all contacts with the inspectorate, including dates of receipt and provision of information, internal approvals for disclosure, and records of steps taken to avoid detriment. The logs will be valuable in the event of later enforcement action or litigation.
• Training and communication:
  • Deliver targeted training to front‑line managers on the effects of s 69A and s 70 and on the confidentiality regime in s 77. Communicate to staff that reprisals against persons who complain to the inspectorate are criminalised.
• Crisis response planning:
  • For organisations working in public construction or with a high volume of workplace complaints, develop a crisis plan that includes legal counsel engagement, media management and a coordinated response to inspectorate referrals.

For unions, advocates and complainants

• Preserve evidence and seek advice:
  • Persons intending to make complaints should preserve contemporaneous records that evidence the complaint and any subsequent adverse actions, in order to establish the causal link required under s 69A if they allege detriment.
• Use inspectorate guidance and education services:
  • The inspectorate’s function to inform and assist workers (s 20(1)(a) and (ha)) is an express avenue for obtaining advice. Complainants should use published guidelines to understand expectations for confidentiality and disclosure.

For those subject to transitional regulations

• Review whether transitional regulations were made under s 83 and their timing:
  • Transitional regulations can have retrospective operation to the day of Royal Assent of the Wage Theft Amendment Act 2025 and are subject to a two‑year sunset. Entities should confirm whether transitional regulations apply to their conduct and obtain legal advice regarding any retrospective effect.

These compliance steps are determined by the statutory provisions cited. They are practical, front‑line measures for organisations and advisers to reduce legal and operational risk under the current text of the Act.
