58 Claim against arbitration award
(1) This section applies if a worker is paid an amount of compensation
on arbitration.
(2) The worker’s lawyer or the lawyer’s agent may claim costs in relation
to the arbitration, or claim a lien in relation to the costs, from the
compensation only if, on application by the worker, lawyer or agent,
the Magistrates Court or committee awards the lawyer or agent the
costs.
(3) Costs to be awarded to the lawyer or the lawyer’s agent—
(a) are payable at 2/3 of the scale of costs prescribed by the rules
applying to a civil proceeding in the Supreme Court, unless the
Magistrates Court or committee otherwise orders; and
(b) must be taxed.
