What it does
This Order sets the numerical values to be used under specified indexation provisions of the Workers Compensation Act 1987 (the Act). It does not itself create entitlements or policy; it supplies the arithmetic constants and dollar amounts that entities and decision makers must apply when carrying out indexation duties imposed by the Act. The Order:
- fixes the multiplicative factors to be used for varying weekly payments on particular review dates under section 82A(4) of the Act (clause 4);
- fixes the dollar amounts that are to apply for particular financial years under section 82B(2) of the Act (clause 5);
- fixes specified amounts for the compensation amount for workers with highest needs for particular review dates under section 82BA(3) of the Act (clause 6);
- fixes the variable amounts to be used for permanent impairment compensation under section 82F of the Act, by reference to the percentage impairment bands in section 66(2) of the Act for specified financial years (clause 7).
Mechanically, the Order operates by reference. Each clause begins with a cross-reference stating that "for the purposes of" a specified subsection of the Act, a particular numerical value or set of values "is" the one that applies. The Order comes into force on the day it is published on the NSW legislation website (clause 2). Definitions in the Order are limited: the Order defines the shorthand "the Act" to mean the Workers Compensation Act 1987 (clause 3(1)), and expressly states that notes in the Order do not form part of it (clause 3(2)).
The Order is an instrument of specification not a stand-alone regulatory code. It supplies numbers, and the Act supplies the legal mechanism that requires those numbers to be used. For example, clause 4 supplies the factor values to be used under s 82A(4); clause 5 supplies the dollar amounts that s 82B(2) says are to apply for designated financial years; clause 6 supplies the amounts for s 82BA(3) review dates; clause 7 supplies the "variable amount" figures used under s 82F and Division 6B of Part 3 of the Act. The Order also contains amendment notes indicating that its figures have been updated over time (see endnotes to clauses).
for the purposes of the variation of a weekly payment on the review date specified in Column 1 of the Table to this clause is the number specified in Column 2 of that Table opposite that date.
