sec.138 Review by panel
After considering the application and reviewing the insurer’s decision, the panel must decide to— confirm the decision; or cancel the decision and substitute a new decision. The panel must give the worker and the insurer written notice of its decision and the reasons for its decision. If the panel decides to substitute a new decision, the new decision is taken to be the insurer’s decision that the qualifying condition is satisfied for the worker. To remove any doubt, it is declared that the panel may review the insurer’s decision without receiving oral submissions. (sec.138-ssec.1) After considering the application and reviewing the insurer’s decision, the panel must decide to— confirm the decision; or cancel the decision and substitute a new decision. (sec.138-ssec.2) The panel must give the worker and the insurer written notice of its decision and the reasons for its decision. (sec.138-ssec.3) If the panel decides to substitute a new decision, the new decision is taken to be the insurer’s decision that the qualifying condition is satisfied for the worker. (sec.138-ssec.4) To remove any doubt, it is declared that the panel may review the insurer’s decision without receiving oral submissions.
