5D Operation of 1998 amending Act
> > (1) Definition In this clause, the 1998 amending Act means the [Workers Compensation Legislation Amendment Act 1998](/view/pdf/asmade/act-1998-85).
>
> > (2) The amendments made to section 38 of this Act by the [Workers Compensation Legislation Amendment Act 1998](/view/pdf/asmade/act-1998-85) do not apply to a worker in respect of any period of incapacity after the commencement of those amendments that results from an injury before that commencement if the worker was in receipt of compensation in accordance with that section before that commencement for any period of incapacity resulting from that injury.

> > (3) Reducing s 40 benefit where suitable employment refused Subsections (2A) and (2B) of section 40, as inserted by the 1998 amending Act, apply to any period of incapacity for work (and to any unreasonable rejection of suitable employment) occurring after (but not before) the commencement of those subsections (whether the incapacity results from an injury received before or after that commencement).
