#### 47 Incapacity deemed to exist in certain cases 47 Incapacity deemed to exist in certain cases (cf former s 12A) > A worker who, as a result of injury, is unable without substantial risk of further injury to engage in employment of a certain kind because of the nature of that employment shall be deemed to be incapacitated for employment of that kind.
