#### 19 Presumptions relating to certain employment 19 Presumptions relating to certain employment (cf former s 7 (4D), (4E)) > > (1) If a worker, during a time when the worker is engaged in employment of a kind prescribed by the regulations as an employment to which this subsection applies, contracts a disease prescribed by the regulations as a disease that is related to employment of that kind, then for the purposes of this Act, unless the contrary is established— > > > > > (a) the disease shall be deemed to have been contracted by the worker in the course of the employment in which the worker was so engaged, and > > > > > (b) that employment shall be deemed to have been a substantial contributing factor to the disease. > > > (2) For the purposes of this Act, the disease brucellosis, Q fever or leptospirosis shall be deemed to have been contracted by a worker if the result of any medical test— > > > > > (a) which complies with such requirements as are prescribed by the regulations in relation to that disease, and > > > > > (b) which was carried out for the purpose of determining whether that worker has contracted that disease, > > > > is a result prescribed by the regulations in respect of that disease. > > **s 19:** Am 1996 No 120, Sch 1.2 \[9\].
