#### 12 Claims by trade union representatives 12 Claims by trade union representatives (cf former s 7 (1) (h)) > If— > > > (a) a worker is an accredited representative of a trade union of employees, or other organisation of employees, of which any person employed by the worker’s employer is a member, > > > (b) with the consent of or at the request of that employer or pursuant to an industrial award or agreement, the worker is carrying out his or her duties as such a representative (whether at the worker’s place of employment or elsewhere) or is on an associated journey, and > > > (c) the worker receives a personal injury while carrying out those duties or on that journey, > > the injury is, for the purposes of this Act, an injury arising out of or in the course of employment, and compensation is payable accordingly.
