36D Determination of Territory or State of connection by
Magistrates Court
(1) If a claim for compensation under this Act has been made, a party to
the claim may apply to the Magistrates Court for a determination of
the question of which Territory or State is the Territory or State of
connection.
(2) The Magistrates Court must determine the Territory or State of
connection in accordance with section 36B (Employment connection
test).
(3) However, an application may not be made or heard if there is a
determination of the Territory or State of connection that is to be
recognised under section 36E.
