182C Meaning of damages claim
(1) For this part, damages claim means a claim for damages in relation
to a work-related injury to a worker caused, or claimed to have been
caused by—
(a) the negligence or other tort of the employer or a person for
whose acts the employer is vicariously liable; or
(b) a breach of contract by the employer.
(2) Also, damages claim includes a claim for damages in relation to an
injury caused, or claimed to have been caused, by negligence or
another tort even if the damages are claimed in an action for breach
of contract or other action.
