163 Employment after 2nd offence
(1) For this section, an employer has been convicted of an offence if the
employer has been convicted of a 2nd or subsequent offence against
any of the following sections:
• section 147A (Compulsory insurance—offences)
• section 155 (Information for licensed insurers on application for
issue or renewal of policies)
• section 156 (Information for licensed insurers after renewal of
policies)
• section 157 (Information for licensed insurers after end or
cancellation of policies)
• section 158 (Information for new licensed insurers after change
of insurers)
• section 203 (Criminal liability of executive officers).
(2) Subsection (1) only applies to an offence against section 203 if the
offence relates to the contravention by a corporation of another
section mentioned in subsection (1).
(3) An employer who has been convicted of an offence within the last
5 years must not employ a territory worker.
Maximum penalty: imprisonment for 5 years.
