Worker Screening Regulations 2021

The Regulations are concentrated around a small set of regulatory building blocks. Below are the key concepts as the instrument defines or uses them and how they function.

• Fee unit pricing and the fee Table (reg 6 and Endnotes). The Regulations do not fix fixed dollar amounts. Instead they specify fees in fee units. The relevant Table lists four application types (NDIS check under s 15 of the Act; WWC checks under s 54 for child‑related work for profit or gain, including a lower fee where s 74 applies; and replacement of a WWC clearance document) and the corresponding number of fee units (for example, item 1: 8.06 fee units). The Endnotes explain conversion to dollars using the Monetary Units Act 2004 and publish the fee unit and penalty unit values for the financial year commencing 1 July 2025 (fee unit $16.81; penalty unit $203.51). The Regulations make the Treasurer’s future fixing of fee unit values binding practice by reference.

• Social Services Regulator discretion on fees (reg 7). The Regulator may reduce, waive or refund a prescribed fee either before or after an application is made. That is a unilateral administrative power to alter applicant costs after the fact.

• "Personal particulars" (reg 5). The Regulations define what must be notified: full name and any other names, date of birth, residential address, electronic address, and any telephone number provided in relation to the application or clearance. The date by which persons must notify is 21 days from becoming aware of the change (reg 12).

• Prescribed disciplinary or regulatory entities (reg 8) and prescribed relevant findings (reg 9). The Regulations list entities (for example the Commission for Children and Young People, the NDIS Commissioner, VCAT, the Victorian Institute of Teaching, a variety of panels and regulatory authorities, the Social Services Regulator itself and others) which the Act will treat as disciplinary or regulatory entities for the statutory provisions cited (reg 8). Reg 9 then maps specific decisions, orders, prohibitions, interim exclusions and findings made by those entities (for example, prohibition notices under the Education and Care Services National Law (Victoria), suspension or cancellation decisions by a hearing panel under the Education and Training Reform Act 2006, orders by the NDIS Commissioner under s 73ZN of the NDIS Act) to being "relevant disciplinary or regulatory findings" for specified sections of the Worker Screening Act 2020. The Regulations therefore create a channel through which adverse administrative outcomes in other regimes feed into screening outcomes under the Act.

• Corresponding NDIS worker screening laws (reg 10). The instrument lists a set of State and Territory Acts that will be treated as corresponding NDIS worker-screening laws for the Worker Screening Act, such as the National Disability Insurance Scheme (Worker Checks) Act 2018 (NSW) and the Disability Inclusion Act 2018 (SA). This concept supports recognition or cross‑jurisdictional integration.

• Revocation and sunset (reg 4; Endnotes). The Regulations revoke specified earlier subordinate instruments (Working with Children Regulations 2016 and its Reportable Conduct Amendment 2017). The Endnotes further state the Statutory Rule will sunset ten years after making (27 January 2031), per the Subordinate Legislation Act 1994.

• Cross‑references to the Act. The Regulations repeatedly implement or supply particulars for the Worker Screening Act 2020, citing the exact Act sections the prescribed entities, findings or persons relate to (for example reg 8 lists which sections of the Act the prescription applies to).

Mechanically, therefore, the Regulations operate by: (1) quantifying costs of specified applications via fee units; (2) creating a discrete duty to notify change; (3) building a list of external administrative outcomes that the Act will treat as relevant; and (4) providing an administrative power to the Social Services Regulator to refund or waive fees.

This instrument assigns direct obligations and costs to a well‑defined set of people and institutions, and indirect operational consequences to others.

Directly affected persons and entities

• Applicants for screening checks as defined in the Worker Screening Act 2020. The Table in reg 6 identifies applicants for NDIS checks and applicants for WWC checks for child‑related work that is for profit or gain. These applicants face the prescribed fee expressed in fee units unless the Social Services Regulator exercises its power to reduce, waive or refund (reg 6; reg 7).

• Persons holding a clearance under the Act. Holders of clearances must notify the Social Services Regulator of any change to "personal particulars" within 21 days of becoming aware of the change (reg 12(2)). The obligation on holders is separate from the obligation on applicants (reg 12(1)) and both carry a penalty.

• Applicants with pending applications. Persons whose application is still pending are required to notify the Regulator of changes to their personal particulars within 21 days of becoming aware of the change (reg 12(1)). This creates an ongoing obligation during the application processing period.

• The Social Services Regulator. The Regulator gains a discretion to reduce, waive or refund fees relating to the specified applications and it is the recipient of notification duties (reg 7; reg 12). The Regulator is also prescribed as a disciplinary or regulatory entity in reg 8(m), meaning its own exclusion or disciplinary decisions may feed into the Act’s screening outcomes under the sections cited in reg 8.

• Prescribed disciplinary or regulatory entities. Bodies that make the sorts of determinations listed in reg 9 are affected in the sense that their decisions are imported into the screening regime. These include statutory agencies and decision makers such as the Commission for Children and Young People, Victorian Disability Worker Commissioner and Commission, the Victorian Institute of Teaching, the NDIS Commissioner, Regulatory Authorities under the Education and Care Services National Law (Victoria), VCAT, various Hearing, Health, WCES and Suitability Panels (reg 8).

Indirectly affected persons and institutions

• Employers and service providers engaging people in risk assessed roles for children or NDIS services. The Regulations change what administrative findings and notices can be relied upon by the Social Services Regulator when making screening decisions under the Worker Screening Act 2020 (reg 8 and reg 9). Employers will need to track adverse administrative actions taken by the prescribed entities because those actions are mapped into the screening regime.

• Applicants and holders who have had disciplinary action taken in other systems. Decisions such as prohibition notices, interim exclusions, suspensions, cancellations or other orders by the prescribed entities in reg 9 are explicitly specified as "relevant disciplinary or regulatory findings" for enumerated sections of the Act. Individuals with such findings should expect those outcomes to be treated as inputs to screening decisions.

• Persons and organisations operating across jurisdictions. The listing of corresponding NDIS worker screening laws (reg 10) is intended to create cross‑jurisdiction recognition. The Regulations therefore affect interstate mobility and the treatment of out‑of‑jurisdiction screening outcomes for NDIS work.

• Users of the former Working with Children regulatory framework. The revocation of the Working with Children Regulations 2016 (reg 4(a)) and its 2017 amendment (reg 4(b)) shifts the regulatory footing for WWC checks into this framework and into the updated definitions and lists in regs 6-9.

Who does not gain new duties here

• The Regulations do not create new criminal offences beyond the penalty in reg 12 for failure to notify personal particulars. They implement how the Act will treat specified external findings and how fees work. Substantive screening offences and other enforcement mechanisms remain in the Act itself.

In short, the Regulations reallocate compliance tasks and monitoring obligations onto applicants, clearance holders, the Social Services Regulator and interconnected disciplinary bodies, and embed cross‑jurisdictional recognition for NDIS screening laws.

The Regulations impose a small number of concrete duties, prescribe administrative discretions and embed rights and triggers via the prescription of other agencies' decisions.

Key duties

• Fee payment where applicable. Applicants for the classes of applications in reg 6 must pay the prescribed fee expressed in fee units unless a waiver, reduction or refund is granted (reg 6; reg 7). The Regulations do not specify procedural forms for payment but establish the fee quantum in fee units for the application types listed.

• Notification of changes to personal particulars. Two separate duties require notification within 21 days of becoming aware of the change: (1) applicants with pending applications must notify the Social Services Regulator of any change to their personal particulars (reg 12(1)); (2) holders of clearances must likewise notify within 21 days of becoming aware of a change (reg 12(2)). The definition of "personal particulars" is set out in reg 5 and includes name(s), date of birth, residential address, electronic address and telephone number provided for the application or clearance.

• Duty to be aware of prescribed external outcomes. While not phrased as a statutory duty on individuals, the Regulations make it operationally necessary for applicants, employers and holders to be aware of decisions by the entities listed in reg 8 and findings listed in reg 9, because those findings feed into the Worker Screening Act 2020 (see the list of Act sections referenced in reg 8 and reg 9). This produces an indirect compliance obligation to track relevant administrative findings in adjacent regulatory systems.

Administrative rights and discretions

• Discretion to reduce, waive or refund fees (reg 7). The Social Services Regulator may reduce or waive the fee set in reg 6, or refund payment in whole or in part, at any time before or after the application is made. That discretion is broad in time and scope and operationally functions as an entitlement that applicants can seek but not compel.

• Rights arising from prescribed external findings. The Regulations do not create positive rights such as appeals; however the prescription of VCAT and tribunal panels as disciplinary entities (reg 8) recognises tribunal determinations within the screening framework. Where reg 9 lists VCAT orders or panel determinations, those outcomes will be taken into account under the Act’s specified sections. Any appeal or review rights arising from those bodies remain those bodies’ own procedures.

• Predictability via definition. The Regulations define the scope of "personal particulars" and list explicitly the types of findings to be treated as relevant. That is a rights‑enhancing clarity element, as interested parties can identify which external outcomes will be imported into the screening determination process.

Triggers and consequences

• The Regulations identify which external actions are triggers by mapping them to specific sections of the Act that deal with screening outcomes (reg 8 refers to sections 15(2)(b) and (c), 18(2)(a), 21(3)(f), 40(1)(a), 54(2)(b) and (c), 58(2)(a), 81(1)(a), 97(2)(b)(ii), 104(b) and 109(b) of the Act). Reg 9 prescribes findings that will be treated as relevant under specified sections of the Act (for example, reg 9(a) prescribes determinations by a Hearing Panel under s 2.6.46(2) of the Education and Training Reform Act 2006 as relevant). The Regulations thus translate specified external administrative outcomes into operational inputs for the Act’s individual screening decisions.

Limitations and procedural elements not in the Regulations

• The Regulations do not set out how the Regulator must exercise its fee discretion, what criteria will be used to reduce or waive a fee, or procedural steps for refunds. This discretion is therefore administratively broad and governed by the Regulator’s practices or policy rather than statutory procedural constraints in the Regulations.

• The Regulations do not set out appeal rights in relation to the notification penalty or fee determinations. Any appeal mechanisms would be found in the Act or in the other statutory instruments governing the prescribed entities.

In sum, the instrument creates clear individual responsibilities to pay fees (subject to waiver) and to notify change of particular identity details, and it converts certain external regulatory outcomes into statutory triggers for screening outcomes through explicit prescription.

The Regulations impose a narrow set of penalties and rely principally on the Act and the listed external agencies for enforcement of substantive screening outcomes. The enforcement architecture in the Regulations is limited and specific.

Penalty for failure to notify personal particulars

• Reg 12 prescribes criminal penalties for failure to notify changes to personal particulars: both applicants with a pending application (reg 12(1)) and holders of a clearance (reg 12(2)) must notify the Social Services Regulator of any change to personal particulars within 21 days of becoming aware of the change. Each breach carries a penalty of 1 penalty unit (reg 12(1) and (2)).

• The Endnotes provide the monetary conversion for a penalty unit for the financial year commencing 1 July 2025 as $203.51 (Endnotes: Penalty Units). The Regulations also explain that the calculation of penalty amounts follows s 7 of the Monetary Units Act 2004 and that the value of a penalty unit for future years is to be fixed by the Treasurer (Endnotes).

Enforcement mechanisms in relation to screening findings

• The Regulations import external administrative decisions and orders as "relevant disciplinary or regulatory findings" (reg 9). The manner in which those findings produce enforcement consequences is governed by the Worker Screening Act 2020 itself via the Act sections cross‑referenced in reg 8 and reg 9. The Regulations do not themselves provide a separate enforcement process for those findings; they create a recognition mechanism so that outcomes such as prohibition notices, suspensions, interim exclusions and VCAT orders are treated as inputs to the Act’s decision-making.

• The Social Services Regulator is given administrative discretion over fees (reg 7) rather than a sanctioning power. The Regulator’s power to refuse or grant waivers or refunds is an administrative tool that can affect applicants’ costs, but the Regulations do not set statutory criteria for exercise of that discretion.

Interaction with other enforcement regimes

• Because the Regulations explicitly include orders and notices from other statutory frameworks (for example, prohibition notices under the Education and Care Services National Law (Victoria), interim exclusions under the Social Services Regulation Act 2021, orders by the NDIS Commissioner under the NDIS Act), enforcement will, in many cases, be dual: an individual may face action in the originating agency and then, separately, have that decision treated as relevant in the screening regime under the Worker Screening Act 2020 as a result of the Regulations’ prescriptions (reg 9).

• VCAT decisions and other tribunal orders are included (reg 9(r) and (s)), so tribunal findings and orders will be imported into the screening apparatus for the statutorily cited sections of the Act.

Limitations and procedural gaps

• The Regulations do not specify investigative powers, penalty schedules beyond the single penalty unit offences, or administrative review processes for decisions the Social Services Regulator makes in respect of fees or notification penalties. Those processes must therefore be found in the Act or in the procedural law governing the Regulator.

• The Regulations do not specify how notification failures will be discovered or investigated. Enforcement will depend on the Regulator’s detection processes and any information-sharing mechanisms with the prescribed entities, which are not elaborated here.

To conclude, the Regulations impose one specific criminal sanction (1 penalty unit) for failure to notify personal particulars within 21 days, and otherwise function to import external enforcement outcomes into the Act’s screening decisionmaking without creating separate multi‑tiered enforcement mechanisms.

The Regulations operate mainly as a cross‑referencing and recognising instrument. They weave together the Worker Screening Act 2020 with a range of other statutory regimes and with the monetary and sentencing architecture for fee and penalty conversion.

Direct statutory cross‑references

• Worker Screening Act 2020. The Regulations are made under s 150 of the Act (reg 2). Many prescriptions in regs 8 and 9 are expressly for the purposes of specific sections of the Act. For example, reg 8 prescribes disciplinary or regulatory entities "for the purposes of sections 15(2)(b) and (c), 18(2)(a), 21(3)(f), 40(1)(a), 54(2)(b) and (c), 58(2)(a), 81(1)(a), 97(2)(b)(ii), 104(b) and 109(b) of the Act." Reg 9 prescribes what constitutes a "relevant disciplinary or regulatory finding" for a list of sections in the Act (for example sections 27(1)(e), 34(2)(e), etc.). The Regulations therefore function as the statutory conduit that brings specified findings, prohibitions and orders from other regimes into the Worker Screening Act’s decision framework.

• Education and Training Reform Act 2006; Education and Care Services National Law (Victoria); Children’s Services Act 1996; Child Wellbeing and Safety Act 2005; Disability Service Safeguards Act 2018; Social Services Regulation Act 2021; NDIS Act; Disability Services Act 2006 (Qld). Reg 9 lists specific types of findings and the provisions under other statutes under which they are made, such as determinations by a Hearing Panel under s 2.6.46(2) of the Education and Training Reform Act 2006 (reg 9(a)), a prohibition notice under s 182(1) of the Education and Care Services National Law (Victoria) (reg 9(i)), and orders by the NDIS Commissioner under s 73ZN of the NDIS Act (reg 9(e)). That mapping means decisions made under those statutes are to be treated as relevant findings under the Worker Screening Act where the Act’s sections referenced in reg 8 apply.

Monetary and sentencing acts

• Monetary Units Act 2004. Fees are expressed in fee units and the Endnotes explain conversion (Endnotes: Fee Units). The Regulations rely on the Monetary Units Act 2004 for calculation and rounding rules.

• Sentencing Act 1991. Penalties are expressed in penalty units and conversion to dollars follows the Sentencing Act framework as explained in the Endnotes (Endnotes: Penalty Units).

Cross‑jurisdictional recognition

• Reg 10 prescribes a set of State and Territory Acts as "corresponding NDIS worker screening laws" (for example National Disability Insurance Scheme (Worker Checks) Act 2018 (NSW), Disability Inclusion Act 2018 (SA), Registration to Work with Vulnerable People Act 2013 (Tas), etc.). By prescribing these Acts as corresponding laws the Regulations enable the Worker Screening Act’s cross‑jurisdictional interaction for NDIS worker screening. Reg 11 has been revoked by a later amendment, which is recorded in the Endnotes. The practical effect is to define which interstate/territory screening regimes the Act regards as comparable or mutually relevant.

Revocation and replacement of subordinate instruments

• Reg 4 revokes the Working with Children Regulations 2016 and its 2017 amendment (reg 4(a) and (b)). This transfers the practical regulatory footing for WWC checks into the current instrument and its amendments, aligning the WWC prescription with the Worker Screening Act’s machinery.

Operational interdependence and potential fragility

• The Regulations’ importation strategy makes the Worker Screening Act’s operation dependent on other statutory regimes’ decision‑making frameworks and potential future legislative changes to those regimes. For example, if the Education and Care Services National Law (Victoria) alters the content or numbering of its prohibition notice provisions, the mapping in reg 9 may need updating to preserve the same cross‑reference. The Regulations do not contain transitional or saving provisions for such future changes; they instead set the current mapping and rely on amendment when necessary (see Table of Amendments in Endnotes).

• The list of prescribed entities includes bodies created by other Acts (for example the Victorian Disability Worker Commissioner established by the Disability Service Safeguards Act 2018) so amendments to those other Acts may change institutional names, powers or procedures relevant to how those findings arise and are recognised in the screening regime.

In short, the Regulations function as an integrative layer that imports, recognises and connects decisions from multiple statutory regimes into the Worker Screening Act, and they rely on the Monetary Units Act and the Sentencing Act for the numerical mechanics of fees and penalties.

The Regulations were made on 27 January 2021 (Endnotes) and commenced on 1 February 2021 (reg 3). The Endnotes set out the amendment instruments and their dates. Key amendments and their effects are summarised below with the sources identified in the Regulations and Endnotes.

Primary instrument

• Worker Screening Regulations 2021, S.R. No. 2/2021, made 27 January 2021, commenced 1 February 2021 (reg 3; Endnotes 1). The Regulations were made under s 150 of the Worker Screening Act 2020 (reg 2).

Subsequent amendments recorded in the Endnotes

1. Worker Screening Amendment (Risk of Harm to Children) Regulations 2025, S.R. No. 71/2025

• Date of making: 29 July 2025.

• Date of commencement: 29 July 2025.

• Effect: A number of textual insertions and substitutions were made by S.R. No. 71/2025. The text annotates many definitions and substitutions as "inserted by S.R. No. 71/2025" or "substituted by S.R. No. 71/2025". Notable changes include substitutions for reg 8 and reg 9 to broaden and clarify the list of disciplinary/regulatory entities and relevant findings, and multiple new definitions (for example Australian Children's Education and Care Quality Authority, Disability Worker Registration Board of Victoria, Health Panel, WCES Panel, Victorian Disability Worker Commission, etc.) were inserted in reg 5 as part of the SR71/2025 amendments (see annotations at reg 5 and reg 8/reg 9).

2. Worker Screening Amendment Regulations 2026, S.R. No. 3/2026

• Date of making: 3 February 2026.

• Staggered commencements recorded in the Table of Amendments: regs 5, 6, 9 and 10 commenced on 9 February 2026; reg 7 on 23 February 2026; reg 8 on 27 February 2026 (Endnotes, Table of Amendments).

• Effect: The SR3/2026 instrument made multiple technical amendments across definitions and substantive provisions. The text annotates certain rules as "amended by S.R. No. 3/2026" including reg 1(b), reg 7 heading, reg 7 substantive, reg 9 paragraphs (s, t and others), and revocation of reg 11 (reg 11 revoked by SR3/2026 reg 9). These amendments adjust the lists of prescribed findings, refine definitions such as Suitability Panel and Victorian Institute of Teaching, and rearrange certain provisions.

Other notes from the Endnotes

• The Endnotes state that the Regulations will sunset 10 years after the day of making, on 27 January 2031, under the Subordinate Legislation Act 1994 (Endnotes 1).

• The Endnotes also contain interpretative statements about the legal status of headings, examples and punctuation (Interpretation of Legislation Act 1984 references), and provide the fee unit and penalty unit amounts for the financial year commencing 1 July 2025 (fee unit $16.81; penalty unit $203.51) as well as the statutory basis for those conversions (Monetary Units Act 2004; Sentencing Act 1991).

Practical implication of the amendment history

• The 2025 and 2026 amendments substantially expanded and clarified the list of prescribed disciplinary entities and relevant findings, and updated definitional cross‑references to other bodies created or continued under recently amended Acts. The staggered commencement dates for the 2026 amendments mean practitioners must check which sub‑provisions became operative on which dates. The Endnotes’ Table of Amendments should be consulted for exact commencement dates and instrument numbers.

• Reg 11 (as originally numbered) was revoked by SR3/2026 (Endnotes). Practitioners should therefore check the current text to confirm which schedules remain operative; the Endnotes identify the amendment sources that gave rise to the current text.

This is a statutory instrument with multiple later technical amendments that expanded the scope and the list of external findings the Act will treat as relevant. The Endnotes and the amendment table in the published statutory rule should be inspected to confirm the precise text operative at any point in time.

The Regulations themselves do not include any reported litigation or case law in their text or Endnotes. The instrument lists no court decisions, no judicial interpretations, and no references to litigation outcomes. The Endnotes and the body of the Regulations focus on the construction and content of the statutory rule, its amendments and technical explanatory details.

Implications for practitioners

• Absence of reported decisions in the Regulations means there is no line of authority in the instrument itself to assist interpretation of how the Social Services Regulator will exercise discretion under reg 7 or how reg 9’s mapping will be applied in particular fact patterns. Questions about the Regulator’s exercise of discretion, the operation of the notification duty (reg 12), or the consequences of prescribed findings will therefore be resolved in practice either by decisions under the Worker Screening Act 2020 or by judicial review or appeal in the courts or tribunals. Those decisions are not recorded here.

• Reg 9 imports decisions by tribunals and statutory bodies (for example VCAT orders and decisions by Hearing Panels). Those bodies themselves have review and appeal pathways, but any litigation concerning the application of their decisions as inputs to the Worker Screening Act would appear in the judicial record outside these Regulations.

If litigation or administrative review of the Regulations’ operation arises, the record will be in case law, tribunal files or administrative determinations rather than in the Regulations. Practitioners should check the Worker Screening Act 2020 case law and administrative decisions of the Social Services Regulator for any emerging interpretive authorities.

The Regulations are short and tightly focused but contain several practical traps or latent sources of uncertainty that practitioners and compliance officers should be aware of.

1. Fee units, dollar conversions and rounding

• Fees are expressed only in fee units (reg 6) and the Endnotes set out the fee unit value for 2025-26 as $16.81 with instructions for multiplication under the Monetary Units Act 2004. The amount may be rounded to the nearest 10 cents (Endnotes). Practitioners should therefore calculate fees using the current fee unit value published by the Treasurer rather than relying on static dollar figures. For example, item 1 (8.06 fee units) corresponds to 8.06 × $16.81 = $135.4886 before rounding. Whether that is shown as $135.49 or $135.50 will depend on the prescribed rounding rules and Treasurer’s publication for the relevant financial year.

2. Fee waivers can be applied retroactively

• The Social Services Regulator may reduce, waive or refund fees either before or after an application is made (reg 7). Therefore an applicant who pays a fee should not assume that payment settles the matter; the Regulator may later refund. Likewise, an applicant may seek a waiver after submission rather than only prior to applying. That creates administrative uncertainty for cash flow and cost forecasting for providers or applicants.

3. Timing of notification obligations

• The duty to notify a change of personal particulars is tied to "becoming aware of the change" with a 21‑day time limit (reg 12). This wording can generate disputes about when a person is deemed to have "become aware," particularly for electronic address changes where automated forwarding, address histories or agent‑handled communications are involved.

4. The offences have statutory unit values that change

• The penalty for breaching reg 12 is expressed in penalty units. The monetary amount will therefore change year to year as penalty unit values are updated by the Treasurer (Endnotes). Practitioners must monitor penalty unit values so they know the current financial exposure.

5. Mapping to other statutory regimes is static until amended

• Reg 9 maps specific orders, findings and notices in other statutes to be "relevant disciplinary or regulatory findings." If the other statutes’ section numbers or mechanisms change, the mapping may become obsolete until amended. The Regulations do not themselves provide a dynamic cross‑reference mechanism. Practitioners should monitor legislative changes in the other Acts listed to anticipate whether the mapping will need updating.

6. Wide range of prescribed entities

• The list of disciplinary or regulatory entities in reg 8 is broad and includes the Social Services Regulator itself. This can produce overlapping or cascade effects where an entity’s own interim exclusions can be fed back into screening decisions under the Act. Employers must remain vigilant for interim exclusions and prohibition notices coming not only from familiar education or disability regulators but also from panels and tribunals included in the list.

7. "Personal particulars" includes electronic address and telephone number provided in relation to the application

• The definition in reg 5 means mobile numbers or email addresses supplied in an application become in-scope personal particulars. Automatic changes, such as a person migrating to a different email provider or changing a phone number, trigger the 21‑day duty. Failure to notify could attract penalty‑unit exposure.

8. Revocation of earlier regulations

• The Regulations revoke the Working with Children Regulations 2016 (reg 4). Transitional consequences from that revocation are not set out in the text. Practitioners relying on the old subordinate instrument should check whether any transitional provisions were included elsewhere or whether case‑by‑case transitional relief is needed.

9. Reg 10 and reg 11 status

• Reg 10 prescribes corresponding NDIS worker screening laws for the purposes of the Act, but reg 11 is revoked (Endnotes), suggesting that the prior structure or numbering changed. Practitioners should not assume continuity in numbering and must rely on the currently consolidated text.

10. Limited procedural safeguards in the Regulations

• The Regulations provide discretion to the Regulator (reg 7) but do not set out procedural constraints or review routes for applicants aggrieved by fee decisions. The absence of procedural detail means applicants must rely on general administrative law protections or any processes in the Act or the Regulator’s policies.

These are concrete, documentable operational hazards that follow from the Regulations’ drafting and from its cross‑referencing strategy. They are the sorts of issues that will matter in day‑to‑day compliance and risk management.

Compliance with these Regulations is procedural and record‑keeping heavy. The primary compliance tasks are (1) correctly identifying the application type and fee; (2) preserving evidence around fee payment and any interaction with the Social Services Regulator on waivers or refunds; (3) keeping personal particulars current and documented; and (4) monitoring prescribed external bodies for findings that will be treated as relevant under the Worker Screening Act 2020.

Step‑by‑step checklist

1. Categorise the application

• Identify whether the person requires an NDIS check under s 15 of the Act, a WWC check under s 54 of the Act (child‑related work for profit or gain), an s 54 WWC check applied for in accordance with s 74 (lower fee), or a replacement WWC clearance document (reg 6, Table). This determines the fee quantum in fee units.

2. Calculate the fee in dollars for the relevant financial year

• Multiply the specified fee units by the fee unit value published by the Treasurer for the relevant financial year (Endnotes: Fee Units). Keep a dated record of the calculation and the Treasurer’s published fee unit value in case of later disputes. Note the rounding provision in the Endnotes (rounding to the nearest 10 cents) when generating the actual payable amount.

3. Consider and apply for a fee reduction, waiver or refund

• If cost relief is needed, apply to the Social Services Regulator for a reduction, waiver or refund. Because reg 7 allows waivers or refunds either before or after the application is made, retain written records of any submissions to the Regulator and any responses. If an applicant pays a fee and later seeks a refund, keep proof of payment to support the refund request.

4. Maintain and update personal particulars

• Implement an internal process to capture the personal particulars defined in reg 5: full name and any other names, date of birth, residential address, electronic address and telephone number provided in relation to the application or clearance. For applicants with pending applications, and for clearance holders, update the Regulator within 21 days of becoming aware of any change (reg 12(1) and (2)). Keep time‑stamped evidence of notification (email, portal receipt, postal tracking).

5. Track prescribed disciplinary or regulatory entities and findings

• For persons working in the sectors covered by the Act, monitor decisions and notices issued by entities listed in reg 8 and forms of findings listed in reg 9. If an individual has been subject to a finding or notice under another regime (for example, an interim exclusion under the Social Services Regulation Act 2021, a prohibition notice under the Education and Care Services National Law (Victoria), an order by the NDIS Commissioner under s 73ZN of the NDIS Act), treat it as potentially reportable and as an input to the Worker Screening Act’s processes.

6. Institutional record‑keeping and employer processes

• Employers and service providers should implement compliance checklists that require notification to the Social Services Regulator of any relevant changes in employees’ or contractors’ details and a process to react to any external findings against staff. Keep records of searches, dates and any communications with the Regulator.

7. Audit and training

• Carry out periodic audits to verify that employees and contractors have kept their personal particulars current and that fee payments are correctly calculated and documented. Train staff on the 21‑day notification requirement and on the list of external agencies whose actions are relevant to screening.

8. Watch for legislative and fee unit changes

• Monitor the Treasurer’s publications for updated fee unit and penalty unit values (Endnotes) and adjust calculations and communications accordingly. Monitor amendments to the Worker Screening Regulations, the Worker Screening Act 2020 and the other statutes listed in regs 8 and 9. Amend internal policies in response to any changes.

9. Maintain dispute and appeal documentation

• If there is disagreement about when a person "became aware" of a change in personal particulars, preserve contemporaneous records that show notice or lack thereof. Similarly, if a fee waiver or refund is denied, preserve correspondence to support any administrative review or judicial review application.

10. Cross‑jurisdictional considerations for NDIS workers

• If an individual has screening outcomes or clearances from another jurisdiction’s NDIS worker screening regime, check whether that jurisdiction’s Act is included in reg 10 as a corresponding NDIS law. If so, maintain evidence of the out‑of‑jurisdiction clearance and any applicable determinations to provide to the Regulator as needed.

Records and evidence to retain

• Proof of fee calculation and payment; copies of fee waiver or refund applications and Regulator responses; evidence of notifications under reg 12 with date/time; notes of monitoring of prescribed agencies and any findings; internal compliance audit records; and contemporaneous notes where a person’s awareness of a change to personal particulars might be in dispute.

Practical notes

• Because the Social Services Regulator’s fee discretion can be exercised after an application, applicants should promptly seek a waiver if they believe they qualify. Do not assume that payment will prevent later administrative relief.

• The 21‑day notification window is relatively short. Implement automated prompts in HR and contractor management systems to capture address, email and telephone number changes and to trigger notification to the Regulator within the statutory window.

Following the steps above will bring a person or organisation into conformity with the Regulations’ practical requirements. The Regulations are procedural rather than substantive; therefore compliance mainly requires administrative rigour, prompt notification and careful record‑keeping.
