19 Regulator must make enquiries of Secretary to the Department of Families, Fairness and Housing
S. 19(1) amended by No. 58/2025 s. 125(Sch. 2 item 1.24(a)).
(1) In considering an application for an NDIS check, the Regulator must—
S. 19(1)(a) amended by No. 58/2025 s. 125(Sch. 2 item 1.24).
(a) check information held by the Regulator as to whether the applicant was assessed by the Secretary to the Department of Families, Fairness and Housing as posing an unacceptable risk to persons with a disability or NDIS participants; and
S. 19(1)(b) amended by No. 58/2025 s. 125(Sch. 2 item 1.24(b)).
(b) if the applicant was so assessed, request the Secretary to the Department of Families, Fairness and Housing provide information relating to that assessment held by the Secretary to the Department of Families, Fairness and Housing.

(2) The Secretary to the Department of Families, Fairness and Housing must provide information requested under subsection (1)(b).
