176  Management of risks to health and safety  (1) A person conducting a business or undertaking at a workplace must manage risks to health and safety associated with general diving work, in accordance with Part 3.1.  (2) A person conducting a business or undertaking must ensure that a risk assessment is conducted by a competent person for subregulation (1). Note: Section 12F of the Act provides that strict liability applies to each physical element of each offence under the Act, unless otherwise stated. The reference in section 12F of the Act includes these Regulations.  (3) The person must ensure that a risk assessment conducted under subregulation (2) is recorded in writing.
