163  Duty of person conducting business or undertaking  (1) A person conducting a business or undertaking that includes the carrying out of construction work must comply with AS/NZS 3012:2019 (Electrical installations—Construction and demolition sites). Note: Section 12F of the Act provides that strict liability applies to each physical element of each offence under the Act, unless otherwise stated. The reference in section 12F of the Act includes these Regulations.  (2) For subregulation (1), AS/NZS 3012:2019 (Electrical installations—Construction and demolition sites) applies as if any term that is defined in that Standard and that is also defined in the Act or these Regulations has the same meaning as it has in the Act or these Regulations.  (3) If any requirement in AS/NZS 3012:2019 (Electrical installations—Construction and demolition sites) deals with the same matter as a requirement under this Part, it is sufficient that the person conducting the business or undertaking complies with the requirement in AS/NZS 3012:2019 as modified by subregulation (2).
