542 Determination in relation to over-threshold facility

542 Determination in relation to over-threshold facility

(1) This section applies if a notification under section 536 or 537 discloses that the quantity of Schedule 15 chemicals present or likely to be present at a facility, or a proposed facility, exceeds their threshold quantity.

(2) The regulator must make a determination confirming the facility, or the proposed facility, to be a major hazard facility.

Note—

A determination that a facility is a major hazard facility is a reviewable decision—see section 676.
