351 Management of risks to health or safety

351 Management of risks to health or safety

(1) A person conducting a business or undertaking must manage, in accordance with Part 3.1, risks to health and safety associated with using, handling, generating or storing a hazardous chemical at a workplace.

(2) In managing risks the person must have regard to the following—

(a) the hazardous properties of the hazardous chemical,

(b) a potentially hazardous chemical or physical reaction between the hazardous chemical and another substance or mixture, including a substance that may be generated by the reaction,

(c) the nature of the work to be carried out with the hazardous chemical,

(d) a structure, plant or system of work that—

(i) is used in the use, handling, generation or storage of the hazardous chemical, or

(ii) could interact with the hazardous chemical at the workplace.
