730 Duties of designers (1) If a designer commenced designing plant or a structure before (a) the new upstream duties imposed on a designer do not apply in relation to the designing of the plant or structure; and (b) the old upstream duties imposed on the designer in relation to the designing of the plant or structure continue to apply as if the old WHS Act had not been repealed. new upstream duties means the duties imposed under NUL regulations 59(1) and (2), 61(1) to (3), 64, 187 to 192 and 228 to 230. WHS regulations 9, 61 and 84, and clause 7 of the National Standard for Construction Work [NOHSC:1016 (2005)] as adopted by old WHS regulation 133A, immediately before 1 January 2012. (3) This regulation expires on 1 January 2015.
