286Work groups

286 Work groups (1) If a work group exists under Part 4, Division 2 of the old WHS Act immediately before commencement, on commencement the group becomes: (a) for a 1-business group – a work group under Part 5, Division 3, Subdivision 2 of this Act; or (b) for a multi-business group – a work group under Part 5, Division 3, Subdivision 3 of this Act. (2) If an agreement about the formation of a workgroup was in force under section 34(3) of the old WHS Act immediately before commencement, on commencement it becomes: (a) for a 1-business group – an agreement for section 52(1) of this Act; or (b) for a multi-business group – an agreement for section 55(2) of this Act. (3) However, if any part of what has been agreed does not comply with Work Health and Safety (National Uniform Legislation) Act 2011 147 1-business group means a work group consists of workers carrying out work for one person conducting a business or multi-business group means a work group consists of workers carrying out work for 2 or more persons conducting businesses or undertakings.
