107 Prohibition of requesting, instructing, inducing,
encouraging, authorising or assisting discriminatory
(1) A person must not request, instruct, induce, encourage, authorise or
assist another person to engage in discriminatory conduct in
contravention of section 104 (Prohibition of discriminatory conduct).
Note A civil proceeding may be brought under div 6.3 if a person requested,
instructed, induced, encouraged, authorised or assisted another person to
engage in discriminatory conduct for a prohibited reason.
(2) For the purposes of the application of the Criminal Code 2002 in
relation to an offence under subsection (1), intention is the fault
element for the physical element of requesting, instructing, inducing,
encouraging, authorising or assisting another person to engage in
conduct.
