What it does
This instrument is a delegated determination under the Woomera Prohibited Area Rule 2014 that designates time-limited exclusion periods for a defined part of the Green Zone inside the Woomera Prohibited Area. It is titled "Woomera Prohibited Area Rule 2014 Determination of Exclusion Periods for the Green Zone for July 2017" and is dated 22 May 2017. The determination is made by Caroline Chalker in her capacity as Director, Woomera Prohibited Area Coordination Office, acting as a delegate of the Minister for Defence, explicitly for the purposes of subsection 8(1) of the Woomera Prohibited Area Rule 2014. The operative text states that the periods listed in the Schedule “be exclusion periods for the Green Zone”.
Mechanically the instrument does three things in the text it contains. First, it identifies the decision-maker and the statutory authority relied on: the Director of the Woomera Prohibited Area Coordination Office, as delegate of the Minister for Defence, for the purposes of subsection 8(1). Second, it sets out two discrete temporal exclusion periods: 1 July 2017 to 7 July 2017, and 8 July 2017 to 14 July 2017. Third, for each temporal period it defines the spatial extent of the exclusion by reference to a polygon of latitude/longitude points (Points 1-19) and by incorporation of a map in Part 2 of the Schedule. The instrument also notes that zones within the Woomera Prohibited Area are prescribed in section 6 of the Woomera Prohibited Area Rule 2014, thereby tying this delegated determination to the zoning framework established by the Rule.
The Schedule is in two parts. Part 1 contains the textual, coordinate-based legal description of the area subject to exclusion during the two week-long periods in July 2017. Part 2 contains a graphical map of the same area. The textual polygon is identical across the two listed exclusion periods. The coordinates include multiple points on longitudes of 132.000000 E and 131.500000 E that indicate the polygon’s edges align in places with whole-degree meridians, and several points cluster in the vicinity of 29-30 degrees south latitude and 133-134 degrees east longitude. The instrument therefore combines a temporal specification, a textual spatial specification in coordinates, and a visual geographic depiction.
