What it does
This instrument is a delegate determination under the Woomera Prohibited Area Rule 2014 that designates specific exclusion periods for a defined part of the Green Zone of the Woomera Prohibited Area. It is signed by Kate Leane, Director, Woomera Prohibited Area Coordination Office, acting as a delegate of the Minister for Defence, and is dated 13 September 2022. The instrument states it is made for the purposes of subsections 8(1) and 8(4) of the Woomera Prohibited Area Rule 2014. Mechanically, the Determination does three things within its limited textual scope.
- It identifies the temporal scope of the exclusion periods. The dates set out in Part 1 of the Schedule are: 22 October 2022 to 28 October 2022 inclusive; 29 October 2022 to 04 November 2022 inclusive; and 05 November 2022. Those three items are the periods that, the Determination states, are "the exclusion periods" for the relevant area of the Green Zone specified in the Schedule.
- It identifies the spatial scope of the exclusion by giving a closed polygon defined by a sequence of geodetic coordinates (latitude and longitude in decimal degrees) in column 2 of Part 1 of the Schedule. The Determination also states that the part of the Green Zone described in column 2 is illustrated on the map at Part 2 of the Schedule, making the Schedule the operative spatial-temporal description.
- It records the delegate and date of the instrument, and it links the Determination to the Woomera Rule by referencing subsections 8(1) and 8(4) of the Woomera Prohibited Area Rule 2014 and noting that "Zones within the Woomera Prohibited Area are prescribed in section 6 of the Woomera Prohibited Area Rule 2014."
The Determination does not itself contain provisions that restate the operational consequences of an "exclusion period" (for example, prohibitions, permit conditions, or penalties). It is a scheduling instrument: it declares that, under the Rule, the listed dates are to be treated as exclusion periods for the specifically described polygon of the Green Zone and provides the map as an aid to identification. Any legal effects (for instance, prohibitions on entry, the need for permits, or enforcement mechanisms) are not set out in this text; the Determination locates its authority in the Rule (subsecs 8(1) and 8(4)) and refers to section 6 for the zone definitions.
