#### 45 Special provisions for former participants in NSW Police Witness Protection Plan 45 Special provisions for former participants in NSW Police Witness Protection Plan > Despite section 17, the Supreme Court is not required to be satisfied of the matters referred to in section 17 (b), (c) and (d) before making a witness protection order if satisfied that— > > > (a) the person named in the application as a witness is a former participant in the New South Wales Police Witness Protection Plan in force before the commencement of section 5 or a person who, because of the person’s association with a former participant in that Plan, may require protection or other assistance under this Act, and > > > (b) the order is sought for the purpose of confirming an identity established while that Plan was in operation. > > **s 45:** Rep 1999 No 85, Sch 4.
