89 Decisions appellable to Federal Court

For the purposes of subsection 40ZAR(1) of the Act, decisions of the Registrar of Trade Marks made under the following provisions of this instrument are prescribed: (a) subsection 71(1) (a decision that a ground of objection is or is not made out); (b) subsection 72(1) (a recommendation that a proposed item be determined or a refusal to make such a recommendation); (c) subsection 85(1) (a decision that a ground of objection no longer exists or a refusal to make such a decision).
