The prosecution does not have to prove, in relation to wine goods, that the wine goods are: (a) a blend; or (b) grape extract derived from grapes of different vintages, varieties or prescribed geographical indications; in order to prove an offence under section 39J if the prosecution proves that, in either case, the defendant would have committed an offence against that section.
