Because the Act extinguishes public and private rights over the closed portion (s 2) but also creates public-access duties where land is reclaimed (s 3(2)), implementing authorities should communicate clearly to local communities, harbour users and adjacent property interests how access will be managed, when reclamation triggers apply, and where safety-based prohibitions authorised by proclamation will operate.
