Wildlife (Tour Operator Licence Fee) Regulations 2021

This instrument builds on three core legal concepts: fee units as the arithmetic vehicle for annual licence fees, the land manager as the operative fee-setting and administration authority, and the use-fee as a volume-based charge tied to headcount and days.

Fee units and arithmetic: The Regulations use fee units for a number of monetary items (regulation 5(2), reg 5(4), reg 12(1)(a) and reg 7). The Monetary Units Act 2004 defines the dollar value of a fee unit for each financial year. The Explanatory details appended to the Regulations confirm the fee unit values for the 2024 and 2025 financial years and state that calculated amounts may be rounded to the nearest 10 cents. The practical effect is that the dollar cost of fee‑unit denominated charges will change from year to year without amendment of these Regulations.

Licence pathways: The Regulations distinguish two processes: “standard licence” and “competitively allocated licence” (regulation 3). A standard licence is granted following a standard application process; a competitively allocated licence is granted following a public competitive Expression of Interest process (regulation 3 definition of Expression of Interest document; Part 3). The two pathways share the same per‑person use-fee rates but differ in how the annual licence charge is set: standard licence annual fees are set by reference to fixed fee-unit amounts in the Regulations (regulation 5), whereas competitively allocated licence annual fees are fixed by the land manager and set out in the relevant Expression of Interest document, subject to a Ministerial-guideline constraint and a statutory minimum of 20.78 fee units (regulation 12(1)(a)-(b)).

Use fee: The “use fee” is defined as the fee payable by the holder of a tour operator licence based on the number of individuals entering a State Wildlife Reserve each day as part of organised tours or recreational activities conducted by the licence holder (regulation 3). The adult and child per-day rates are expressed in fixed dollar amounts ($2.40 and $1.60) for both licence types (regulation 6(2)-(3) and regulation 13(1)(a)-(b)). The land manager is responsible for calculating the total use fee (regulation 6(1), 13(1)) and for determining whether to limit the number of licences (regulation 10). For standard licences the Regulations impose a use fee cap denominated in fee units (regulation 7).

Record-keeping and returns: Licence holders are obliged to maintain daily records (regulation 9(1) and 14(1)) in Form 1 (Schedule 1) and to provide those records to the land manager quarterly or annually (regulations 9(2)(c) and 14(2)(c)). The Form 1 template requires per-day entries for location, activity, number of adults and students/children, days/trips and totals, and a certification statement signed by the licence holder (Schedule 1).

Discretionary relief and limits: Regulation 15 creates a formal application path for waiver/reduction/refund and explicitly allows the land manager to act on the land manager’s own motion. Regulation 15(4) sets the decision factors: undue financial hardship, manifest unfairness, and the impact of a natural or unnatural event on ability to conduct tours. Regulation 16 imposes categorical bars on relief where licences are suspended under s 21H or cancelled under s 21J of the Act, with a narrow transitional exception for pro‑rata refunds of non‑commenced years where the cancelled licence had been held for more than one year (regulation 16(3)).

Temporal scope: The Regulations are time-limited: they expire on 30 June 2026 (regulation 18). They have been amended twice (S.R. Nos 45/2023 and 45/2025) and the current version incorporates amendments as at 11 June 2025.

Inter-instrument references: The Regulations expressly invoke other statutes and instruments. They rely on the Wildlife Act 1975 for the authorising power and reference certain licence-related sections of that Act (regs 4, 5, 11, 12, 16 refer to s 21C, s 21D, s 21H, s 21J). They adopt the definitions of “compulsory school age” and “school” from the Education and Training Reform Act 2006 (regulation 3). They use fee units as defined in the Monetary Units Act 2004 (Explanatory details). The Minister may issue guidelines to which the land manager must have regard when fixing competitively allocated licence fees in an Expression of Interest document (regulation 12(1)(a)).

Overall, the Regulations combine fixed per-head user charges with fee-unit based licence fees, and allocate significant implementation authority to land managers while providing for discretionary relief subject to categorical exclusions for suspended or cancelled licences.

Who pays: The primary payers are holders of tour operator licences for State Wildlife Reserves. The Regulations apply to both holders of standard licences and holders of competitively allocated licences (regulation 3; Parts 2 and 3). Applicants for those licences are not required to pay the application fee under section 21C of the Act (regs 4 and 11), but if granted a licence they must pay the annual licence fees prescribed in these Regulations (regs 5 and 12).

Who decides and administers: The land manager has central operational responsibility. The land manager calculates the use fee, decides whether it is necessary to limit the number of licences for environmental, cultural or public safety reasons (regulation 10), sets the licence fee for competitively allocated licences and publishes it in an Expression of Interest document subject to Ministerial guidelines and a statutory minimum (regulation 12(1)(a)-(b)), receives the Form 1 records, determines waiver/reduction/refund applications or acts on the land manager’s own motion to make such relief (regulation 15), and issues refunds on surrender (regulation 17). The Minister retains a role in setting guidelines to be had regard to when the land manager fixes the fee for competitively allocated licences (regulation 12(1)(a)).

Businesses and pricing: Tour operators and businesses that run organised tours or recreational activities for profit in State Wildlife Reserves will be directly affected. The per-head use fees ($2.40 adult, $1.60 child) are small fixed amounts but, over volume, can become material; the existence of a use-fee cap for standard licences (regulation 7) provides an upper bound on an operator’s annual use‑fee exposure. Competitively allocated licence holders face a licence fee set by the land manager and posted in the Expression of Interest document, subject only to a minimum of 20.78 fee units (regulation 12(2)).

Consumers and groups: The Regulations define “child” for the purpose of reduced use-fee rates: a child is a person under 16 or a person of compulsory school age who is educated at a school (regulation 3). This definition will affect pricing for tours that include school groups and young persons; how “compulsory school age” is interpreted depends on the Education and Training Reform Act 2006 definition. The per-head fee is charged by the licence holder based on participation in organised tours or recreational activities (regulation 3 definition of use fee and regs 6 and 13).

Public land stewardship and third parties: The land manager (a public land-management authority under the Act) uses these fees to regulate and charge commercial activity on State Wildlife Reserves, and will face administrative work to collect fees, verify returns, and administer waiver/refund applications. The Regulations also allow the land manager to limit numbers of licences for environmental, cultural or public safety reasons (regulation 10), which may affect the availability of commercial tour services in particular reserves and the distribution of commercial activity across reserves.

Smaller operators and cash flow: The Regulations give operators the option to pay use fees quarterly or annually (regulations 8(1) and 13(2)), and allow holders of multi-year standard licences to elect to pay annual fees for subsequent years in a lump sum at granting (regulation 5(5)). Those options affect cash-flow and financial planning for operators. The waiver/reduction/refund provisions contain hardship and natural/unnatural event factors (regulation 15(4)(a) and (c)), which are relevant to operators affected by seasonal shocks, extreme weather, or other disruptive events.

Compliance counterparties: The land manager is the recipient of returns and waiver applications. The Regulations do not themselves specify criminal offences or administrative penalties for failing to keep or provide returns, but the Act contains provisions on suspension and cancellation (s 21H, s 21J) that interact with the waiver/refund regime (regulation 16). Licence holders whose licences have been suspended or cancelled are limited in their eligibility for relief under regulation 16.

Time-limited nature: All affected parties should note the sunset clause: these Regulations expire on 30 June 2026 (regulation 18). That sunset affects planning for multi-year licences and the expected regulatory cash flows over time.

Key duties

• Application fee: Applicants for either a standard licence or a competitively allocated licence are explicitly not required to pay the application fee under section 21C of the Wildlife Act 1975 as a result of regulations 4 and 11. The duty to pay arises upon grant in the form of annual licence fees under these Regulations (reg 4; reg 11; reg 5; reg 12).
• Payment of annual licence fees:
  • Standard licences: If a standard licence is granted for one year, the holder must pay 20.78 fee units on granting (regulation 5(1)-(2)). If granted for more than one year, the holder must pay 16.3 fee units pro‑rata on granting (covering the period to 30 June) and by 30 June of each subsequent financial year, with an option to pay the subsequent years in a lump sum at granting (regulation 5(3)-(5)).
  • Competitively allocated licences: The annual licence fee is the fee fixed by the land manager and set out in the relevant Expression of Interest document, subject to a minimum of 20.78 fee units and to any Ministerial guidelines (regulation 12(1)-(2)). Payment schedule mirrors the standard licence provision (regulation 12(3)).
• Use fees: Licence holders must pay use fees calculated by the land manager based on daily participation numbers:
  • Standard and competitive licences: $2.40 per non-child and $1.60 per child per day (regulation 6(2)-(3); regulation 13(1)(a)-(b)).
  • For standard licences there is a statutory cap on use-fee liability: the holder is not liable to pay use fees in excess of the use fee cap of 1018.74 fee units at the end of each financial year (regulation 7).
• Timing and manner of payment: Use fees may be paid quarterly or annually by the licence holder (regulation 8(1) and reg 13(2)). If more than the capped amount is paid, the licence holder is entitled to a refund for the excess at the end of the financial year (regulation 8(2)).
• Record-keeping and returns: Licence holders must maintain daily records of the number of persons participating in any organised tour or recreational activity for which the licence applies, in Form 1 (Schedule 1), and provide that record to the land manager quarterly or annually (regulations 9(1)-(2) and 14(1)-(2)).

Key rights

• Right to apply for waiver, reduction or refund: A licence holder may apply in writing to the land manager for a waiver, reduction or refund of any fee payable under these Regulations (regulation 15(1)-(2)). The land manager may also act on the land manager’s own motion to grant relief (regulation 15(5)(a)-(b)).
• Grounds to be considered: When making a decision on a relief application, the land manager must have regard to undue financial hardship, manifest unfairness, and the impact of natural or unnatural events on the licence holder’s ability to conduct tours (regulation 15(4)).
• Refund on surrender: The land manager may refund on a pro‑rata basis fees paid in advance for any non‑commenced year if the licence holder surrenders the licence (regulation 17).
• Use-fee cap: Standard licence holders have an enforceable cap on annual use-fee liability, measured in fee units (regulation 7). If the licence holder has paid more than the cap, regulation 8(2) entitles them to a refund of the excess.
• Minimum competitive fee: Competitively allocated licence applicants are protected by a statutory floor: the land manager cannot set a fee in the Expression of Interest document below 20.78 fee units (regulation 12(2)). Ministerial guidelines are a factor the land manager must have regard to in fixing fees (regulation 12(1)(a)).

Constraints and exclusions

• Suspended or cancelled licences: Regulation 16 imposes firm limitations. A licence holder whose licence has been suspended under s 21H is not eligible for waivers, reductions or refunds of outstanding or paid fees (regulation 16(1)). A licence cancelled under s 21J similarly disqualifies the former holder from waiver/reduction/refund in most circumstances (regulation 16(2)), subject to a pro‑rata refund exception for non‑commenced years where the cancelled licence had been held for more than one year (regulation 16(3)).
• Form of application: Relief applications must be in writing (regulation 15(2)), and the land manager may rely on the Form 1 returns to calculate use-fees and to reconcile claims (regulations 9 and 14, Schedule 1).

Cross-reference obligations

• Definitions from other Acts: The status of “child” and “compulsory school age” depends on the Education and Training Reform Act 2006 (regulation 3). The value of a fee unit and its annual variation depend on the Monetary Units Act 2004 and the Treasurer’s Gazette notice (Explanatory details).
• Act-based consequences: The Regulations link to the Act’s suspension and cancellation powers (s 21H, s 21J), and to the Act’s fee provisions (s 21C, s 21D) by specifying that applicants are not required to pay the s 21C application fee but are required to pay the annual licence fees under these Regulations if granted the licence (regulations 4 and 11).

In short, these Regulations impose specific fee, payment, and reporting duties; they create discretionary relief rights administered by the land manager; they constrain relief in cases of suspension or cancellation; and they use external statutory references (Monetary Units Act; Education Act) to define key calculations and beneficiary categories.

The Regulations themselves do not create standalone penalty offences or set monetary fines. Instead, they operate within the enforcement and regulatory framework of the Wildlife Act 1975 and allocate administrative duties to the land manager. The instrument therefore relies on the Act for enforcement consequences connected to licence non‑compliance, suspension and cancellation.

Statutory enforcement links

• Suspension and cancellation: Regulation 16 refers directly to licences suspended under section 21H of the Wildlife Act 1975 and licences cancelled under section 21J of the Act. Those sections are the Act-based mechanisms that the Regulations use to restrict eligibility for waiver, reduction or refund. The existence of those cross-references means that enforcement action under the Act (suspension or cancellation) has explicit financial consequences under these Regulations (regulation 16(1)-(3)).
• Application and annual licence fees under the Act: The Regulations state that applicants for standard or competitively allocated licences are not required to pay the fee under section 21C of the Act (regs 4 and 11) and that the annual licence fee under section 21D of the Act is to be treated as comprising the components set out in the Regulations (reg 5(1) and reg 12(1)). These provisions reframe how the Act’s fee sections are implemented, but do not themselves create enforcement processes.

Administrative enforcement and audit risk

• Record-keeping and certification: Licence holders must maintain daily records in Form 1 (Schedule 1) and provide those records quarterly or annually to the land manager (regulations 9 and 14; Schedule 1 includes a certification statement). The certification requirement implies a risk of administrative consequences for false statements, but the Regulations do not specify the consequence. Any penalty or enforcement power in relation to false or missing returns would derive from the Wildlife Act or general public sector rules (not from these Regulations directly).
• Refunds and caps subject to reconciliation: The use-fee cap for standard licences (regulation 7) and the entitlement to refunds for overpayment (regulation 8(2)) suggest an ex post reconciliation process overseen by the land manager. The left-hand procedural power to reconcile returns implies the practical possibility of audits or reconciliations, although the Regulations do not prescribe audit powers, timeframes for audits, or the documentation the land manager may require beyond the Form 1 returns.

Discretionary relief decisions

• Waiver/reduction/refund decisions sit with the land manager (regulation 15(3)). The statutory factors to be considered are set out in regulation 15(4). The land manager may act on the land manager’s own motion or on application (regulation 15(5)). There is no internal appeal procedure specified in these Regulations; external review rights (for example, merits review or judicial review) would depend on the Act or on general administrative law principles.

Temporal enforcement impact

• Effect of expiry: The Regulations expire on 30 June 2026 (regulation 18). The expiry affects continuity of the fee regime and may affect enforcement or debt-collection strategies if not replaced. Any outstanding obligations or ongoing fee liabilities created while the Regulations are in force would typically survive until determined, but the instrument does not discuss transitional enforcement detail.

Practical enforcement summary

• The Regulations create fee obligations and record-keeping duties, vest the land manager with calculation and relief powers, and tie penalties and formal enforcement to the Act’s suspension/cancellation regime and any general enforcement powers in that Act. The Regulations themselves are procedural and financial rather than punitive: enforcement mechanisms for non-compliance will be found in the Act and in general administrative law.

These Regulations sit in a network of statutes and administrative instruments; several cross-references are explicit in the text and the Explanatory details. The principal interactions are with the Wildlife Act 1975, the Monetary Units Act 2004, and the Education and Training Reform Act 2006. The Minister’s guidelines and the Expression of Interest mechanism also create administrative interaction points.

Wildlife Act 1975

• Authorising provisions: These Regulations are made under sections 87 and 87A of the Wildlife Act 1975 (regulation 2). The Wildlife Act provides the broader regulatory framework for State Wildlife Reserves, licences and the powers of land managers.
• Fee provisions and licence consequences: The Regulations amend the practical operation of the Act’s fees and licence provisions: they state that applicants are not required to pay the fee under section 21C but are required to pay annual licence fees as set out in these Regulations if granted a licence (regulations 4 and 11). They also reference suspension (s 21H) and cancellation (s 21J) under the Act as disqualifying events for waiver or refund eligibility (regulation 16). The Regulations therefore do not replace the Act’s enforcement powers but reconfigure the fee components that an annual licence fee comprises for the purposes of section 21D.

Monetary Units Act 2004

• Fee unit mechanism: The Regulations prescribe some fees by reference to fee units (for example, 20.78 fee units in reg 5(2), 16.3 fee units in reg 5(4), and the use fee cap of 1018.74 fee units in reg 7). The Explanatory details note that fee unit values for each financial year are fixed by the Treasurer under section 5 of the Monetary Units Act 2004 and must be published in the Government Gazette and a Victorian newspaper. The Regulation’s reliance on fee units therefore links the dollar amounts payable under the Regulations to the Monetary Units Act’ annual adjustments, creating automatic indexation of fee-unit denominated charges without further subordinate instrument amendment.

Education and Training Reform Act 2006

• Definitions: The Regulations adopt definitions from the Education and Training Reform Act 2006 for “compulsory school age” and “school” (regulation 3). The definition of “child” in the Regulations depends on those cross-references. That interaction affects who benefits from the lower child use-fee and how school groups are charged.

Administrative law and Ministerial guidelines

• Ministerial guidelines: Regulation 12(1)(a) requires the land manager, when fixing the fee for a competitively allocated licence and setting it out in the Expression of Interest document, to have regard to any guidelines issued by the Minister. Those guidelines become a binding factor for the fee-setting exercise and introduce a governance interaction: the Minister’s guidance shapes the land manager’s discrete pricing discretion.
• Expression of Interest process: Competitively allocated licences are to be offered by an Expression of Interest document advertised to the public (regulation 3 definition; Part 3). That process implicates public procurement or property-allocation practices and may intersect with general administrative law requirements for fairness, public notice and transparent criteria where governmental agencies are granting valuable commercial rights to use public land.

Other regulatory and statutory interactions

• Rounding and publication obligations: The Explanatory details state that calculated fees may be rounded to the nearest 10 cents and remind readers that the fee unit value must be published in the Gazette and a newspaper before 1 June in the preceding financial year. Those publication requirements intersect with financial administration and notice obligations found in the Monetary Units Act 2004.
• Interaction with the Act’s broader regulatory regime: Because the Regulations do not themselves create offences or specific enforcement procedures, they rely on the Act for enforcement consequences. Conversely, the Act references (s 21C, s 21D, s 21H, s 21J) are operationalised by the Regulations’ fee and refund rules. Compliance obligations under the Act (licence conditions, suspension, cancellation) will therefore have fee consequences under these Regulations.

In sum, these Regulations operate as a fee‑setting and administrative implementation instrument that depends on and references other statutes for definitions, monetary conversion, administrative constraints and enforcement. Practitioners should read the Regulations alongside the relevant sections of the Wildlife Act 1975, the Monetary Units Act 2004, and the Education and Training Reform Act 2006, and be alert to any Ministerial guidelines and the content of particular Expression of Interest documents for competitively allocated licences.

The published version of the Regulations is Version No. 003, described as incorporating amendments as at 11 June 2025. The Endnotes include a discrete Table of Amendments that records two amending statutory rules.

Recorded amendments

• Wildlife (Tour Operator Licence Fee) Amendment Regulations 2023, S.R. No. 45/2023: Date of making 6 June 2023; date of commencement 6 June 2023. The Regulations record that regulation 18 (the expiry provision) was amended by S.R. No. 45/2023 (endnote and reg 18 footnote).
• Wildlife (Tour Operator Licence Fee) Amendment Regulations 2025, S.R. No. 45/2025: Date of making 11 June 2025; date of commencement 11 June 2025. Regulation 18 was also amended by S.R. No. 45/2025 (endnote and reg 18 footnote).

Current status and temporal scope

• The Regulations state that they expire on 30 June 2026 (regulation 18). The recorded amendments indicate that the expiry date has been amended by the 2023 and 2025 amending Regulations. Version No. 003 is current as at 11 June 2025 and thus incorporates the changes made up to and including S.R. No. 45/2025.

Explanatory details added in the consolidated version

• The explanatory details section appended to the Regulations clarifies the fee-unit mechanism and provides concrete fee unit values for the financial years commencing 1 July 2024 ($16.33) and 1 July 2025 ($16.81). It also notes that fee amounts calculated by multiplying fee units by fee-unit value may be rounded to the nearest 10 cents and explains the statutory process under the Monetary Units Act 2004 for setting fee unit values in future years.

What the amendments changed (what we can read from the text)

• The Endnotes explicitly state that regulation 18 was amended by the two listed amending statutory rules. While the consolidated text does not reproduce the pre‑amendment wording, the presence of those amending rules and the consolidated expiry date make clear that the instrument has been updated to extend its remainder or otherwise to address timing. The consolidated version also carries explanatory details referencing fee unit values for 2024 and 2025; those explanatory details are part of the published consolidated instrument.

Practical consequence of amendments

• Since the Regulations use fee-unit denominated amounts for several items, the amending instruments and the Treasurer’s periodic fee-unit determinations interact to change dollar charges over time without requiring textual amendment of fee rates expressed in fee units. The 2023 and 2025 amending Regulations appear to have primarily updated timing and the expiry clause; the consolidated instrument as at 11 June 2025 carries the fee‑unit values in the Explanatory details that are necessary to convert fee‑unit amounts into dollars for the 2024 and 2025 financial years.

Record-checking: legal practice note

• Any practitioner advising a licence applicant or holder should check the consolidated instrument for the exact fee-unit values in force for the year in question, and should check whether any further amending statutory rules have been made after 11 June 2025 (the incorporated date). Fee purchases, pro‑rata refunds, the use-fee cap in fee-unit terms, and the minimum fee for competitive licences all have monetary effects that vary with the fee-unit value.

The consolidated instrument does not record any litigation history. The Endnotes and Table of Amendments provide the legislative amendment background but do not record judicial decisions or challenges to the Regulations.

What the absence of litigation details means

• There is no express record in the text of any court or tribunal decisions interpreting these Regulations. The Regulations include cross-references to the Wildlife Act 1975 (for suspension and cancellation powers) and to other statutes for definitions and fee-unit conversion. Any litigation concerning the interpretation, application or validity of these Regulations would therefore appear in court records and case law databases, not in the Regulations themselves.

Practical research steps if litigation is relevant

• If litigation or judicial interpretation is material to a matter, a practitioner should:
  • Search Victorian court and tribunal databases for proceedings mentioning the Wildlife (Tour Operator Licence Fee) Regulations 2021 or its amending Instruments (S.R. Nos 45/2023 and 45/2025).
  • Check administrative review and merits-review decisions (e.g. VCAT) for disputes about land manager decisions on waivers, reductions, refunds or licence allocation under Expressions of Interest.
  • Review any decisions that interpret the relevance of fee-unit conversions or the interaction between s 21C/s 21D of the Wildlife Act 1975 and these Regulations.

For present purposes, the Regulations themselves contain no litigation annotations and do not list cases; no cases are named in the instrument.

This section flags textual and practical traps within the Regulations that are visible on close reading of the instrument.

1. Application fee under s 21C vs annual licence fee

• The Regulations remove the need to pay the application fee under s 21C for applicants (regs 4 and 11). That may tempt counsel or clients to assume there are no relevant Act-based fees, but the Regulations still require annual licence fees under reg 5 (standard) or reg 12 (competitive) if a licence is granted. Practitioners should not conflate the absence of an application fee with an absence of all upfront charges.

2. Fee‑unit denominated items change in dollar terms yearly

• Several statutory amounts are expressed in fee units (for example 20.78 fee units in reg 5(2); 16.3 fee units in reg 5(4); the use-fee cap of 1018.74 fee units in reg 7). The dollar equivalent depends on the Treasurer’s fee‑unit value for the relevant financial year under the Monetary Units Act 2004 (Explanatory details). This means the practical dollar cost of a licence or cap varies year to year without text changes, and invoice calculations must use the fee‑unit value applicable to the financial year in which the fee is payable.

3. Use-fee cap is in fee units, use-fee per person is fixed dollars

• The per-person use fees are fixed dollar amounts ($2.40 adult, $1.60 child, regs 6 and 13). The cap for standard licences, however, is denominated in fee units (reg 7). That produces a moving-dollar cap because the fee-unit value changes. For FY commencing 1 July 2024 the explanatory details give a fee-unit value of $16.33, so the cap of 1018.74 fee units equates to approximately $16,636.02 before rounding; for FY commencing 1 July 2025 the cap is approximately $17,125.02 before rounding. Practitioners should not assume a fixed dollar cap.

4. Definition of “child” can be non‑obvious

• “Child” is defined as a person under 16 or a person of compulsory school age who is educated at a school (reg 3). Because “compulsory school age” is defined in the Education and Training Reform Act 2006, some persons aged 16 or older who remain of compulsory school age and attend school may qualify for the child rate. Operators should take care in classifying participants and keep documentary evidence for school-group rates.

5. Land manager discretion is broad and multi-faceted

• The land manager determines whether limiting licences is necessary (reg 10), calculates use fees (reg 6(1), reg 13(1)), sets competitively allocated licence fees in Expression of Interest documents subject to Ministerial guidelines (reg 12(1)(a)), and decides (or acts on the land manager’s own motion) to waive, reduce or refund fees (reg 15). That concentration of operational discretion can lead to inconsistent outcomes across different land managers or reserves unless checked by guidelines or internal policies. The Regulations do not prescribe an appeal route or timeframe for land manager decisions.

6. Record-keeping falls on the licence holder but consequences are implicit

• The Regulations require daily records in Form 1 (reg 9(1) and 14(1), Schedule 1) and certification. The Regulations do not state the retention period for records, nor do they directly specify penalties for false certification. However, the Act’s enforcement powers with respect to licences (including suspension and cancellation) can interact with record-falsification risks. Licence holders should assume authoritative scrutiny and act accordingly.

7. Suspension and cancellation bars to relief are strict

• A licence suspended under s 21H cannot be the subject of waiver or refund (reg 16(1)). A cancelled licence under s 21J likewise disqualifies the holder from waiver/reduction/refund for outstanding fees or fees paid, with only a narrow pro‑rata refund exception for non‑commenced years if the cancelled licence was held for more than one year (reg 16(2)-(3)). Where a licence faces disciplinary risk, operators should consider the financial implications carefully.

8. Form 1 is the required format

• The Regulations require returns to be in Form 1 (Schedule 1) (regulations 9(2)(b) and 14(2)(b)). Custom spreadsheets or summaries may be insufficient unless they replicate Form 1’s fields and certification.

9. Time‑limited regime

• The Regulations expire on 30 June 2026 (regulation 18). For operators seeking multi‑year certainty, the sunset creates regulatory risk: the fee structure may disappear or be replaced, and multi‑year licence planning should recognise that.

10. Rounding rules and publication timing affect accounting

• The Explanatory details specify rounding to the nearest 10 cents and impose timing for publication of the fee-unit value before 1 June preceding the financial year. Practical accounting should use the fee-unit value published by the Treasurer for the applicable year and apply the specified rounding.

These “gotchas” are textual or structural features of the Regulations that create traps for the inattentive. Each item arises directly from the wording of the Regulations and their Explanatory details.

This section sets out practical compliance steps and internal controls distilled from the Regulations’ text and Explanatory details. Each step cites the relevant regulatory provision or Explanatory detail.

1. Determine which licence pathway applies

• Confirm whether the activity requires a standard licence or will be offered under a competitively allocated licence (regulation 3 definitions; Part 2 and Part 3). If you expect to bid in an Expression of Interest process, check the particular EoI document for the fee fixed by the land manager (regulation 12(1)(a)).

2. Read the Expression of Interest and Ministerial guidelines (competitive)

• For competitively allocated licences, read the Expression of Interest document carefully because it will specify the annual licence fee fixed by the land manager and must reflect any Ministerial guidelines (regulation 12(1)(a)). Note the statutory minimum (20.78 fee units, regulation 12(2)).

3. Calculate licence fees using current fee-unit values

• For fee-unit denominated items (standard licence fees, multi-year pro rata, use-fee cap), obtain the Treasurer’s fee-unit value applicable to the financial year from the Government Gazette (Monetary Units Act 2004 and Explanatory details). Multiply the stated fee units by the fee-unit dollar value and round to the nearest 10 cents as specified in the Explanatory details. Examples based on the Explanatory details:
  • Standard one-year licence fee of 20.78 fee units equates to approximately $339.34 in FY commencing 1 July 2024 (20.78 x $16.33), rounding to nearest 10 cents. Recalculate for the specific financial year in question.
  • The use-fee cap of 1018.74 fee units equates to approximately $16,636.02 in FY commencing 1 July 2024 (1018.74 x $16.33, rounding rules apply).
• Ensure the correct fee-unit value is used for fees payable in each relevant financial year.

4. Implement daily record-keeping in Form 1

• Maintain daily records for each organised tour or recreational activity in Form 1 (Schedule 1) and keep the certification page signed and dated (regulation 9(1)-(2) and regulation 14(1)-(2)). Ensure entries capture date, location, activity, number of adults and children/students, number of days/trips, and totals. Keep originals or reliable duplicates to support any reconciliation or review by the land manager.

5. Submit returns on the required schedule and reconcile payments

• Provide the Form 1 returns to the land manager on a quarterly or annual basis (regulation 9(2)(c) and regulation 14(2)(c)). If paying use fees quarterly, reconcile the cumulative payments against the annual liability and the use-fee cap (for standard licences) at year end to claim any refund of overpayment per regulation 8(2).

6. Choose payment timing strategically

• For standard licences granted for more than one year the holder must pay 16.3 fee units on granting covering the remainder of the financial year and by 30 June for subsequent years, but may elect to pay the subsequent year fees in a lump sum on granting (regulation 5(4)-(5)). For use fees, holders may elect to pay quarterly or annually (regulations 8(1) and 13(2)). Use these options to manage cash flow.

7. Monitor classification of participants

• Use the regulation 3 definition of “child” and the Education and Training Reform Act 2006 definition of “compulsory school age” to determine eligibility for the lower child rate. Keep evidence for school-group participants (attendance lists, school letters) to support child-rate claims.

8. Apply in writing for waivers/reductions/refunds when appropriate

• If hardship, manifest unfairness or natural/unnatural events have affected operations, make a written application to the land manager under regulation 15(1)-(2). Include documentary support demonstrating financial hardship, the event and its impact on operations. Bear in mind that waivers are not available if the licence is suspended under s 21H or cancelled under s 21J (regulation 16).

9. Use the land manager’s own-motion relief sparingly as a fallback

• The land manager may act on the land manager’s own motion to grant relief (regulation 15(5)(a)). If anticipating hardship or an event affecting many operators, consider coordinated submissions to the land manager or engagement with representative bodies to prompt a land-manager‑initiated response.

10. Preserve documentation for potential enforcement or review

• Keep records of all returns, payments, waiver applications, land-manager decisions, and any correspondence about suspension or cancellation decisions under the Wildlife Act. While the Regulations do not specify retention periods, retention supports audit, administrative review and defence against enforcement actions.

11. Plan for the sunset and changes to fee-unit values

• Because the Regulations expire on 30 June 2026 (regulation 18), factor regulatory uncertainty into multi‑year business plans. Also plan for annual fee‑unit value changes that will alter dollar amounts; ensure accounting systems update automatically to use the published fee-unit value for each financial year.

12. Reconcile financial accounting with trip returns

• Ensure accounting entries for use fees reconcile to Form 1 trip returns. Because Form 1 contains a certification, internal controls should require cross-checking between sales/booking records and trip returns prior to certification.

13. Prepare for potentially broad land-manager discretion

• Because the land manager has several discretionary powers (limiting licences reg 10, setting competitive fees reg 12, calculating use fees reg 6, and deciding waivers reg 15), proactively engage with the land manager on likely fee-setting approaches, Expression of Interest terms, and administrative expectations. Obtain clear written guidance from the land manager where possible.

14. If bidding for competitively allocated licences, price accordingly

• For Expression of Interest offers, factor in the minimum statutory fee (20.78 fee units) and the potential use fees and cap effects when pricing services to customers. Review any Ministerial guidelines that the land manager must have regard to in setting fees (regulation 12(1)(a)).

15. Seek legal or accounting advice where ambiguity exists

• If a land manager’s calculation, waiver decision, or classification of participants is contested or unclear, seek targeted legal advice on administrative law remedies (merits review/ judicial review) and on whether the land manager has complied with the obligation to have regard to Ministerial guidelines.

Compliance is record-driven and calculation-sensitive. The key compliance tasks are to maintain daily trip returns in Form 1, convert fee units to dollars using the Treasurer’s published fee-unit value and rounding rules, reconcile payments to returns and the cap where applicable, and make any waiver or refund applications in writing with supporting evidence.
