83B Constraints on the granting of whale watching tour permits (1) Where the Secretary has made a limited permit area determination for an area specifying the number of whale watching tour permits that may be in force in respect of the area, the Secretary must not grant such a number of whale watching tour permits for the area that the maximum number of permits that may be in force in the area is exceeded. (2) The Secretary must not grant a whale watching tour permit for a limited permit area for such permits unless the Secretary is satisfied that the applicant satisfies the criteria specified in the notice under section 83GC for that area.
