Wilderness Protection Regulations 2021

Several core legal constructs structure these regulations.

Relevant authority: Defined in r 3 as either the co‑management board for a co‑managed wilderness protection area or zone, or otherwise the Director. The regulations also clarify that if the co‑management board is suspended under relevant provisions (via the National Parks and Wildlife Act 1972 as applied under s 33A of the Act), references to relevant authority become references to the Director (r 3(2)). This creates a shifting locus of decision-making tied to the operational status of co‑management boards.

Permission and written permission: The regulations make many otherwise permissible activities conditional on obtaining the written permission of the relevant authority (see the permissions requirement repeated across r 9-r 31). Permissions must be in writing, may be conditional and may be varied or revoked at any time (r 34(1)). Permissions may be granted to particular persons or published in the Gazette to apply generally or to a class of persons (r 34(2)). The written-permission requirement converts many ordinary recreational and commercial activities into regulatory interactions requiring prior administrative approval.

Setting aside and Gazette notices: The relevant authority may set aside whole or parts of an area or zone for particular activities by notice in the Gazette and may impose conditions (r 8). Similarly, the relevant authority may publish opening hours, closures and declarations of fossil or geomorphological significance by Gazette notice (r 7, r 26(1)). The Gazette is used both for fixed area designations and for broad, notice-based regulation.

Co‑management and exclusions: The regulations define co‑managed wilderness protection areas and zones and co‑management boards (r 3). They do not apply to co‑managed areas that are constituted of Aboriginal‑owned land (r 4(1)), producing a formal statutory exemption for those specific areas.

Interaction with other statutory regimes: Several provisions explicitly preserve the effect of other legal regimes. For example, multiple permissions or prohibitions are “subject to the rights of a person pursuant to a mining tenement and a proclamation under Part 3 Division 2 of the Act” (see r 16, r 24(2), r 27(2), r 29(2) and others). The rules on aircraft are expressly subject to any Commonwealth law to the contrary (r 10(4)). Definitions and powers are cross-referenced to the National Parks and Wildlife Act 1972 and the Motor Vehicles Act 1959 (r 3), so the regulations operate in a web of cross-statute definitions and exceptions.

Wardens and enforcement: Wardens are given a role in on-the-ground enforcement. The regulations prescribe qualifying criteria for wardens (r 5) and exclude wardens from being subject to the regulations when performing their functions (r 4(2)). Wardens may remove vehicles that obstruct tracks and may seize animals or abandoned property, with costs of capture, impoundment and disposal recoverable as debts (r 9(4), r 23, r 29). The regulations also make compliance with signs and warden directions an offence (r 32, r 33).

Offences, penalties and expiation: Most contraventions carry a maximum penalty of $1,250 and an expiation fee commonly ranging $100-$150 (discrete exceptions apply). Destroying or damaging a declared fossil or geomorphological site carries a higher maximum penalty of $15,000 and an expiation fee of $1,500 (r 26(2)). The general defence for emergency action is available (r 35).

Special status of Aboriginal persons and customary rights: The regulations recognise certain Aboriginal rights expressly: for example, r 17(2) and r 22(2) provide that the prohibitions on firearms and devices for taking animals do not apply to an Aboriginal person taking animals under s 68D of the National Parks and Wildlife Act 1972. Co‑managed Aboriginal‑owned land is excluded from the operation of the regulations (r 4(1)). These provisions create carve-outs tied to statutory Aboriginal customary-taking rights and land status.

Preservation of administrative discretion: The relevant authority has repeated powers to grant, vary and revoke permissions, to set aside and declare parts of areas for uses, and to close areas for safety or fire risk (r 7, r 8, r 34). That discretionary architecture is central to the regulatory design and determines how private activity is channelled into permitted locations or conditional approvals.

The regulations affect a wide range of actors by prescribing permissions, fees, behavioural prohibitions and enforcement mechanisms.

Members of the public and visitors: Any person entering or remaining in a wilderness protection area or zone is subject to entry fee requirements (r 6) and the general prohibitions and permissions regime that follows (r 9-r 33). Typical recreational users , hikers, campers, rock climbers, swimmers, cave explorers, fishermen, vessel users and model-plane flyers , will need to check whether their intended activity is permitted without written permission (for many activities it is not) and, if not, to apply to the relevant authority for written permission (r 34). Model plane and drone operators are specifically affected by prohibitions (r 10(3), r 20(2)).

Commercial operators and organisers: Tour operators, filming crews (defined by r 3 as “filming”), organisers of public meetings, demonstrations or gatherings, and any business planning to use loudspeakers, arrange group events, or operate equipment will face an administrative permission regime (r 31). Permissions may be subject to conditions and revocable at any time (r 34), creating an ongoing compliance requirement for commercial or recurring users.

Land managers and authorities: Co‑management boards, the Director, and wardens are decision-makers under the regulations. Co‑management boards are the relevant authority for co‑managed areas (r 3). The Director becomes the relevant authority where no co‑management board exists or a co‑management board is suspended (r 3(2)). Wardens exercise enforcement functions but are exempt from being subject to the regulations while performing those functions (r 4(2)), and wardens must meet prescribed qualifications (r 5).

Aboriginal persons and custodial groups: The instrument recognises Aboriginal customary rights in several ways. It does not apply to co‑managed areas constituted of Aboriginal‑owned land (r 4(1)). The prohibitions on firearms and devices for taking animals exclude Aboriginal persons acting under s 68D of the National Parks and Wildlife Act 1972 (r 17(2), r 22(2)). These provisions affect how Aboriginal people exercise traditional practices in these areas and allocate decision-making to co‑management arrangements where they exist.

Owners of animals, vehicles and property: The regs impose duties and potential liabilities on owners of animals and property. An unprotected animal present without permission or not under control may be captured and sold or destroyed; costs are recoverable as a debt to the Crown and animals will not be returned until costs are paid (r 23(1)-(4)). Vehicles or property left unattended for more than 24 hours may be seized and impounded; the owner must pay seizure and impoundment costs before return, and if not claimed within a month the relevant authority may sell or dispose of the items (r 29).

Mining and prospecting interest-holders: Multiple provisions expressly preserve the rights of persons holding mining tenements and proclamations under Part 3 Division 2 of the Act (see r 16, r 24(2), r 27(2), r 29(2), r 17(3)). Holders of those statutory rights will be able to rely on those rights where they conflict with certain prohibitions in the regulations.

Law enforcement and administrative agencies: The regulations designate wardens and persons authorised by the relevant authority to enforce the rules, remove vehicles and seize property (r 9(4), r 23, r 29). The Director, co‑management boards and their authorised staff will administer permissions, Gazette notices and area designations (r 7, r 8, r 26).

Visitors who are subject to dedicated Commonwealth regimes: Aircraft activity over an area is regulated by both these regulations and any relevant Commonwealth law (r 10(4)). Operators must therefore navigate both state and Commonwealth regimes.

In aggregate, the regulations channel a broad set of ordinary recreational, commercial and custodial activities into a system of prior permissions, area-specific designations and enforceable obligations administered by the relevant authority and enforced by wardens and authorised persons.

The regulations create a framework of duties that visitors and users must observe and a set of administrative rights vested in the relevant authority and wardens.

Duties on individuals and visitors:

• Pay entry fees: A person must not enter or remain in an area or zone unless the appropriate entrance fee fixed by the relevant authority has been paid (r 6). The offence carries a maximum penalty of $1,250 and an expiation fee of $150.
• Observe opening hours and closures: The relevant authority may publish opening hours and close areas or parts thereof by Gazette notice or where public safety, fire bans, or staff shortages justify closure (r 7). Entering closed areas without permission is an offence (r 7(3)-(4)).
• Obtain written permission for many activities: A long list of activities require prior written permission from the relevant authority, including driving off set-aside roads, camping outside set-aside campsites, using aircraft or drones, launching vessels in water not set aside for that purpose, lighting fires in contravention of bans, using chainsaws, operating generators outside set sites, using metal detectors except under mining tenement/proclamation, possession and use of firearms and devices for taking animals, swimming/diving outside set-aside areas, cave entry (r 9-r 20, r 22, r 31).
• Comply with conditions attached to permissions: If permission is granted subject to a condition, failure to comply is an offence (r 34(3)).
• Comply with signage and warden directions: Contravening or failing to comply with notices or signs displayed by the relevant authority is an offence (r 32). Failure to comply with a reasonable direction of a warden is also an offence (r 33).
• Avoid interference with animals, plants and geological features: Taking or disturbing unprotected animals, damaging nests or burrows, bringing plants into areas (except dead plants as food), removing soil, rock, fossils, mulch or archaeological remains, or otherwise disturbing earth material requires permission and may attract penalties (r 21, r 24, r 25).
• Avoid littering and pollution: Deposit or leaving of litter, noxious substances, offal, domestic garbage and industrial waste is prohibited (r 27). Fouling or polluting water is prohibited (r 28).

Administrative rights and powers of the relevant authority and wardens:

• Grant, vary and revoke permissions: Permits must be in writing, may be conditional and may be varied or revoked at any time (r 34(1)). The relevant authority can also publish permissions in the Gazette to apply to classes of persons (r 34(2)).
• Set aside areas for particular uses: Via Gazette notices the relevant authority may set aside areas for particular activities and impose conditions (r 8).
• Declare fossil or geomorphological significance sites: The relevant authority may declare protected sites by Gazette notice and contravention attracts a higher penalty (r 26).
• Close areas: The relevant authority may close areas or parts where fire risk is extreme, staff are unavailable, public safety concerns exist, or where closures are in accordance with the plan of management (r 7(2)).
• Seize, remove and impound property and animals: Wardens may remove vehicles obstructing access, seize and impound abandoned property, capture and sell or destroy unprotected animals present without permission, and recover associated costs as debts due to the Crown (r 9(4), r 23, r 29).
• Recover costs: The relevant authority may recover the costs of removal, seizure, impounding and keeping items from owners before returning them, and may sell items not claimed after 1 month (r 9(4), r 29(4)-(6)).

Legal defences and exceptions:

• Emergency defence: It is a defence if a defendant proves they acted in response to an emergency and that the action was reasonable in the circumstances (r 35).
• Aboriginal and mining rights: Specific exemptions exist for Aboriginal persons acting under s 68D of the National Parks and Wildlife Act 1972 in relation to firearms and devices for taking animals (r 17(2), r 22(2)). Rights under mining tenements and proclamations under Part 3 Division 2 of the Act are preserved in specific provisions (r 16, r 24(2), r 27(2), r 29(2), r 17(3)).
• Commonwealth laws: Aircraft regulation is subject to Commonwealth law to the contrary (r 10(4)).

Practical implications of duties and rights:

• Permissions are formal and revocable: The written, conditional and revocable nature of permissions (r 34) means that legal compliance requires retaining written permits and complying with any conditions imposed.
• Liability and cost recovery: Seizure and disposal powers (r 23, r 29) convert non-compliance into a potential financial debt to the Crown recoverable by the relevant authority.
• Administrative discretion: The breadth of the relevant authority’s powers to set aside areas, impose conditions, and close areas (r 7, r 8, r 26) concentrates day-to-day practical decision-making authority in the relevant authority and wardens.

The regulations combine fixed maximum criminal penalties with an expiation system and administrative enforcement powers exercised by wardens and the relevant authority.

Offences and penalties:

• Standard maximum penalties: Many contraventions in r 6-r 34 carry a maximum penalty of $1,250. The expiation fees attached to those offences are typically $100-$150 depending on the specific regulation (for example, entry without payment: max $1,250, expiation $150 at r 6; driving off-track: max $1,250, expiation $150 at r 9(1)).
• Higher penalty for fossil/geomorphological site damage: Destroying, damaging or disturbing a declared fossil or geomorphological site (declared by Gazette under r 26(1)) is a stand-out higher-offence: maximum penalty $15,000 and expiation fee $1,500 (r 26(2)).
• Range of expiation fees: Expiation fees are specified in multiple provisions and vary by offence. The schedule of offences shows a pattern where more environmentally sensitive or potentially harmful activities attract higher expiation fees (e.g. fires, chainsaw use, firearms usages often $150; many others $100).

Enforcement powers:

• Wardens and authorised persons: Wardens and persons authorised by the relevant authority have powers to enforce the regulations on the ground (see r 9(4), r 23 and r 29). Wardens are exempt from being subject to the regulations when performing their functions (r 4(2)).
• Removal of vehicles: A warden may remove a vehicle left in contravention of obstruction rules and the relevant authority can recover the cost from the owner as a debt due to the relevant authority (r 9(3)-(4)).
• Seizure and disposal of animals: If an unprotected animal is in an area without written permission or not under control, a warden or authorised person may capture and sell or otherwise dispose of the animal or destroy it (r 23(1)(c)-(d)). Costs of capture and disposal are a debt due by the owner to the Crown and the animal will not be returned until costs are paid (r 23(2)-(3)). If sold, the Crown is entitled to the excess proceeds (r 23(4)).
• Seizure and impoundment of property: Vehicles or personal property abandoned or left unattended for more than 24 hours may be seized and impounded (r 29(3)). The owner may be required to pay seizure and impoundment costs before retrieving property (r 29(4)). If the owner does not pay or collect within one month of notification, the relevant authority may sell or otherwise dispose of the property (r 29(5)-(6)).
• Notices and signage compliance: Contravening a direction given by notice or sign is an offence with the usual maximum penalty and expiation fee (r 32). Failure to comply with a reasonable direction of a warden is likewise penalised (r 33). This expands enforcement from positive prohibitions to obedience to administrative directions on site.

Administration of penalties:

• Expiation scheme: The regulations provide expiation fees for many offences, permitting on-the-spot or administratively processed penalties in lieu of prosecution. The regulations themselves list the expiation fee amounts for each offence. The presence of expiation fees suggests an administrative enforcement pathway for many contraventions; the text, however, does not set out procedural rules for expiation notices , those would be governed by the broader South Australian expiation framework outside these regulations.
• Debt recovery: Costs associated with removal, seizure or destruction are recoverable as debts to the Crown (r 9(4), r 23(2), r 29(4)). That provides the relevant authority an alternative monetary enforcement mechanism beyond fines.

Constraints and exceptions for enforcement:

• Mining tenements and proclamations: Several enforcement prohibitions are expressly subject to rights under mining tenements and proclamations under Part 3 Division 2 of the Act (e.g. r 16, r 24(2), r 27(2), r 29(2)), meaning enforcement action that would interfere with such rights is limited by those statutory legal interests.
• Commonwealth aviation law: The aircraft provisions operate subject to any contrary Commonwealth law (r 10(4)). Enforcement in relation to aircraft will therefore need to respect federal aviation regulation.
• Defence for emergency action: There is a statutory defence where a defendant proves action was taken in response to an emergency and was reasonable in the circumstances (r 35), which may limit enforcement in exigent situations.

Practical enforcement consequences:

• Administrative discretion plus on‑the‑ground powers: The combination of discretionary written permissions (r 34), Gazette setting aside and closures (r 7, r 8, r 26), and on-site enforcement by wardens (r 9, r 23, r 29) means the practical enforcement model is a mix of pre-approval control and reactive on-the-ground policing.
• Financial exposure: Owners of animals, vehicles and property can face immediate financial costs (capture, removal, impoundment) recoverable as debts and possible loss of property via sale after the statutory period (r 23(2), r 29(4)-(6)).
• Higher penalties for certain environmental harms: Declared fossil or geomorphological sites attract substantially higher penalties, signalling prioritisation of geological and palaeontological protection in enforcement.

The regulations operate as subordinate legislation under the Wilderness Protection Act 1992 (the Act) and are cross-referenced to and constrained by several other statutory regimes. The instrument embeds specific statutory interlocks that affect both rights and enforcement.

References to the Act and co‑management:

• The regulations sit under the Act and consistently cross-reference statutory concepts and powers in the Act, such as co‑management agreements and Part 3 Division 4 arrangements. The definition of “relevant authority” ties directly to co‑management boards established under the Act (r 3). The regulations also provide that if a co‑management board is suspended under the National Parks and Wildlife Act 1972 (s 43I as that section applies under s 33A of the Act), the Director becomes the relevant authority (r 3(2)). Thus the regulations coordinate with the Act’s institutional architecture.

Interaction with the National Parks and Wildlife Act 1972:

• Definitions such as “protected animal” and “take” are taken from the National Parks and Wildlife Act 1972 (r 3). The regulations recognise Aboriginal customary-taking rights under s 68D of that Act by excluding Aboriginal persons from certain prohibitions in respect of firearms and devices for taking animals (r 17(2), r 22(2)). This makes Aboriginal customary rights a mirrored legal exception within the regulations where the National Parks and Wildlife Act provides statutory authority.

Preservation of mining rights under the Act:

• Several provisions are expressly made subject to the rights of persons pursuant to mining tenements and proclamations under Part 3 Division 2 of the Act (see r 16, r 24(2), r 27(2), r 29(2), r 17(3)). Those cross-references ensure that established mining tenements and proclamations retain effect and limit the application of specific prohibitions within the wilderness protection areas where those tenements apply. Practically, that means enforcement officers must check whether a mining tenement or proclamation authorises an activity rather than assuming unilateral prohibition by these regulations.

Commonwealth aviation law:

• The regulation prohibiting aircraft use (r 10(1)-(3)) is expressly “subject to any law of the Commonwealth to the contrary” (r 10(4)). Aviation is a federal competence; the regulation therefore signals that where Commonwealth law permits or regulates an activity differently, that federal regime will take precedence or operate concurrently.

Motor Vehicles Act 1959:

• “Motor vehicle” has the same meaning as in the Motor Vehicles Act 1959 (r 3). Speed limits and driving offences in r 9 are therefore made in the context of the Motor Vehicles Act’s definitional framework and potentially other motor-vehicle regulatory regimes.

Expiation and administrative enforcement frameworks:

• While the regulations specify expiation fees and maximum penalties, they do not themselves set out the procedural machinery for issuing expiation notices or prosecuting offences. Those processes are generally governed by broader South Australian expiation and criminal procedure statutes. The practical application of expiation fees will therefore be subject to those external administrative frameworks.

Property and debt recovery:

• The regulations convert certain enforcement costs into debts due to the Crown (r 9(4), r 23(2), r 29(4)). That interacts with statutory debt-recovery processes and broader public finance rules on the collection of Crown debts.

Limitations and carve-outs:

• The regulations do not apply to co‑managed wilderness protection areas or zones that are constituted of Aboriginal‑owned land (r 4(1)), creating an explicit statutory carve-out that interacts with Aboriginal land tenure and co‑management arrangements under the Act.
• Wardens and Department employees are exempt from the regulations when performing their functions (r 4(2)), which interacts with public employment law and the operational duties of staff employed under the Act.

Taken together, the regulations are interleaved with existing state and Commonwealth statutory regimes. Those interlocks create legal priorities (for example, Commonwealth aviation law, mining tenement rights, Aboriginal customary-taking rights) that must be checked when applying the regulations on the ground.

The text provided shows the regulations were made in 2021 and commenced the day they were made (r 2). The legislative history at the end of the instrument records the principal regulations as 2021 No. 112, Gazette 5.8.2021 p2962, with commencement on 5 August 2021 (r 2). Schedule 1 explicitly revokes the Wilderness Protection Regulations 2006, stating “The Wilderness Protection Regulations 2006 are revoked” (Schedule 1, r 1). That revocation is the principal clear amendment action recorded in the instrument , the 2021 regulations replace the 2006 instrument in full.

The instrument also contains a number of cross-references to provisions of the Act and to the National Parks and Wildlife Act 1972 that bear on when certain institutional arrangements (such as co‑management boards) apply and who acts as the relevant authority (r 3, r 4). The regulations therefore incorporate the Act’s mechanisms for suspending co‑management boards (noted at r 3(2) referring to suspension under s 43I of the National Parks and Wildlife Act 1972 as applied under s 33A of the Act) and make the Director the fallback relevant authority in that situation.

No further amendments, amendments dates, or variation instruments are listed in the supplied legislative history. The instrument itself reserves significant administrative flexibility to the relevant authority (for example r 34 permits variation and revocation of permissions at any time and r 8 and r 26 contemplate future Gazette notices to set aside areas and declare fossil sites). That structure suggests the operational contours of the regulations were intended to be shaped by subsequent administrative actions (Gazette notices, permissions, area designations) rather than by frequent textual amendments to the regulations.

Because this legislative history section is limited to what is printed in the provided text, practitioners should note that the official public compilation of statutes (for example on legislation.sa.gov.au) or the Gazette could record subsequent amendments, revocations, ministerial approvals, or related instruments that post‑date the principal instrument. The 2021 instrument, however, is the operative text documented here and expressly rescinds the 2006 regulations.

The provided regulatory text and legislative history do not record any cases, judicial decisions, or administrative appeals concerning the Wilderness Protection Regulations 2021. No litigation history, reported decisions or interpretative rulings are included in the material supplied.

Practical implications for practitioners:

• Absence of recorded litigation in the instrument means there is no statutoryly recorded body of judicial interpretation to guide application of ambiguous provisions in the text provided. Users should therefore be cautious where the regulations leave substantial administrative discretion (for example, the grant and variation of permissions under r 34, closing under r 7, setting aside areas under r 8, and declaring fossil sites under r 26) because those discretionary powers commonly generate factual disputes that can proceed to administrative review or judicial review in practice.
• Where the regulations cross‑reference or incorporate definitions and rights from the National Parks and Wildlife Act 1972 and the Motor Vehicles Act 1959, relevant judicial interpretation in respect of those statutes (not provided here) may influence how the regulations are applied. For example, the meaning of “take” or the application of s 68D customary rights in the National Parks and Wildlife Act will be relevant to the regulations’ firearms and device exceptions (r 17, r 22).
• Given that the regulations allow the relevant authority to act by Gazette notice and to attach conditions and revocations to permissions, administrative law challenges are the most likely source of litigation: judicial review on grounds such as illegality, irrationality or procedural unfairness; and merits review where available. The supplied text, however, records no such cases.

If litigation history is material to a client or matter, the relevant next step is to search statute databases, tribunal and court judgments, and Gazette entries post‑dating the principal instrument to identify any contested administrative actions, prosecutions, or judicial decisions interpreting these regulations.

The regulations contain several features that create practical pitfalls for users, decision-makers and enforcers. The following items identify areas where errors, omissions or misunderstanding often generate legal or operational risk; each point refers directly to the text.

Broad and recurring written‑permission requirement:

• Many everyday activities require written permission from the relevant authority (see r 9-r 31). Practitioners should note that “permission” must be in writing (r 34(1)(a)) and may be conditional, varied or revoked at any time (r 34(1)(b)-(c)). Failure to carry written permission or to comply with conditions creates exposure to penalties. Relying on informal verbal permission is therefore high‑risk.

Discretion concentrated in the relevant authority:

• The relevant authority may set aside areas for specific activities, impose conditions, vary or revoke permissions and close areas for safety or fire risk (r 7, r 8, r 34). That concentration of discretion can produce unpredictability for commercial operators, event organisers and repeat users. Permissions published in the Gazette may apply generally (r 34(2)), but the default is individual written permissions that can be revoked.

Multiple statutory carve-outs and overlapping rights:

• The regulations repeatedly state that particular prohibitions are “subject to the rights of a person pursuant to a mining tenement and a proclamation under Part 3 Division 2 of the Act” (for example r 16, r 24(2), r 27(2), r 29(2)). Failure to check whether an activity falls within such a tenement or proclamation can lead to mistakenly denying or enforcing a right. Similarly, Aboriginal customary-taking rights under s 68D of the National Parks and Wildlife Act 1972 carve out certain activities for Aboriginal persons (r 17(2), r 22(2)). Co‑managed Aboriginal‑owned land is excluded from the operation of the regulations (r 4(1)). Practitioners must check land status, tenement records and co‑management arrangements before advising or enforcing.

Ambiguity about expiation procedure:

• The regulations specify expiation fees for offences but do not set out expiation procedures. That means the practical functioning of expiation notices, payment periods, and consequences for non-payment will depend on the broader South Australian expiation framework. Advisers should not assume outcome or process without reference to the expiation statute or practice.

Wardens exempt while performing functions:

• Wardens and Department employees are not subject to the regulations when performing their functions (r 4(2)). That creates a potential operational inconsistency where wardens can lawfully carry out acts that would otherwise be prohibited to visitors. Practitioners advising clients should identify whether an act was performed by an authorised warden in an enforcement or management capacity.

High penalties for declared geological sites:

• Destroying or disturbing a declared fossil or geomorphological site attracts a significantly higher maximum penalty ($15,000) and expiation ($1,500) compared with most other offences (r 26). Because the declaration power is exercised by Gazette notice (r 26(1)), persons active in areas with geological significance should proactively check Gazette declarations to avoid substantial penalties.

Costs recovered as debts to the Crown:

• The costs of removing vehicles, capturing and disposing of animals, and impounding property are recoverable as debts due to the Crown (r 9(4), r 23(2), r 29(4)). That exposes owners to immediate monetary recovery actions independent of criminal penalties. The relevant authority can also keep proceeds of sales beyond costs (r 23(4)), creating a financial exposure beyond fines.

One‑month disposal rule for impounded property:

• The relevant authority may sell impounded property if the owner does not pay or collect it within one month of notification (r 29(5)-(6)). Practitioners should note the short statutory period for reclaiming property.

Permissions may be Gazette‑published:

• Permissions can be made general or class‑based by Gazette publication (r 34(2)). That means that a single Gazette notice could authorise classes of activities without individual written permits. Failure to consult Gazettes may result in unnecessary permit applications or mistaken assumptions about prohibitions.

Overlap with Commonwealth aviation law:

• The aircraft rules are expressly subject to Commonwealth law (r 10(4)). Operators should check federal aviation rules and not assume state-level permission suffices for air operations such as low-altitude flights or aerial drops.

“Drive includes ride” and broad definitions:

• The definition of “drive includes ride” (r 3) can broaden the meaning of vehicle provisions to cover some recreational off-road uses. Likewise, “vessel” is defined to include a range of craft including hovercraft and sailboards (r 3). These definitional choices can extend regulatory coverage beyond common-sense expectations.

Warden qualifications include ministerial discretion:

• Prescribed qualifications for wardens include specific training (police, Border Force, customs) and “any other qualification approved by the Minister” (r 5(e)). That creates ministerial discretion over warden eligibility that may affect enforcement standards and administrative appeals.

Emergency defence is defendant’s burden:

• The defence in r 35 requires the defendant to prove they acted in response to an emergency and that the action was reasonable. That is a factual burden and may be difficult to establish on summary disposition; careful evidence-documentation is therefore important if relying on that defence.

Taken together, these structural features mean that compliance often turns on administrative facts (zone designations, Gazette notices, existence of mining tenements, possession of written permissions), and operational missteps are easily created by failure to check those particulars.

Compliance under the Wilderness Protection Regulations 2021 primarily requires a mix of pre‑activity administrative checks, written permissions, observance of site-specific controls, and documentary retention. The following is a practical, section‑by‑section checklist-style approach grounded in the regulations.

1. Identify the relevant authority and land status (r 3, r 4)

• Check whether the area is co‑managed and whether it is constituted of Aboriginal‑owned land. If it is co‑managed and Aboriginal‑owned, the regulations do not apply (r 4(1)). If co‑management is in place but not suspended, the co‑management board is the relevant authority; if suspended, the Director is the relevant authority (r 3(2)). Confirm which body issues permissions and Gazette notices.

2. Check Gazette notices and plan of management (r 7, r 8, r 26, r 34(2))

• Before planning an activity, search the South Australian Government Gazette and the relevant authority’s published information to identify area openings/closures, parts set aside for specific uses, and any declared fossil or geomorphological sites. Permissions may be published in the Gazette to apply generally to particular classes (r 34(2)). Also check the plan of management for closures referenced at r 7(2)(d).

3. Obtain written permission where required and keep records (r 34)

• For activities listed as requiring permission (driving off set-aside roads r 9, camping outside set-aside camps r 12, fires subject to bans r 13, chainsaw use r 14, generator use r 15, metal detectors r 16, firearms r 17, cave access r 19, certain recreational activities r 20, public gatherings and loudspeakers r 31, and other items across r 9-r 31), apply to the relevant authority for written permission. Keep the written permission on-person when conducting the activity, and comply with any conditions. Remember permissions may be varied or revoked at any time (r 34(1)(c)), so inquire whether pre-existing permissions remain in force close to the activity date.

4. Pay prescribed fees (r 6, r 12)

• Pay any entry fees fixed by the relevant authority before entering (r 6) and any camping fees for designated campsites (r 12(2)). Failure to pay is an offence (r 6) with an expiation fee of $150.

5. Adhere to site designations and stay on set-aside tracks and camps (r 8, r 9, r 12)

• Drive only on roads or tracks set aside by the relevant authority (r 9(1)), and comply with speed limits as fixed by the relevant authority or the default 40 km/h (r 9(2)). Camp only in areas set aside (r 12(1)). Do not obstruct tracks with vehicles (r 9(3)); a warden may remove obstructing vehicles and recover costs (r 9(4)).

6. Observe fire rules and fuel/wood collection limitations (r 13)

• Check for fire bans or restrictions (r 13(1)). Do not collect or use onsite wood for fires unless permission is granted (r 13(2)). If you light or use a fire, do not leave it unattended (r 13(3)).

7. Respect cave, fossil and geomorphological protections (r 19, r 25, r 26)

• Do not enter caves without permission and without the company of a warden or assistant (r 19(a)). Do not remove or displace rocks, minerals or fossils; do not touch speleothems (r 19(b)-(d)). Check for declared fossil or geomorphological sites (r 26(1)); damage to declared sites attracts a higher maximum penalty (r 26(2)).

8. Check for mining tenements and proclamations (r 16, r 24(2), r 27(2), r 29(2), r 17(3))

• If your planned activity involves metal detectors, plant removal, deposit of waste, or abandoned property, determine whether a mining tenement or proclamation applies; these statutory rights may permit activities otherwise restricted by the regulations.

9. For firearms, devices for taking animals and Aboriginal customary activities (r 17, r 22)

• If you are an Aboriginal person acting under s 68D of the National Parks and Wildlife Act 1972, certain prohibitions on firearms and devices for taking animals do not apply (r 17(2), r 22(2)). Non‑Aboriginal users must obtain written permission to possess or use such items.

10. Comply with signage and warden directions and retain proof of compliance (r 32, r 33)

• Pay attention to on‑site notices and displayed directions. Failure to comply is an offence. Where a warden gives a reasonable direction, comply; record and retain photographs or copies of permissions and signs where possible if an enforcement action occurs.

11. Avoid leaving vehicles or property unattended for more than 24 hours (r 29)

• If you must leave a vehicle or property for more than 24 hours, obtain permission. Otherwise you risk seizure, impoundment and debt recovery for costs (r 29(1), r 29(3)-(4)).

12. Prepare for enforcement and possible cost recovery (r 9(4), r 23, r 29)

• Understand that seizure, capture and removal costs may be recovered as debts. For owners of animals, property, or vehicles, budget for possible immediate costs and be ready to collect items within one month of notification to avoid sale or disposal by the relevant authority (r 29(5)-(6)).

13. Ensure welfare and emergency preparedness (r 35)

• If your activity could reasonably trigger an emergency response, plan to demonstrate that any emergency action taken was reasonable. Keep contemporaneous records and witness statements where possible to support the emergency defence (r 35).

14. Commercial operators and organisers: apply early, expect conditions and revocations (r 31, r 34)

• Commercial operators, organisers of public events, film crews and similar users should apply well in advance, because permissions may be conditional and revocable and may require compliance with site management plans, safety protocols, and limiters imposed by the relevant authority.

15. Maintain insurance and safety documentation

• While the regulations do not prescribe insurance, reasonably careful operators should maintain public liability insurance, risk assessments, emergency contact plans and evidence of training for staff or guides, including established warden-approved qualifications where relevant.

16. Consult multiple legal layers for aircraft and motorised craft (r 3, r 10, r 11)

• For aircraft and drone operations, check Commonwealth aviation law as well as these regulations (r 10(4)). For motor vehicles, the Motor Vehicles Act definitions and obligations are relevant (r 3).

17. Check for co‑management board procedures

• If the area is co‑managed, contact the co‑management board for the specific application procedures, forms, and conditions they apply. If a co‑management board is suspended and the Director is the relevant authority, applications should be routed accordingly (r 3(2)).

This compliance checklist is intended to be operational: confirm land status and relevant authority, check Gazette notices and plans of management, obtain and carry written permissions where required, pay fees, comply with all conditions and signage, and be prepared for enforcement actions that can convert contraventions into immediate monetary debts to the Crown. Where any doubt exists about the interaction with mining tenements, Aboriginal rights or Commonwealth aviation law, obtain legal or administrative confirmation prior to conducting the activity.
