sec.28 Activities with minor and inconsequential impact
A person may carry out an activity in the wet tropics area that— causes no more than minor and inconsequential destruction of a forest product; and has no more than a minor and inconsequential adverse impact on the world heritage values and integrity of the area; and causes no more than minor and inconsequential interference with earth or a watercourse. The following activities, for example, could reasonably be carried out on the land in a way that complies with subsection (1) — maintaining a residence; maintaining the following things around a residence—a structure, garden, lawful access road or small clearing; driving a vehicle off a road to the extent necessary to get around an immovable obstacle on the road; bushwalking in the area; taking water from a watercourse for personal consumption while in the area. However, subsection (1) does not allow a person to— fly a motorised aircraft less than 1,000ft above the area, or land a motorised aircraft, for commercial purposes; or reconfigure a lot, if the reconfiguration would be assessable development for which a local government would be the assessment manager. For subsection (1) , the authority may prepare guidelines about activities that may be carried out in a way that complies with subsection (1) . If the authority prepares guidelines under subsection (4) , the authority must ensure the guidelines are available for inspection under section 4 . s 28 amd 2020 SL No. 176 s 16 (sec.28-ssec.1) A person may carry out an activity in the wet tropics area that— causes no more than minor and inconsequential destruction of a forest product; and has no more than a minor and inconsequential adverse impact on the world heritage values and integrity of the area; and causes no more than minor and inconsequential interference with earth or a watercourse.
