Western Australian Sports Centre Trust (Traffic) Regulations 2017

The instrument rests on a small set of legal concepts and operational mechanisms. These are the Trust as regulator of its venues, the traffic management officer as the operative enforcer, the designation of parking areas and conditions by signage, a permit system, a suite of parking and driving offences, vehicle removal and cost recovery, and an infringement/modified-penalty framework.

Trust designation and signage: Regulation 5 allows the Trust to use signs and road markings to create legal designations. A designation can permit or prohibit parking, restrict parking to classes of vehicles or certain persons, or prohibit standing entirely (regulation 5(1)(a)-(e)). When making a designation the Trust may set conditions including times and maximum periods (regulation 5(2)). The regulations require signs or road markings to "clearly indicate" the designation and any conditions (regulation 5(3)). The legal effect attaches to the combination of physical signage/marking and the regulation; a traffic management officer may override designations in a particular instance by permitting parking outside a parking area subject to conditions (regulation 5(4)).

Traffic management officers: The operational enforcement role is vested in traffic management officers, defined as persons who are authorised officers under section 18C(2) of the Act (regulation 3). These officers can give binding directions about parking and driving at a venue (regulation 8(1)), require name and address where there are reasonable grounds of an offence (regulation 15(1)), remove vehicles (regulation 9(1)-(3)), and serve infringement notices on the prescribed forms (regulation 13). The regulations provide procedural protections: failure to comply with a direction or requirement is an offence unless the traffic management officer failed to inform the person that non-compliance constituted an offence (see regulation 8(3) and regulation 15(3) , a procedural condition which negates liability when notice was not given).

Parking permits: The Trust may issue parking permits in the form of stickers or documents (regulation 6(1)). Permits may be conditional and subject to fees set by the Trust (regulation 6(2)). Conditions may be tailored by vehicle, area or time (regulation 6(3)). Permits have specified start dates and durations and can be cancelled under their own conditions (regulation 6(4)). Permit holders must display the permit in a prominent position at the front of the vehicle while parked in the relevant parking area (regulation 7(3)).

Offences, penalties and modified penalties: The regulations create a conventional two‑tier enforcement design. Each substantive offence has a court penalty (usually a fine of $1,000 as indicated in the relevant subregulation penalty notes; see regulation 7(1) penalty and regulation 10). For certain parking offences and related procedural breaches the regulator has prescribed a lower "modified penalty" for on-the-spot or infringement notice disposal through Schedule 1 (regulation 12 and Schedule 1). The modified penalty for each listed offence in Schedule 1 is $100. Regulation 12 explicitly makes the Schedule 1 amount the modified penalty for the purposes of section 18C(4) of the Act.

Vehicle removal and cost recovery: A traffic management officer can remove vehicles parked in contravention or abandoned, transport them to storage approved by the Trust and take necessary actions including unlocking, driving and towing (regulation 9(1)-(3)). The Trust must keep a record of removals (regulation 9(2)), and may hold vehicles until the costs and expenses of moving and holding are paid (regulation 9(4)). The regulations do not set a schedule of allowable towing or storage charges; they simply permit recovery by holding the vehicle.

Procedural instruments and forms: The form of the infringement notice is prescribed in Schedule 2 Form 1 and the withdrawal form in Schedule 2 Form 2, and are made the prescribed forms for the purposes of section 18C(3) and section 18C(7) of the Act respectively (regulation 13). Form 1 contains procedural content such as the 28 day payment or withdrawal request period and explanatory text that, where the owner is served because driver identity cannot be immediately established, the owner is deemed the driver unless they pay, identify the driver or satisfy an authorised officer that the vehicle was stolen, within 28 days (Schedule 2 Form 1 text).

Venue limitation and definitions: The regulations apply only to the venues listed in regulation 4(1). Regulation 3 defines key terms used throughout the instrument including "parking area", "parking permit", "traffic management officer", and "disability parking permit", the last being a specific document issued by National Disability Services Limited consisting of an Australian Disability Parking Permit and an ACROD Parking Program Card (regulation 3). Emergency vehicle is defined by reference to the Road Traffic (Vehicles) Regulations 2014 regulation 226 (regulation 3).

Together these concepts structure a site-specific parking and traffic enforcement regime that combines signage-based rules, permit-based variations, authorised-officer discretion and an infringement/modified-penalty route for lower-cost enforcement.

The regulations allocate regulatory roles and direct legal obligations and liabilities to a discrete set of actors. The primary actors affected are the Trust, traffic management officers, drivers and vehicle owners or persons in charge of vehicles at the listed venues, permit holders, and indirectly venue users and contractors such as tow operators.

The Trust: As owner/operator under the Act, the Trust gains specific regulatory functions. It may determine which areas of a venue are parking areas, permit particular classes of vehicles or persons, set conditions and maximum periods, erect signs and road markings, issue parking permits, approve storage places for removed vehicles and impose fees on permits (regulations 5, 6 and 9(1)). The Trust also has a record-keeping duty for removed vehicles (regulation 9(2)). The Trust decides, by signage and permit terms, what conduct is permitted in each area; this creates the primary point of decision-making about on-site parking regimes (regulation 5).

Traffic management officers: Persons appointed as authorised officers under the Sports Centre Trust Act and specified as traffic management officers by regulation 3 have operational control. They can direct drivers to comply or not comply with a regulation, permit parking outside designated areas (regulation 5(4)), remove vehicles, require name and address, and serve infringement notices on the prescribed forms (regulations 8, 9, 13, 15). Their discretionary choices determine immediate outcomes. Operationally this concentrates decision-making at the level of authorised officers.

Drivers and vehicle users at venues: Drivers at the listed venues must comply with signage, road markings and the directions of traffic management officers (regulation 7 and regulation 8). Specific obligations include parking entirely within a single bay where bays are designated (regulation 7(2)), not parking on pedestrian crossings or footpaths (regulation 7(1)(c)), not parking in disability bays unless a qualifying disabled person is present and an approved disability parking permit is displayed as required by regulation 7(1)(d). Drivers must also display any parking permits at the front of the vehicle while parked (regulation 7(3)). Failure can attract an on‑the‑spot modified penalty or prosecution.

Owners and persons in charge: Where an infringement notice is served under section 18D(1)(b) of the Act by leaving it on or attaching it to a vehicle, regulation 14 makes it an offence for anyone other than the driver, owner, person in charge, or a traffic management officer to remove the notice. Schedule 2 Form 1 contains further consequences: when the identity of the driver is not immediately established, serving the notice on the owner may result in the owner being deemed the driver if they do not pay the modified penalty, identify the driver to an authorised officer, or demonstrate theft or unlawful use within 28 days (Schedule 2 Form 1). This shifts a procedural burden onto vehicle owners in those circumstances.

Permit holders: Persons to whom the Trust issues parking permits are subject to permit conditions (regulation 6). They must display the permit in a prominent position at the front of the vehicle when parking in the relevant area (regulation 7(3)). The Trust can set fees and cancel permits in accordance with conditions (regulation 6(2)(b) and 6(4)).

Venue users with disabilities: The regulations provide a specific protection for disability parking spaces. Regulation 7(1)(d) prohibits parking in spaces designated for people with disabilities unless a qualifying person is a driver or passenger and a disability parking permit (as defined in regulation 3) is displayed in a prominent position at the front of the vehicle. The defined term specifies the form and issuer of that permit (National Disability Services Limited documentation) (regulation 3).

Tow and storage operators: The Trust is authorised to remove vehicles and cause them to be moved to storage approved by the Trust (regulation 9). Tow operators or storage facilities will be engaged operationally, and the Trust may retain vehicles until the owner pays the associated costs (regulation 9(4)). Although fees and charges are not prescribed in the regulations, the power to hold the vehicle serves as a collection mechanism.

Other public authorities and emergency services: Emergency vehicles are expressly excluded from these restrictions when acting in the course of duty and when it is expedient and safe to do so (regulation 11). The definition of emergency vehicle is sourced to the Road Traffic (Vehicles) Regulations 2014 (regulation 3). No other public authorities are directly identified in the text as having special roles.

Overall, the regulations allocate decision-making power to the Trust and authorised officers while making drivers, owners and permit holders liable for compliance and, where served with an infringement notice as owner, for prompt response or payment as detailed in Schedule 2 Form 1.

The regulations create discrete duties for the Trust, traffic management officers, permit holders, drivers, and vehicle owners, and they grant procedural rights in the infringement process. The duties and rights are primarily expressed in regulatory obligations, signage requirements, permit display duties, record keeping and notice procedures.

Trust duties and rights:

• Determine and mark parking designations. The Trust may designate parking areas and set conditions by sign or road marking (regulation 5(1)-(3)). When designating, the Trust may determine times and maximum parking periods (regulation 5(2)(c)-(d)).
• Issue and condition parking permits and charge fees. The Trust may issue parking permits subject to any condition and may charge a fee if it thinks fit (regulation 6(1)-(2)). It may determine conditions about vehicles, parking areas and permitted times (regulation 6(3)).
• Approve storage places for removed vehicles and keep records. When vehicles are removed, the Trust must cause a record of the removal to be kept including description, dates/times, and places of removal and storage (regulation 9(2)). The Trust may hold vehicles until costs are paid (regulation 9(4)).

Traffic management officers’ duties and rights:

• Give directions to regulate traffic. Officers may direct drivers to do or not do something in the officer’s reasonable view necessary for regulating traffic at a venue (regulation 8(1)). A person must not fail to comply without reasonable excuse (regulation 8(2)).
• Permit parking outside parking areas. Officers can permit drivers to park in places that are not parking areas, subject to conditions (regulation 5(4)).
• Remove vehicles. Officers may remove vehicles parked in contravention or abandoned and may take necessary action including unlocking, driving or towing (regulation 9(1), (3)).
• Serve infringement notices and require name/address. Officers are the operational enforcers for serving infringement notices and may require a person’s name and address where there are reasonable grounds to believe an offence occurred (regulation 13 and regulation 15).

Driver and vehicle user duties:

• Obey signage and directives. Drivers must not park contrary to a sign or road marking (regulation 7(1)(a)), and must obey directions from traffic management officers except where an officer failed to inform that non‑compliance constitutes an offence (regulation 8(3)).
• Park considerately. Drivers must not park in a way that obstructs or is likely to obstruct another vehicle, must not park on pedestrian crossings or footpaths, and must not occupy disability parking bays unless eligible and the disability parking permit is displayed (regulation 7(1)(b)-(d)).
• Position vehicles correctly. Where parking bays are designated, the vehicle must be completely within a single bay (regulation 7(2)).
• Display permits. Permit holders must display their parking permit in a prominent position at the front of the vehicle while parked in the parking area (regulation 7(3)).

Owners’ procedural obligations and rights:

• Owners can be served via an infringement notice left on the vehicle. The prescribed infringement form includes a procedure whereby if driver identity is not immediately established the notice may be served on the owner and the owner will be deemed the driver unless they either pay, identify the driver to an authorised officer or satisfy an authorised officer that the vehicle was stolen or unlawfully used within 28 days (Schedule 2 Form 1). This creates both a potential obligation to pay or identify and a right to make a written request for withdrawal or to pay the modified penalty.
• Restrictions on removal of infringement notice. A person must not remove an infringement notice left on or attached to a vehicle unless they are the driver, owner, person in charge or traffic management officer (regulation 14). This is a legal duty; non-compliance is a criminal offence with a $1,000 fine for the principal regulation provisions and $100 modified penalty under Schedule 1 for r14.

Rights in the enforcement process:

• Right to pay modified penalty to avoid prosecution. Form 1 specifies a 28 day payment window to pay the modified penalty to an authorised officer to avoid being prosecuted (Schedule 2 Form 1).
• Right to request withdrawal within 28 days. Form 1 advises that if the person considers there is good reason the notice should be withdrawn, they can write to an authorised officer requesting withdrawal within 28 days and setting out reasons (Schedule 2 Form 1).
• Right to have notice withdrawn and refund. Form 2 provides the mechanism and formality for an authorised officer to withdraw an infringement notice and to specify refund procedures where the modified penalty has already been paid (Schedule 2 Form 2).

Procedural safeguards affecting liability:

• Informative duty by traffic management officer. A person does not commit an offence for failing to comply with a direction or failing to give name and address if, when the direction or requirement was given, the traffic management officer did not inform the person that failure to comply constituted an offence (regulation 8(3) and regulation 15(3)). This creates an evidentiary and procedural obligation on officers seeking to prosecute non-compliance.

Other duties:

• Avoid obstructing traffic management officers. It is an offence to obstruct an officer performing functions under the regulations (regulation 16).
• Do not impersonate. It is an offence to pretend to be a traffic management officer (regulation 17).

In summary, the instrument places regulatory control in the hands of the Trust and authorised officers, confers rights to use the infringement and modified penalty process, sets procedural constraints on enforcement (notably the requirement to inform persons that non-compliance is an offence), and imposes explicit duties on drivers, permit holders and vehicle owners with respect to signage, permit display, positioning and response to notices.

The regulations set a dual enforcement pathway: on-the-spot or administrative enforcement through modified penalties, and court-based prosecution with higher maximum fines. Enforcement powers are operationalised through traffic management officers and backed by vehicle removal and procedural mechanisms in the prescribed forms.

Penalty structure:

• Court penalties: Many of the substantive offences carry a stated penalty note of a fine of $1,000 in the relevant subregulation. For example, regulation 7(1) , prohibitions on parking contrary to signs, obstructive parking, parking on crossings or footpaths and misuse of disability parking , bears a penalty of $1,000. Regulation 7(2) on positioning within a parking bay is punishable by a fine of $1,000. Regulation 7(3) for failure to display a parking permit also carries a $1,000 penalty note. Driving offences in regulation 10 carry a fine of $1,000. Regulation 14 provides a penalty of $1,000 for removing an infringement notice left on or attached to a vehicle except in permitted circumstances. Regulation 16 and regulation 17 (obstruction and impersonation of traffic management officers) carry a penalty of $1,000.
• Modified penalties: Schedule 1 lists the modified penalties for specific offences as $100 each. Regulation 12 makes the Schedule 1 amount the modified penalty for the purposes of section 18C(4) of the Act. The offences listed in Schedule 1 are closely aligned with the parking offences in regulation 7 and the r14 offence of removing an infringement notice. Thus, enforcement can proceed by serving an infringement notice in the prescribed form and seeking payment of $100 rather than prosecuting for up to $1,000.

Infringement notice procedure:

• Prescribed forms: Regulation 13 prescribes Schedule 2 Form 1 as the infringement notice form for section 18C(3) of the Act and Schedule 2 Form 2 for withdrawal under section 18C(7). Form 1 contains the mechanics for service, the statement about modified penalty payment within 28 days, the ability to seek withdrawal, and the deemed-owner provisions when driver identity cannot be immediately established (Schedule 2 Form 1).
• Service methods: Form 1 contemplates service in person or by leaving the notice on or attaching it to the vehicle. Regulation 14 makes it an offence to remove such a notice unless the person is the driver, owner, person in charge, or a traffic management officer.
• Deemed liability for owners: Schedule 2 Form 1 provides that where a notice is served on the owner due to unknown driver identity, unless the owner either pays, identifies the driver to an authorised officer or satisfies the authorised officer about theft/unlawful use within 28 days, the owner is deemed to be the driver. This is a procedural mechanism that enables enforcement where the driver cannot be immediately identified.

Enforcement actions and recovery:

• Directions and compliance: Traffic management officers can give directions to regulate traffic (regulation 8). Non-compliance without reasonable excuse is an offence (regulation 8(2)), but liability is negated if the officer failed to inform the person that failure to comply was an offence (regulation 8(3)).
• Vehicle removal and cost recovery: Officers can remove vehicles believed to be parked in contravention or abandoned, place them in Trust‑approved storage and take necessary actions (including towing) (regulation 9(1), (3)). The Trust must keep records of removals (regulation 9(2)). The Trust may hold removed vehicles until costs and expenses of moving and holding are paid (regulation 9(4)). The regulations do not prescribe the quantum of those costs but empower retention as a collection mechanism.
• Restriction on removing notices: Regulation 14 contains a specific offence of removing an infringement notice attached to a vehicle by someone other than driver, owner, person in charge or traffic management officer. Schedule 1 prescribes a modified penalty of $100 for that offence.

Procedural constraints and evidentiary points:

• Informational requirement when giving directions or requiring name and address: Under regulation 8(3) and regulation 15(3), a person does not commit the offence of non‑compliance if the traffic management officer did not inform the person that failure to comply constituted an offence. This procedural requirement can be an evidentiary defence to a charge under those provisions.
• Prescribed forms: Since the forms are prescribed by regulation 13, any procedural defects in the form may affect the validity of an infringement notice. Form 1 contains an express notice and 28 day timeline. The regulations do not prescribe further administrative review or appeal mechanisms beyond the standard options in the infringement pathway as set out in the form.

Practical enforcement landscape:

• The enforcement regime is designed to be low-cost and administratively simple for parking contraventions, using $100 modified penalties for common infractions rather than moving immediately to prosecution with higher fines. For more serious or contested matters the Trust retains the power to prosecute, with maximum fines up to $1,000 specified in the substantive regulation notes.
• Operational enforcement is concentrated in the authorised officers, who exercise discretion about directions, permitting of otherwise prohibited actions and issuance of infringement notices (regulation 5(4), regulation 8, regulation 13). The regulations include record-keeping requirements for vehicle removals (regulation 9(2)), and give the Trust a retention mechanism to recover towing and storage costs (regulation 9(4)).

In short, the regulations deploy a mixed administrative and prosecutorial enforcement model that relies on authorised officers to exercise discretion, uses a modest modified penalty to resolve most parking breaches and preserves court prosecution as a higher‑penalty alternative.

The regulations are expressly framed as subordinate to and operating under the Western Australian Sports Centre Trust Act 1986 and make cross‑references to other instruments for definitions and enforcement context. The interaction points in the text are primarily twofold: reliance on the Sport Centre Trust Act for the definition and powers of authorised officers and on other traffic legislation for technical definitions.

Reliance on the parent Act , authorised officers and infringement framework:

• The term traffic management officer is defined by reference to section 18C(2) of the Western Australian Sports Centre Trust Act 1986 (regulation 3). Regulation 13 confirms that Schedule 2 Form 1 is the prescribed form for an infringement notice "for the purposes of section 18C(3) of the Act" and that Form 2 is the prescribed form for withdrawal under section 18C(7) of the Act. Regulation 12 directly links the modified penalties in Schedule 1 to section 18C(4) of the Act. The form in Schedule 2 also incorporates the Act’s service mechanics under section 18D(1)(b) where an infringement notice can be left on a vehicle and served on the owner where the driver cannot be identified. Thus the regulations implement and operationalise the Act’s authorised‑officer and infringement notice powers. Any procedural or jurisdictional limits in the Act will therefore apply to enforcement under these regulations. The regulations do not, on their face, create independent authorised‑officer status; they assume a power that originates in the Act.

Cross-reference for the meaning of emergency vehicle:

• Regulation 3 adopts the definition of emergency vehicle from the Road Traffic (Vehicles) Regulations 2014 regulation 226. The practical effect is that exemption for emergency vehicles in regulation 11 is coextensive with the definition used in the Road Traffic (Vehicles) Regulations 2014. The regulations do not repeat the underlying definition; they rely on that separate instrument.

Potential interface with broader road and traffic law:

• The instrument regulates vehicle use, parking and driving on Trust venues but it does not purport to amend or displace other road traffic laws that apply more generally in Western Australia. The regulations do not themselves set out how they sit with the Road Traffic Code or local government by‑laws. They do, however, create parallel criminal offences and administrative penalty mechanisms for activities on Trust venues; where the same conduct could constitute an offence under general road traffic law, both regimes might be applicable in particular fact patterns. The regulations do not include a non‑duplication clause. Any interaction with the Road Traffic Act, local council parking regimes or other state instruments would depend on the overlapping subject matter and the applicable enforcement powers in those instruments. The text provided does not specify which instrument takes precedence in cases of overlap.

Service and evidence interactions:

• Schedule 2 Form 1 explicitly treats service by leaving a notice on a vehicle and the consequential deeming that may attach to an owner where the driver is not identified. These mechanics interact with the Act’s service provisions , the form is expressly prescribed "for the purposes of section 18C(3) of the Act" and the service method references section 18D(1)(b) of the Act. The availability of this vehicle-attached service mechanism thus depends on the underlying Act’s service regime.

Administrative law and procedural rights:

• The regulations require certain procedural steps by traffic management officers (such as informing people that failure to comply with directions or requirements to provide name and address would constitute an offence) for liability to attach (regulation 8(3), regulation 15(3)). These procedural constraints will interact with principles of administrative fairness and procedural regularity in any review or court challenge, but the regulations themselves do not set out a separate internal review scheme for decisions like permit revocation, refusal to withdraw an infringement notice or vehicle detention. The prescribed forms provide an administrative avenue for withdrawal requests to an authorised officer (Schedule 2 Form 1), and Form 2 documents official withdrawal and refund.

Amendment and venue listing:

• Regulation 4 lists the venues to which the regulations apply and contains a special operative rule that a change to the name of a listed facility does not affect the regulations’ application (regulation 4(2)). Amendments to regulation 4 have been made (see compilation table), indicating that the list of venues has been updated by later instrument(s). The mechanism for altering venue coverage is therefore amendment of the regulations themselves.

In sum, these regulations are designed as a site-specific overlay that leverages the enforcement and authorised-officer architecture of the Sports Centre Trust Act and borrows definitions from other traffic rules. Any legal analysis of conflicts, duplication or primacy with other road or parking laws must begin with the Act’s delegation and the functional limits of authorised officer powers, and then compare overlapping provisions in other traffic legislation. The text provided prescribes the linkages to the Act (sections 18C and 18D as cited) and to the Road Traffic (Vehicles) Regulations 2014 for the emergency vehicle definition.

The compilation table appended to the regulations records three instruments in the legislative history and identifies the commencement dates for the initial instrument and subsequent amendments. The materials in this compilation are the authoritative record of the regulations as at the latest compilation.

Original instrument:

• Western Australian Sports Centre Trust (Traffic) Regulations 2017 were published 18 August 2017. Regulations 1 and 2 (citation and commencement) commenced on 18 August 2017; the remainder commenced on 19 August 2017, i.e., the day after publication (compilation table entries and regulation 2).

Subsequent amendments recorded:

• Western Australian Sports Centre Trust (Traffic) Amendment Regulations 2017 were published 22 December 2017 and came into operation with regulations 1 and 2 on 22 December 2017 and other regulations on 23 December 2017 (compilation table). The text shows a footnote at regulation 4 indicating that regulation 4 was amended: "Regulation 4 amended: Gazette 22 Dec 2017 p. 5994". Regulation 4 is the venue list. The compilation records the existence and commencement of that amendment; the present text of regulation 4 includes facilities with added lettered paragraphs such as (ea) and (ha) that reflect later insertions or reordering.

• Western Australian Sports Centre Trust (Traffic) Amendment Regulations 2023 (SL 2023/124) were published 9 August 2023 with regulations 1 and 2 commencing on that date and the remainder on 10 August 2023. The compilation table notes the 2023 instrument entry SL 2023/124 with commencement details. Regulation 4 contains the bracketed citation "[Regulation 4 amended: Gazette 22 Dec 2017 p. 5994; SL 2023/124 r. 4.]" indicating that regulation 4 has been amended by both instruments.

Substantive visible changes:

• The compilation notes and the present text show an expanded list of venues in regulation 4(1) including facilities such as Optus Stadium (ea), State Football Centre (ha) and other named facilities. The bracketed note indicates that regulation 4 has been amended more than once. The regulations also contain a provision in regulation 4(2) that a change to the name of a facility does not affect application, which suggests the drafters anticipated future name changes.

No other amendments are recorded in the compilation table in the provided text. The compilation does not list any repeals, disallowances or other historic versions beyond these three entries. The dates and Gazette citations in the compilation table provide the formal amendment trail.

Practical consequence of the amendment history:

• The listing of venues has been updated through subordinate instruments since 2017, which demonstrates that the Trust’s jurisdictional footprint under these regulations is capable of being expanded or adjusted via amendment to regulation 4. The 2017 and 2023 amendments therefore appear to have been used to keep the venue schedule current. Regulation 4(2) also mitigates the need for amendment where a venue simply changes name.

If precise change‑by‑change tracking is required, practitioners should consult the Gazette notices referenced in the compilation table (the Gazette of 22 December 2017 p. 5994 and SL 2023/124) or the legislative database for amendment instruments to see the amending text and any explanatory notices. The compilation here confirms when each instrument commenced and which regulation(s) were amended.

The text provided is a statutory instrument and includes no judicial decisions, litigation references, or case law. The schedules and compilation table do not record any litigation history. There are no cases named in the regulations themselves.

Consequently, within the supplied source material there is no litigation history to analyse. The absence of recorded litigation in the instrument does not mean there has been no case law testing these regulations; it simply means the regulations and compilation do not include or summarise any judicial consideration. For any court decisions that interpret the regulations, authorised officer powers, the validity of particular signs, the procedural sufficiency of infringement notices or issues regarding vehicle removal and costs, an independent search of court databases and legal reporting services would be required. The current compilation contains only the statutory text, schedules and procedural forms and does not supply decisions or administrative reviews.

Where practitioners require litigation precedents relevant to enforcement action under these regulations, the recommended next step is to search Western Australian Magistrates Court and higher court databases for decisions referencing the Western Australian Sports Centre Trust (Traffic) Regulations 2017, or cases dealing with section 18C or 18D of the Western Australian Sports Centre Trust Act 1986, since those sections are engaged by the enforcement regime in these regulations.

The regulations are compact but several features create practical risks and procedural traps that users, permit holders and enforcement officers should note. Each "gotcha" below is grounded in the regulation text.

1. Divergence between maximum court fines and modified penalties:

   • The substantive offences commonly carry a maximum penalty of $1,000 where prosecuted (for example regulation 7(1) penalty note and regulation 10). However Schedule 1 sets the modified penalty at $100 for listed offences and regulation 12 ties that schedule to section 18C(4) of the Act. Practically this means an on-the-spot or served infringement is resolved at $100 but the same conduct could be prosecuted for up to $1,000. Parties should be aware that accepting the modified penalty resolves the matter without prosecution, but refusal or contest may expose the person to higher liability.

2. Owner-deemed liability where driver identity unknown:

   • Schedule 2 Form 1 contains a mechanism of service by leaving the notice on a vehicle and a deeming provision: if the driver cannot be immediately identified, the notice may be served on the owner, who then must either pay the modified penalty, identify the driver to an authorised officer, or show the vehicle had been stolen/unlawfully used within 28 days (Schedule 2 Form 1). If the owner does not do so, they are deemed to be the driver. This shifts responsibility to owners and increases exposure especially for fleet owners or rental agencies. Practitioners should note that the deeming step is contained in the prescribed form and is operative via the Act’s service mechanics cited in the form text.

3. Procedural protection that can defeat enforcement if not followed:

   • Regulations 8(3) and 15(3) provide that a person does not commit the offence of failing to comply with a direction or provide name/address if, when the officer gave the direction or requirement, the officer did not inform the person that failure to comply constituted an offence. This creates an evidentiary and procedural trap for authorised officers and prosecutors: omission to inform may preclude conviction under those specific provisions. Enforcement agencies should document that warning was given, and drivers should record whether the warning was given if contesting a charge.

4. Removing an infringement notice can itself be an offence:

   • Regulation 14 criminalises removing an infringement notice left in or on, or attached to, a vehicle except by the driver, owner, person in charge or a traffic management officer. Some persons may inadvertently remove a notice before reading it, which can generate a secondary offence. The modified penalty for r14 is $100 under Schedule 1. The risk is higher where multiple people use a vehicle or if a notice is obscured.

5. Broad discretion to authorise parking outside parking areas:

   • Regulation 5(4) gives traffic management officers the power to permit drivers to park in places that are not designated parking areas, subject to officer-imposed conditions. While useful for operational flexibility, this discretion can lead to inconsistent enforcement or disputes over whether permission was granted and on what terms. Officers should document permissions and conditions to prevent later disputes.

6. No schedule of towing/storage charges and retention until paid:

   • Regulation 9 permits removal and retention of vehicles until costs are paid but does not prescribe maximum towing or storage fees. This leaves room for dispute over the reasonableness and quantum of those charges, and it concentrates the Trust’s leverage over vehicle owners. Owners should obtain documentation of costs and may need to challenge excessive charges in court or by complaint.

7. Permit display requirement and cancellation risk:

   • Regulation 7(3) requires permit holders to display the person’s parking permit in a prominent position at the front of the vehicle, with a $1,000 penalty if prosecuted (and a $100 modified penalty listed for r7(3) in Schedule 1). The Trust may impose conditions on permits and cancel them under those conditions (regulation 6(2)(a) and 6(4)), which means permit holders should be careful to comply with permit terms to avoid losing the permit’s protection.

8. Narrow geographic application:

   • The regulations apply only to the venues listed in regulation 4(1); other Trust facilities not listed, or private car parks nearby, are outside this regulatory scope. Ensure that actions and signage are applied only within the legal boundaries of the listed venues, otherwise the Trust may have no jurisdiction. Regulation 4(2) preserves the regulations’ application even if a facility changes name.

9. Form-based substance:

   • The prescribed infringement and withdrawal forms contain substantive deeming and timing rules. Because the form is prescribed by regulation 13, any inaccuracy or failure to comply with form requirements in practice could affect the validity of enforcement action. Both officers and recipients should verify form compliance.

10. Emergency vehicle exemption:

• Regulation 11 permits emergency vehicles to stop, stand or park at any time where it is expedient and safe and in the course of duties. The definition of emergency vehicle is drawn from another instrument. Officers and owners should not seek to penalise emergency vehicles acting under that definition but note that the scope of that definition is determined elsewhere.

These "gotchas" highlight where procedural, evidentiary or drafting features of the regulations can materially affect enforcement outcomes, the distribution of liability between drivers and owners, and the margin for dispute over charges and permissions.

For venue operators (the Trust), traffic management officers, permit applicants/holders, drivers and vehicle owners, compliance requires clear signage, documented procedures, consistent permit administration, careful record-keeping for removals, and adherence to prescribed forms and officer obligations.

For the Trust and venue managers:

• Use clear, compliant signs and road markings. Regulation 5(3) requires that a sign or road marking used to designate an area "must clearly indicate" the designation and any conditions determined under regulation 5(2). Ensure all signage displays the permitted class, times, maximum periods and any conditions, and that markings are maintained and legible.
• Create documented permit conditions. When issuing parking permits under regulation 6(1)-(3) set explicit written conditions on vehicle class, area and permitted times, and record fee determinations under regulation 6(2)(b). Keep records of permit issue dates and expiry per regulation 6(4).
• Authorise and train traffic management officers. Ensure authorised officer appointments align with section 18C(2) of the Act and that officers are trained on the need to inform persons that a failure to comply with directions or to provide name/address will constitute an offence where this information is required for subsequent prosecution (regulation 8(3), regulation 15(3)). Officers should be instructed to provide that warning and to record evidence of having done so.
• Establish documented procedures for granting ad hoc permissions. Since regulation 5(4) allows officers to permit parking outside designated areas subject to officer-imposed conditions, require officers to provide written or electronic records of such permissions and the conditions attached to them to avoid inconsistent enforcement.
• Maintain towing and storage approval and records. Regulation 9 requires records of removed vehicles and allows holding until costs are paid. Pre‑qualify storage facilities, document fees and ensure removal records include vehicle description, dates and places of removal and storage (regulation 9(2)). Be prepared to substantiate costs taken to recover towing and storage charges.

For traffic management officers:

• Use prescribed forms and follow the Act. Serve infringement notices on Schedule 2 Form 1 as required by regulation 13. When leaving a notice on a vehicle (service under section 18D(1)(b) as referenced in Form 1), ensure the notice is attached in accordance with the Act and the form. Complete all form fields and retain copies.
• Deliver procedural warnings. When requiring a name and address or giving directions under regulation 8 and regulation 15, inform the person that failure to comply is an offence to maintain prosecutorial options. Document that the warning was given.
• Record permissions and reasons for vehicle removal. When using the powers in regulation 5(4) and regulation 9(1), create contemporaneous records of the permission or the reasonable grounds for removal to support decisions about towing and storage.

For permit holders and applicants:

• Read and keep permit conditions. Know exactly which vehicle(s) and time windows the permit covers. Keep a copy of the permit and display it prominently at the front of the vehicle while parked in the permit area (regulation 7(3)).
• Monitor permit renewals and cancellations. Because permits can be cancelled under their conditions (regulation 6(4)), maintain administrative controls to renew or replace permits early where necessary and to respond promptly to any notice of intended cancellation.

For drivers and vehicle owners:

• Observe signage and road markings. The Trust’s signs and road markings create the legal regime for the venue (regulation 5(3) and regulation 7(1)(a)). Ensure vehicles are parked within a single bay when bays are marked (regulation 7(2)).
• Do not use disability parking without entitlement. Only park in areas designated for people with disabilities if a qualifying person is present and a disability parking permit is displayed in a prominent position at the front of the vehicle (regulation 7(1)(d) and definition of "disability parking permit" in regulation 3).
• If served with an infringement notice, act within 28 days. Schedule 2 Form 1 makes clear that payment of the modified penalty must be made within 28 days to avoid prosecution, or a written request for withdrawal can be made within 28 days setting out reasons. If an owner receives the notice as the vehicle owner but was not the driver, respond within 28 days to identify the driver to an authorised officer or to demonstrate theft/unlawful use, or pay the modified penalty to avoid being deemed the driver (Schedule 2 Form 1).
• Do not remove infringement notices left on vehicles. Regulation 14 makes removing such notices an offence except for specified persons. If you find a notice, leave it undisturbed until addressed unless you are the person permitted to remove it.
• Provide name and address when lawfully required. If an officer reasonably believes you committed an offence under these regulations, you must give name and address when lawfully required under regulation 15(1), unless you have a reasonable excuse. If the officer did not inform you that failure to comply would be an offence, that may affect liability (regulation 15(3)).
• Retain evidence if contesting enforcement. If you intend to contest an infringement or challenge vehicle removal costs, retain photographic evidence of signage, vehicle position, permit display and any oral permissions given by officers.

For operators engaging tow or storage contractors:

• Ensure contracts reflect regulatory duties. If the Trust uses private contractors to remove vehicles, contracts should require contractors to follow Trust procedures, provide itemised invoices for costs incurred and ensure transparency for owners seeking refunds. Contracts should also ensure the storage facility is an approved place for removal under regulation 9(1).

In all cases:

• Document things contemporaneously. Because many enforcement powers and defences turn on what an officer said or recorded at the time (particularly the warning required under regulation 8(3) and regulation 15(3)), contemporaneous written records or photographic evidence will materially assist in any dispute.

Following these steps reduces the risk of procedural challenge, clarifies when the $100 modified penalty is appropriate, and helps all parties understand their rights and obligations under the regulations as drafted.
